A woman in Kentucky who is seeking an abortion filed a lawsuit Tuesday that seeks to strike down the state’s near total ban. The suit, filed by a woman referred to in the documents as Mary Poe, alleges that two Kentucky abortion laws violate the state Constitution’s rights to privacy and self-determination. “I feel overwhelmed and frustrated that I cannot access abortion care here in my own state, and I have started the difficult process of arranging to get care in another state where it’s legal. Poe’s lawsuit is also requesting class-action status for all pregnant people in Kentucky who are seeking access to abortion in the state but are not allowed to receive the medical treatment because of the abortion laws. In 2022, the ACLU was involved in a lawsuit brought by abortion providers on behalf of their patients.

President-elect Donald Trump is planning to nominate South Dakota Republican Gov. Kristi Noem to serve as the secretary of the Department of Homeland Security, according to four sources familiar with the decision. As Homeland Security secretary, Noem would oversee a number of key federal agencies including U.S. Immigration and Customs Enforcement, U.S. Customs and Border Protection, the Federal Emergency Management Agency (FEMA), the U.S. Secret Service, TSA and the Coast Guard. Noem has criticized President Joe Biden's handling of the border, echoing arguments made by Trump that violent criminals are flooding into the country. Similar to Trump's other allies, Noem had signaled support for his efforts to overturn the 2020 election results.

PHOENIX — Democratic Rep. Ruben Gallego will be Arizona’s first Latino senator next year, NBC News projects, after he defeated Republican Kari Lake amid a protracted vote count in one of the key swing states. Trump won the state in 2016 and won it again this year by what appears to be his biggest margin in any of the core swing states. But he kept his message homed on the issues behind those identities, linking them to border security, comprehensive immigration reform and expanded mental health services for veterans. Gallego focused on his party’s strengths, like reproductive rights, but he also tried to tackle his party’s weaknesses head-on, advertising on issues like border security. CNN —The man accused of killing Georgia nursing student Laken Riley on Tuesday waived his right to a trial by jury and agreed to a bench trial – where a judge will decide his guilt or innocence. With the prosecution in agreement, Superior Court Judge H. Patrick Haggard approved 26-year-old Jose Antonio Ibarra’s waiver. Ibarra, through his translator, told the judge he understands he can’t go back and change this decision. Riley, a 22-year-old Augusta University College of Nursing student, was killed on February 22 while out for a run on the University of Georgia’s campus. Laken Riley, 22, was killed while on a jog at the University of Georgia's campus in February 2024.

President-elect Donald Trump on Monday selected former Rep. Lee Zeldin of New York to oversee the Environmental Protection Agency in his administration. In a statement announcing the appointment, Trump described the former four-term House Republican from Long Island as "a true fighter for America First policies." We will do so while protecting access to clean air and water," Zeldin said in a statement on X. The New York Post first reported Zeldin's appointment — Trump's second Cabinet pick for his second term in office. President-elect Donald Trump is expected to name Stephen Miller as his deputy chief of staff for policy at the White House, a source with knowledge of the transition team's plans said Monday. While Trump hasn't made his choice public yet, Vice President-elect JD Vance appeared to confirm the news in a post on X as he reacted to CNN's report about Miller being chosen for the role. Vance said. Miller, a staunch hardliner on immigration policy, worked in the White House during Trump's first term in office, serving both as director of speechwriting and as a senior adviser to the president. Private prison stocks rose on Monday after President-elect Donald Trump selected immigration hard-liner Tom Homan as his “border czar.”The Geo Group jumped more than 4% and and CoreCivic nearly 8% in premarket trading. Homan served as the head of Immigration and Customs Enforcement during Trump’s first term. Homan told a conservative conference in July that he “will run the biggest deportation operation this country has ever seen” when Trump returns to office. The second Trump administration would allow for contracting with the U.S. Marshalls Services and the Federal Bureau of Prisons, Boltansky said. “More importantly they would take a far more aggressive stance on border enforcement, which would impact the ICE business lines at these firms,” the analyst told clients.
