WASHINGTON (AP) — Self-help author and spiritual guru Marianne Williamson on Wednesday announced the end of her long-shot Democratic challenge to President Joe Biden. She won just 2% of the vote in South Carolina and about 3% in Nevada. “I hope future candidates will take what works for them, drinking from the well of information we prepared,” Williamson wrote in announcing the end of her bid. She tweaked Biden, an avid Amtrak fan, by announcing her campaign at Washington’s Union Station. Two and a half centuries after its creation, the Royal Academy of Arts in London — an artist-and-architect-led institution that is a bastion of the British establishment — is embracing inclusivity. Last year, for the first time, it dedicated a major solo show to a woman, Marina Abramovic. Now comes “Entangled Pasts, 1768-Now: Art, Colonialism and Change,” an exhibition on how British art was implicated by slavery, with historic depictions of enslaved people displayed alongside contemporary works by artists of African and Caribbean origin. The show is part of a reassessment of Britain’s colonial past by museums and cultural institutions, including the 129-year-old National Trust, a charity that runs historic houses and heritage sites across the country, and a few owners of stately homes. CNN —Black History Month, which gets underway this week, is a chance to give Americans the timely reminder that you can’t teach our history honestly without understanding Black struggle and triumph. There are few aspects of America’s past that haven’t been impacted by conscientious Black people and their resistance to systemic racism and illiberal democracy. The situation at Harvard has been made more dire by the university’s failure to push back sufficiently against broader political attacks. While we await oral argument in Trump v. Anderson — the Supreme Court case that will evaluate the Colorado Supreme Court’s decision to exclude the former president from the state’s Republican primary ballot — it’s worth revisiting the arguments leveled against the Colorado court’s decision and, by extension, its interpretation of Section 3 of the 14th Amendment to the U.S. Constitution. The first and most important one is that the plot to overturn the results of the 2020 presidential election, culminating in the Jan. 6 attack on the United States Capitol, was not an insurrection. Related to this is the argument that, even if Jan. 6 was an insurrection, it’s still not clear that Donald Trump was an insurrectionist. If that isn’t persuasive, consider the evidence marshaled by the legal scholars Akhil Reed Amar and Vikram David Amar in a more recent amicus brief. They argue that top of mind for the drafters of the 14th Amendment were the actions of John B. Floyd, the secretary of war during the secession crisis of November 1860 to March 1861.

Most of my writing this week was on the recent elections in Iowa and New Hampshire, but most of my reading was focused elsewhere. In particular, I want to highlight this report from Jessica Valenti, published in her excellent newsletter, on proposed travel bans for abortion care in Tennessee and Oklahoma. The Tennessee ban, proposed by State Representative Jason Zachary, would make it a felony to take a minor out of state to obtain an abortion. I have written about how abortion bans implicate a broad set of rights tied to our personal and bodily autonomy, including the right to travel between states. The federal government, by contrast, was a limited government of enumerated powers — a government that could take only such action as allowed by the Constitution.

But there’s a critical philosophical question that lies beneath the legal questions in this case. In a representative democracy, the people are sovereign, and they express their sovereignty through representatives of their choice. If the courts presume to pre-emptively reject the people’s choice, then who is truly sovereign? The question of sovereignty was central to the purpose of the 14th Amendment in the first place.
