CNN —Two federal judges in south Florida urged District Judge Aileen Cannon to forgo overseeing the criminal prosecution of former President Donald Trump when she was first assigned the classified documents case in 2023, according to a report from The New York Times. Cannon is still overseeing the case, which has seen a multitude of delays and is not yet scheduled to go to trial. Altonaga’s chambers declined to comment on the report to CNN. The Times did not identify the second judge who reportedly contacted Cannon. Critics of the judge say that she has slowed the pace of the case to a near standstill, making a pre-election trial essentially out of reach.

CNN —Former President Donald Trump has once again asked a judge to throw out the classified documents case, arguing this time that investigators destroyed exculpatory evidence by rifling through boxes for classified documents gathered in the FBI’s 2022 search of Mar-a-Lago. But, according to Trump, those boxes have been tampered with because investigators failed to maintain the order of their contents. CNN —Federal Judge Aileen Cannon on Tuesday rejected special counsel Jack Smith’s request for a gag order against Donald Trump in the classified documents case, saying that prosecutors’ efforts to confer with the defendant was “wholly lacking in substance and professional courtesy.”In a brief order, Cannon slammed prosecutors for not following the court’s rules by failing to meaningfully confer with Trump’s defense lawyers about a potential gag order before making the request. Prosecutors can ask for a gag order again, Cannon said, once they give “sufficient time” to Trump’s defense team to read the motion and discuss it with prosecutors. Trump’s campaign, for instance, sent a fundraising email on Tuesday that claimed FBI agents were “locked and loaded” and that he “nearly escaped death” at Mar-a-Lago. The same standard FBI policy was used in the searches of President Joe Biden’s homes and offices in a separate classified documents investigation. In a blistering court filing late on Memorial Day, attorneys for Trump said that the gag order request was an “extraordinary, unprecedented, and unconstitutional censorship application” to target Trump’s speech as he runs for president.

Former President Donald J. Trump’s lawyers on Monday assailed a request by federal prosecutors to limit what he could say about a new flare-up in a case accusing him of illegally retaining classified documents after leaving office. In an angry court filing, the lawyers pushed back hard against the request by the office of the special counsel, Jack Smith, to revise Mr. Trump’s conditions of release by forbidding him to make any public comments that might endanger federal agents working on the prosecution. On Friday evening, Mr. Smith’s team requested what amounted to a limited gag order on Mr. Trump, prompted by what it called “grossly misleading” social media posts the former president made last week falsely claiming that the F.B.I. had been authorized to kill him when agents searched Mar-a-Lago, his Florida club and residence, in August 2022. The former president’s statements were based on a recently unsealed operational order for the search that contained boilerplate language spelling out that the use of deadly force could be used only in case of emergency, a standard provision applied to all searches conducted by the bureau.
