We determined that the most commonly discussed strategies — such as a state legislature picking a new slate of electors to the Electoral College — wouldn’t work because of impediments built into the Constitution. We also concluded that the most blatantly extreme strategies, such as a state canceling its election and selecting its electors directly, are politically unlikely. The scenario we see as the most alarming was made possible by the Supreme Court itself. In a 2021 decision, the court held, in our reading, that state legislatures have the power to direct electors on how to cast their electoral votes. The question now is whether there is any way to close that loophole before a stolen election slides through.

CNN —The special prosecutor hired by Fulton County District Attorney Fani Willis to pursue the criminal case against former President Donald Trump bought tickets for Willis to accompany him on at least two out-of-state trips, records released Friday show. The motion comes as a Fulton County commissioner has launched an inquiry into allegations that Willis misused county funds and “accepted valuable gifts and personal benefits” from Nathan Wade, according to a letter obtained by CNN. Willis has received a subpoena to appear at a deposition as part of the divorce proceedings on Tuesday. And on January 31, there is a hearing at Cobb County Superior Court regarding whether to unseal the records in the divorce case. The Fulton County judge overseeing the Georgia election subversion case has also set a February 15 hearing to consider another motion seeking to disqualify Willis over allegations of an “improper” relationship with Nathan Wade.

Atlanta CNN —Former President Donald Trump’s attorneys in the Georgia election subversion case are set to defend their client in a Fulton County courtroom for the first time on Friday as they try to have the charges thrown out on First Amendment grounds. CNN —Nevada’s attorney general is investigating individuals who acted as fake electors in the state following the 2020 election, a source close to the investigation told CNN. Attorney General Aaron Ford’s office declined to comment. In Georgia, Fulton County District Attorney Fani Willis has charged multiple individuals involved in the plot to put forth fake electors in that state, along with Trump. Michigan Attorney General Dana Nessel in July charged more than a dozen individuals who acted as fake electors. And Arizona Attorney General Kris Mayes has launched an investigation into the fake elector scheme there.

LAS VEGAS (AP) — Nevada's attorney general is investigating six Republican electors who submitted a document to Congress falsely declaring Donald Trump the winner of the 2020 presidential election, a person with knowledge of the case said Wednesday. But the probe adds to official scrutiny of so-called fake electors in several swing states won by President Joe Biden in 2020, including investigations in Georgia, Michigan and Arizona. So-called “fake electors” were charged in Georgia and Michigan, and Trump faces charges both in Georgia and in a federal investigation of his conduct related to the Jan. 6, 2021 Capitol riot. He told the Democratic Attorneys General Association last January he feared that making any comment would be seen as partisan. Efforts by AP to reach the other two fake electors, Durward James “Jim” Hindle III and Eileen Rice in northern Nevada, were not successful.

Former President Donald Trump faces a key week ahead, and yet again the drama won’t be on the campaign trail but in the courtroom as the GOP front-runner’s children prepare to testify before a judge. Ivanka Trump was initially listed as a co-defendant, but a New York appeals court dismissed that status, finding that the claims against her were too old. Chutkan had imposed a narrow gag order on Trump earlier this month, barring him from making public statements targeting prosecutors, court staff and potential witnesses. But she paused the gag order to allow Trump’s defense team time to argue why his speech should not be restricted.
