NEW YORK (AP) — A federal judge in Texas has ordered a 55-year-old U.S. agency that caters to minority-owned businesses to serve people regardless of race, siding with white business owners who claimed the program discriminated against them. The agency, which helps minority-owned businesses obtain financing and government contracts, now operates in 33 states and Puerto Rico. Justice Department lawyers representing Minority Business Development Agency declined to comment on the ruling, which can be appealed to the conservative-leaning 5th U.S. John F. Robinson, president of the National Minority Business Council, said the ruling is “a blow against minority owned businesses," and does nothing to help majority-owned businesses because they already enjoy access to federal resources through the Small Business Administration. "It has the potential of damaging the whole minority business sector because there will be less service available to minority-owned businesses,” Robinson said.

Scores of people turned out Tuesday to testify well into the night on bills being considered by Nebraska lawmakers that target diversity initiatives and higher education programs, mirroring proposals by Republicans across the country. Some bills would bar financial institutions from discriminating against those who refuse to participate in DEI programs. Meanwhile, Democrats have filed about two dozen bills in 11 states that would require or promote DEI initiatives. The Supreme Court’s June decision ending affirmative action at universities has created a new legal landscape around diversity programs in the workplace and civil society. Rob Standridge, who has authored four bills aiming to hollow out DEI programs in the state, said it has become a salient campaign theme. In a 2023 report, White said Mississippi’s public universities are spending millions on DEI programs instead of student scholarships.

Others are calling for larger foundations to help grantees if they are sued or are offering legal assistance themselves. The Council on Foundations, which supports philanthropic foundations and provides legal resources to its members to help them consider potential legal risks, submitted an amicus brief in the case supporting the Fearless Fund's First Amendment argument. “If you’re committed to DEI or race-conscious or race-based giving, you should not back down on your priorities. New York CNN —Tesla CEO Elon Musk has a new social media target: Diversity, Equity and Inclusion. Following Musk’s recent critical posts about DEI policies and racial discrimination lawsuits against Tesla, the electric car company has omitted all language regarding minority workers and outreach to minority communities in its 10-K filing with the SEC made January 29. In Musk’s eyes, DEI is “just as morally wrong as any other racism and sexism,” he tweeted in December. And as recently as 2020, Tesla had been publishing its own corporate DEI reports, reaffirming its commitment to the mission. CNN has reached out to Tesla for comment, though the company does not usually respond to press requests.
