Hunter Biden’s foreign business dealings and private life have provided political fodder for Republicans seeking to pin wrongdoing on his father. Here’s what you need to know about the legal challenges facing the president’s son. Photo Illustration: Ryan TrefesThe yearslong criminal investigation into Hunter Biden has aired a lot of dirty laundry about the president’s son’s attempts at foreign business and his descent into drug addiction. A parallel congressional probe is now airing a lot of dirty laundry about the government officials investigating him. The younger Biden was indicted in September on three felony gun charges and pleaded not guilty last month in Delaware federal court.

WASHINGTON (AP) — The prosecutor overseeing the Hunter Biden investigation is expected to testify on Tuesday, marking the first time a special counsel will appear before Congress in the middle of a probe. The rare move by the Justice Department to allow a special counsel or any federal prosecutor to face questioning before the conclusion of an investigation indicates just how seriously the department is taking accusations of interference. Weiss' appearance comes after months of back-and-forth negotiations between Republicans on the Judiciary Committee and the Justice Department as lawmakers subpoenaed several investigators and attorneys involved in the Hunter Biden case. But the IRS whistleblower, who testified publicly over the summer, insists his testimony reflects a pattern of interference and preferential treatment in the Hunter Biden case and not just disagreement with their superiors about what investigative steps to take. In the Hunter Biden case, defense attorneys have already indicated they plan to challenge the gun charges he is currently facing on several other legal fronts and suggested that prosecutors bowed to political pressure in filing those charges.

The Supreme Court is considering a section of federal law that bars an individual subject to a domestic violence restraining order from possessing a firearm. But then the Supreme Court issued its Second Amendment decision in Bruen. The 6-3 Bruen decision broke along familiar conservative-liberal ideological lines. But Justice Brett Kavanaugh, joined by Chief Justice John Roberts, wrote separately to stress that the Second Amendment right is not unlimited. The Second Amendment is “neither a regulatory straitjacket nor a regulatory blank check,” Kavanaugh said.

His testimony sheds new light on how his office vetted the tip, and he disputed past Democratic claims that he “closed” the matter without recommending any further scrutiny. However, it doesn’t bolster the GOP narrative that Joe Biden or his son Hunter Biden were offered or accepted a bribe. The informant described his interactions with Mykola Zlochevsky, a Ukrainian oligarch and owner of the energy company Burisma, where Hunter Biden had served on the board. The saga of a once-trusted FBI informant bringing explosive but unverified claims about a presidential candidate is reminiscent of the Christopher Steele debacle in 2016. This time, the political roles are reversed: Republicans are championing the unproven bribery claims, as Democrats try to discredit the material.

WASHINGTON (AP) — The special counsel overseeing the Hunter Biden investigation is expected to testify before a Congressional committee behind closed doors as a GOP probe into the Justice Department's handling of the case continues to unfold. In a rare step, David Weiss is set to appear for a transcribed interview before members of the House Judiciary Committee on Nov. 7, sources told The Associated Press Friday on the condition of anonymity to discuss the closed-door appearance. However, the Justice Department noted in a letter to the Judiciary Committee last month that he could be called on for public testimony after the investigation is over. Hunter Biden has now been charged with three felony firearm courts related to his purchase of a gun in 2018, a period when he has acknowledged struggling with addiction. Weiss has also indicated Hunter Biden could face tax charges, though none have yet been filed.

Law enforcement investigations and criminal prosecutions will continue “without interruption,” the plan says, and prisons will remain staffed. Special counsels are instead funded by “the permanent, indefinite appropriation for independent counsels,” according to their expenditure reports. Civil litigation in lower federal courts will be “curtailed or postponed,” according to the Justice Department contingency plan. A shutdown also could affect state and local efforts to address violent crime, Monaco said. During a hearing on Capitol Hill last week, Attorney General Merrick Garland said that a shutdown would “certainly disrupt” programs like “our grant programs to state and local law enforcement.”

