The surgeon general’s 837-page report on tobacco use found that 37.8% of gay, lesbian and bisexual U.S. adults have tried electronic cigarettes, compared with just 16.5% of their straight counterparts. He said that LGBTQ people use tobacco products at higher rates largely because of “long-standing stigma” within health care settings. Still, 36 million U.S. adults and 760,000 middle and high school students smoke tobacco products, according to the report. New York prosecutors told the judge who presided over Donald Trump's hush money trial on Tuesday that his sentencing should be postponed while the president-elect's lawyers file further legal arguments asking the case be dismissed. The proposal Tuesday from Manhattan District Attorney Alvin Bragg's office would need to be signed off on by Judge Juan Merchan to become official. CNN —Brazilian police have arrested five people, including a former adviser to ex-President Jair Bolsonaro, over an alleged plot to assassinate President Luiz Inácio Lula da Silva in 2022, authorities said. The coup plot was conceived in late 2022, before Lula took office, according to Federal Police. The alleged plot also involved other military personnel with training in special forces, the Federal Police said. “The governor will defer to the DA-elect’s review and analysis of the Menendez case prior to making any clemency decisions.”Current District Attorney George Gascón, who has voiced strong support for the Menendez brothers’ clemency petition and submitted letters to the governor advocating for them, requested a judge in October to resentence the siblings, who are serving life without parole. With Hochman set to take office in December, questions have arisen about the future of the resentencing effort and the clemency process. The brothers, family members and the public deserve a thorough review, Hochman said. The renewed examination of the Menendez case comes more than 35 years after Jose and Kitty Menendez were shot dead in their Beverly Hills home. In the subsequent trial, much of the evidence regarding the alleged abuse was deemed inadmissible, resulting in the brothers’ conviction and life sentences.

CNN —Two women who claim they were paid for sex by former Rep. Matt Gaetz provided House ethics investigators with “numerous” photos related to time they spent with the Florida Republican, a lawyer for the women said Tuesday, including from an alleged 2019 trip to New York. The women additionally provided the House Ethics Committee with selfies Gaetz is said to have sent them, according to their lawyer. They also testified that they sent nude photos to Gaetz, sometimes at his request, Leppard said. Leppard’s account of the testimony provides more insight into the evidence the House committee collected in its probe, which was conducted in addition to a criminal investigation by the Justice Department. “What I’m telling you is just a fraction of the evidence that’s available, of the thousands of documents” the House obtained, Leppard said.
