The letter also cited presidential immunity as a reason to dismiss the case, and maintained Trump is already protected by it. "Just as a sitting President is completely immune from any criminal process, so too is President Trump as President-elect," the letter said. The attorneys have argued he can't be sentenced while in office because it would interfere with his constitutional duties. President-elect Donald Trump is now receiving intelligence briefings after having declined them during his campaign, according to a source with knowledge of the matter and a former U.S. official. “ODNI is acting consistent with the tradition, in place since 1952, of providing intelligence briefings to the President-elect,” an ODNI spokesperson said. The office would not comment specifically on whether Trump was actually accepting the offer of the briefings. A Trump transition team representative was not able to confirm that Trump had begun receiving the briefings. Before the election, Trump had said he did not want to get the intelligence briefings to avoid any chance he would be accused of leaking information.

New York prosecutors told the judge who presided over Donald Trump's hush money trial on Tuesday that his sentencing should be postponed while the president-elect's lawyers file further legal arguments asking the case be dismissed.