Kevin Dietsch/Getty ImagesHouse Republicans are taking their next official steps in their impeachment inquiry of President Joe Biden by preparing a hearing and subpoenas to members of the Biden family, as well as scheduling the first hearing in the investigation for September 28. A committee spokesperson told CNN that the hearing will focus on the constitutional and legal questions Republicans are raising about Biden. “It’s an informative hearing where we’re going to have some experts in different areas of the law that can answer questions pertaining to specific crimes, as well as to educate and inform exactly what an impeachment inquiry is, and why you do an impeachment inquiry,” Comer, a Republican from Kentucky, told CNN. The subpoenas are the first direct outreach to members of the Biden family and are expected to be for their personal and business records. Republicans have made Hunter Biden’s business dealings a central component of their impeachment inquiry, but there is no public evidence to date that the president personally received any money.

Chairman of the House Oversight Committee James Comer said that House Republicans have amassed “a mountain of evidence” showing that Biden “abused his public office for his family’s financial gain.”Yet, as has been the case since they began lobbing the sensational accusations, they offered nothing to support them. Turley added that, in his view, House Republicans passed the threshold for an impeachment inquiry into Biden’s conduct but that the evidence made public thus far lacks teeth and would, in his view, favor Biden. Thus far, no evidence has surfaced suggesting the president has accepted bribes or abused his positions in office. In at least one such cash transfer, Hunter Biden used the president’s home address in the wire form, which Republicans said on Thursday provides a critical link to the president. McCarthy gave his blessing to the impeachment inquiry earlier this month after pressure mounted from former President Donald Trump and his allies in the House.

WASHINGTON (AP) — Hunter Biden sued Rudy Giuliani and another attorney Tuesday, saying the two wrongly accessed and shared his personal data after obtaining it from the owner of a Delaware computer repair shop. The suit filed in California also claims Biden’s data was “manipulated, altered and damaged” before it was sent to Giuliani and Costello, and has been further altered since then. House Republicans, meanwhile, have continued to investigate every aspect of Hunter Biden's business dealings and sought to tie them to his father, the president, as part of an impeachment inquiry. Hunter Biden, meanwhile, after remaining silent as the images are splayed across the country, has changed his tactic, and his allies have signaled there's more to come. Giuliani provided the information to a reporter at the New York Post, which first wrote about the laptop, Biden's attorney said in a letter pushing for a federal investigation.

CNN —Hunter Biden filed a civil lawsuit Tuesday against Rudy Giuliani and his former attorney, claiming they caused “total annihilation” of his digital privacy and violated federal and state computer privacy laws through their alleged efforts to hack his devices. It comes as Republicans launch an impeachment inquiry into his father, President Joe Biden, that’s also examining Hunter Biden’s business dealings. Earlier this month, Hunter Biden brought a similar civil suit against former Trump White House aide Garrett Ziegler, claiming that since leaving his White House post, Ziegler “has devoted most of his waking time and energy” on the effort to access devices that purportedly belonged to Hunter Biden. And last week, Hunter Biden sued the Internal Revenue Service, alleging its agents illegally released his tax information and that the agency failed to protect his private records. The suit accuses Giuliani and Costello of breaking both federal and California state computer privacy laws and asks for a jury trial in the matter.

CNN —President Joe Biden and his Oval Office predecessor, Donald Trump, are about to wage the most direct showdown yet of their possible rematch as far-right House Republicans drive the nation to the brink of a government shutdown. Trump, seeking to sow dysfunction on Biden’s watch and advance his political goals as the GOP front-runner for 2024, is goading his loyalists to shut Washington down. Michigan – which Trump won in 2016 but Biden pulled back into the Democratic column in 2020 – will again be a vital general election state. With the political heat over a potential shutdown rising, Transportation Secretary Pete Buttigieg toured Sunday political talk shows to pressure Republicans. He wrote on his Truth Social network that the shutdown was the “last chance to defund these political prosecutions against me and other Patriots.

