Companies Tesla Inc FollowJuly 21 (Reuters) - A federal appeals court on Friday said it will reconsider its recent decision that Tesla (TSLA.O) Chief Executive Elon Musk violated federal labor law by tweeting that employees would lose stock options if they joined a union. Circuit Court of Appeals in New Orleans granted Tesla's request to revisit the case "en banc," meaning that its 16 active judges will take part. Musk issued the tweet as the United Auto Workers sought to organize employees at Tesla's plant in Fremont, California. "But why pay union dues & give up stock options for nothing?" The appeals court panel found "substantial evidence" that the tweet was "an implied threat to end stock options as retaliation for unionization."

In case you missed it: This is the last week of 10 Things in Tech. The EV company only has six gigafactories across the world: Fremont, California; Sparks, Nevada; Berlin; Shanghai; Austin, Texas; and Buffalo, New York. Each location is outfitted with solar panels, and Musk claims 100 gigafactories could supply the world with all of its energy. But technological advances have also reduced the performance gap with more widely used materials such as nickel and cobalt. Ford Motor (F.N) aims to open a $3.5 billion LFP cell manufacturing plant in western Michigan, leveraging technology licensed from China’s CATL (300750.SZ), the world’s largest EV battery maker. The rapidly increasing adoption of LFP by EV manufacturers including Tesla and Hyundai suggests those companies “are not ready to decouple from China," Meng said.

WASHINGTON, June 22 (Reuters) - The U.S. Energy Department plans to lend up to $9.2 billion to a joint venture of Ford Motor (F.N) and South Korea's SK On to help it build three battery plants in Tennessee and Kentucky. The conditional commitment for the low-cost government loan for the BlueOval SK joint venture comes from the government's Advanced Technology Vehicles Manufacturing (ATVM) loan program. The joint venture is building three battery manufacturing facilities in Kentucky and Tennessee capable of collectively producing more than 120 gigawatt hours annually, the Energy Department said. This is the sixth loan for battery supply chain projects from the ATVM program. Last year, the department awarded a joint venture of General Motors (GM.N) and LG Energy Solution (373220.KS) $2.5 billion to help finance construction of new lithium-ion battery cell manufacturing facilities.

A judge said that amount was excessive and ordered a second trial on damages after Diaz rejected a reduced award of $15 million. "There is no other explanation for the extraordinary gap between the first and second jury's damages verdicts," his lawyers wrote. Diaz also renewed a motion for a mistrial on similar grounds, which the judge had denied in the middle of the retrial. The U.S. Supreme Court has said punitive damages should be no more than nine times the amount of other damages. Lawyers for Tesla and Diaz did not immediately respond to requests for comment on Wednesday.

A Black former Tesla contract worker who was awarded $3.2 million in damages in a racial harassment case against the company is seeking a retrial, saying that the use of "poisonous messaging" tainted the proceedings. Diaz told the court in 2021 that colleagues verbally abused him and told him to "go back to Africa," according to CNBC. These lawyers said that the $3.2 million payout is disproportionate to Diaz's compensatory damages, per Bloomberg.
Companies Tesla Inc FollowWASHINGTON, May 8 (Reuters) - A group of seven U.S. senators on Monday questioned Tesla Inc's (TSLA.O) use of forced arbitration clauses in employee and consumer contracts, arguing that they prevent bringing discrimination claims and consumer safety complaints to court. Tesla has said it does not tolerate workplace discrimination and takes worker complaints seriously. The senators cited an ongoing National Highway Traffic Safety Administration investigation into reports of “phantom braking" in Tesla vehicles. The senators sought answers to detailed questions by June 8 about Tesla's use of forced arbitration. The senators said arbitration clauses may keep"potential safety flaws from the public eye and limited regulatory authorities’ ability to protect Tesla customers and employees and hold Tesla publicly accountable."
A group of mostly Democratic senators pressured Tesla CEO Elon Musk to end the company's use of forced arbitration clauses in employee and customer contracts, in a letter on Monday. Forced arbitration clauses in consumer contracts have similarly obscured important details about Tesla's vehicle safety and business practices from the public, the lawmakers wrote. They asked for the same details about sexual harassment complaints from Tesla workers. However, Tesla makes and sells its cars direct to consumers so its forced arbitration clauses cover more than the norm where auto sales are concerned. Tesla uses arbitration clauses as a tactic to shunt people into a forum that's pretty rigged for the corporation."
If you're in the market for an electric car and were banking on tax credits to drop the price by $7,500, you now have fewer options to choose from. A Tesla Model 3 rolls out of the Tesla factory in Fremont, California. The list also details which electrified vehicles qualify for half credit, or $3,750. The tax credits are meant to incentivize the auto industry to move their supply chains and invest in electric vehicle development in the US. Few all-electric vehicles can get the full credit amount starting April 18, while others qualify for partial credits.
(Reuters) - Tesla Inc supervisors at a Florida service center violated U.S. labor law by telling employees not to discuss pay and other working conditions or bring complaints to higher level managers, a U.S. labor board official has ruled. The judge ordered Tesla to cease and desist from violating workers’ rights and to post notice of the violations in the service center and email it to employees. Tesla had argued that it had quickly repudiated the managers’ comments by posting a notice in the service center that Tesla policy allowed workers to discuss their pay. The judge said that attempting to silence employees violated their fundamental right under U.S. labor law to band together to advocate for better working conditions. The company is also appealing an NLRB decision that said it unlawfully barred factory workers from wearing union t-shirts.
