WASHINGTON (AP) — The top vote-getter in Tuesday’s Republican presidential primary in Nevada wasn’t former U.N. Instead, Nevada voters mounted a ballot-box protest and gave the most votes to “None of these candidates,” a ballot option required by state law. At the time the race was called, “None of these candidates” led with about 60% of the vote. Initial returns showed “None of these candidates” leading in seven counties that Trump carried in his 2016 Nevada caucus win. CNN —Donald Trump is not immune from prosecution for alleged crimes he committed during his presidency to reverse the 2020 election results, a federal appeals court said Tuesday. The ruling is a major blow to Trump’s key defense thus far in the federal election subversion case brought against him by special counsel Jack Smith. “For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant. But any executive immunity that may have protected him while he served as President no longer protects him against this prosecution,” the court wrote. But it also sets the stage for additional appeals from the Republican ex-president that could reach the U.S. Supreme Court and result in further delays. The judges gave Trump until February 12 to ask the Supreme Court to pause the ruling. The appeals court took center stage in the immunity dispute after the Supreme Court in December said it was at least temporarily staying out of it, rejecting a request from Smith's team to take up the matter quickly and issue a speedy ruling. Trump has pledged to appeal and has until Monday to ask the Supreme Court to temporarily block the ruling. Perhaps to speed things along, the appeals court established a quick schedule for Trump to respond to Tuesday’s ruling, giving Trump until February 12 to file an emergency stay request with the Supreme Court. The Supreme Court, however, can take as long as it likes at each step. The cases are entirely separate – this is a criminal prosecution against Trump, and the upcoming Supreme Court case is a civil attempt to remove Trump from state ballots. Further, the appeals court’s findings and explanations in Tuesday’s ruling are not binding on the Supreme Court.

The problem with this approach is that most Republican voters do not want an alternative to Trump; they overwhelmingly back him. At least that’s what the Nikki Haley campaign said after finishing second to former President Donald Trump in the New Hampshire primaries on Tuesday. Democratic nominee Bill Clinton and third-party candidate Ross Perot exploited that division in the Republican Party against Bush in the fall. The Republican Party is united behind Trump, and with optimal conditions for an opponent like Haley, Trump was still unstoppable. “Democrats deserve options, and it’s not clear at all that President Biden can beat Donald Trump.

CNN —The Doomsday Clock that has been ticking for 77 years is no ordinary clock — it attempts to gauge how close humanity is to destroying the world. Last year the Bulletin set the clock at 90 seconds to midnight mainly due to Russia’s invasion of Ukraine and the increased risk of nuclear escalation. The clock isn’t designed to definitively measure existential threats, but rather to spark conversations about difficult scientific topics such as climate change, according to the Bulletin. Originally, the organization was conceived to measure nuclear threats, but in 2007 the Bulletin made the decision to include climate change in its calculations. “When the clock is at midnight, that means there’s been some sort of nuclear exchange or catastrophic climate change that’s wiped out humanity,” she said.

Donald Trump’s victory in the Iowa caucuses was resounding enough to make the race for the Republican nomination look essentially finished at the start. But it wasn’t resounding enough to remove the sense that it could have been otherwise, that yet again his opposition within the Republican Party made things ridiculously easy for his candidacy. Trump is essentially running an incumbent’s campaign, presenting himself as the default leader of the party, declining to debate, rolling up endorsements. Eugene McCarthy’s 42 percent of the New Hampshire primary vote in 1968 forced Lyndon Johnson out of the race. Ted Kennedy’s 31 percent in Iowa and 37 percent in New Hampshire in 1980 betokened a long and bitter campaign for Jimmy Carter.

Some version of the Insurrection Act is probably necessary. The authority granted by the act, however, is remarkably broad, and oversight is virtually nonexistent. The Insurrection Act contains a number of provisions, and not all are equally bad. But the act gets worse, much worse. You might wonder why the Insurrection Act hasn’t presented much of a problem before now.

No one behind in the national polls by as much as Haley at this point in the primary calendar has ever ended up winning the nomination. A late October Des Moines Register poll had Trump at 43% to Haley and DeSantis each at 16% in Iowa. They both went on to win Iowa. Haley, however, doesn’t need to win Iowa to secure the GOP nomination. Hart’s overperformance in Iowa was a big reason he went to win the New Hampshire primary in 1984.

On the Democratic side, Barack Obama won the Iowa caucuses in 2008 and went on to win the White House. And Trump, although he’s the favorite in pre-caucus polling this year, lost the Iowa caucuses in 2016 to Cruz. Weren’t there some problems with the Iowa caucuses? This is the first time since 1972 that the Iowa caucuses will not be the first event on Democrats’ presidential nomination calendar.