We’re looking back at the strongest, smartest opinion takes of the week from CNN and other outlets. It became a meme (are you even in a relationship if she hasn’t asked you about the Roman Empire? They marvel at their absolute dominion, their mastery of every strand of civilisation — and then how that power suddenly slipped away. CNN —House Republicans and Attorney General Merrick Garland clashed Wednesday at a testy hearing that offered a preview of the coming Republican impeachment inquiry into President Joe Biden focused on allegations surrounding his son, Hunter Biden. He also didn’t engage in GOP attacks against special counsel Jack Smith’s investigations into former President Donald Trump. Judiciary Chairman Jim Jordan, one of the three committee chairs spearheading the impeachment inquiry, accused the Justice Department of not prosecuting Hunter Biden over the tax years when Hunter Biden was on the board of Ukrainian energy firm Burisma. “I’m going to say again, and again, if necessary, I did not interfere with, did not investigate, did not make determinations” on the Hunter Biden case, the attorney general said. CNN —Attorney General Merrick Garland forcefully rebuked congressional Republicans who have accused the Justice Department of political bias as he opened a contentious House Judiciary Committee hearing in Washington on Wednesday. Even with the face-saving indictment last week of Hunter Biden, everyone knows the fix is in,” House Judiciary Chairman Jim Jordan said in his opening statement. The House Judiciary Committee has also been probing allegations from an IRS whistleblower that the Justice Department investigation into Hunter Biden was politically tainted. “House Republicans will use their time today to talk about long-discredited conspiracy theories and Hunter Biden’s laptop. Several House Republicans – including McCarthy – have floated an impeachment of the attorney general, although those calls have quieted down as House Republicans have turned their impeachment lens on President Joe Biden himself.

CNN —A federal magistrate judge has denied Hunter Biden’s request to appear virtually for his first court hearing in the federal gun case against him and set his arraignment for September 26. The initial court appearance and arraignment for President Joe Biden’s son will be held at 10 a.m. ET on Tuesday before Magistrate Judge Christopher J. Burke. The deal fell apart under scrutiny from another federal judge, who had taken several recesses to allow the attorneys to regroup and see if they could resolve disagreements. Given the seriousness of the felony gun charges, prosecutors say the magistrate judge should assess Biden in person before deciding his conditions of release.

The lawsuit against the IRS is only the latest in a series of counterpunches by the president's son. Now, Hunter Biden could be heading to trial in the midst of his father’s reelection effort. Hunter Biden, according to his memoir, tumbled into drug addiction after the death of his older brother, Beau, in 2015. Earlier this year Hunter Biden hired high-profile attorney Abbe Lowell, a legal heavyweight known for also representing Jared Kushner and Ivanka Trump. “And it is not even touching on the issue of whether people think that he is being prosecuted because he’s Hunter Biden," she said.

The new testimony comes as House Republicans begin an impeachment inquiry into President Joe Biden and his family, potentially undercutting one element of that effort. At issue is an October 2022 meeting between prosecutors and case agents working on the Hunter Biden investigation. But the deal fell apart amid scrutiny from a judge, and Weiss subsequently requested special counsel status. Shapley, a 14-year IRS veteran who oversaw parts of the Hunter Biden probe, alleged in testimony to Congress there was political interference in the investigation. Last week, CNN and others reported on Sobocinski’s testimony, which prompted Shapley’s attorneys to dispute his recollection of the October 2022 meeting.

He is seeking, among other things, all documents involving the disclosure of the tax information, $1,000 for each unauthorized disclosure and attorneys fees. The lawsuit, which was filed in federal court in Washington, DC, does not name the two IRS agents turned whistleblowers as defendants. The octogenarian president is increasingly coming under scrutiny over his ability to serve a full second term if he wins in November 2024. But the trauma seizing Washington will soon intrude, transfixing the nation in a tumultuous 2024 election. The turmoil in the Republican Party is creating the kind of dysfunction and extremism that could turn off general election voters next year. In more placid times, the auto strike would be a dominant national issue defining a fraught political moment. But it’s just one of many crises threatening to overwhelm a political system that appears on the verge of a serious malfunction.

Hunter Biden sued the Internal Revenue Service on Monday, saying that investigators for the agency violated his privacy rights by disclosing details to Congress and the public about his taxes and the investigation into his conduct. Mr. Biden, the president’s son, filed the suit days after the Justice Department indicted him on separate charges relating to his purchase of a handgun in 2018. investigators violated the agency’s rules on taxpayer privacy and “targeted and sought to embarrass Mr. Biden via public statements to the media in which they and their representatives disclosed confidential information about a private citizen’s tax matters.”It points to the public testimony and statements by two I.R.S. investigators, Gary Shapley and Joseph Ziegler, who have been providing information to House committees seeking evidence of wrongdoing by President Biden and his family. Mr. Shapley and Mr. Ziegler have told House Republicans that they believe the Justice Department inquiry into Hunter Biden’s taxes was influenced by politics.
