Special counsel Jack Smith, at the beginning of 2023, obtained a search warrant for the Twitter account of Donald Trump as part of his criminal investigation into the former president's effort to reverse his loss in the 2020 election, a federal appeals court decision revealed Wednesday. The appeals court ruling says Twitter completed its production of Trump's account information for Smith's office on Feb. 9. And Twitter argued that by keeping the warrant secret from Trump, he would be unable to shield communications made using his Twitter account from prosecutors by asserting executive privilege. The unanimous ruling against the company on all points was issued by a three-judge panel of the U.S. Court Court of Appeals for the District of Columbia Circuit. Twitter was bought last year by Elon Musk, the billionaire who also heads Tesla , and SpaceX.

At around the same time, the grand jury that could soon vote on criminally charging Trump assembled in Washington federal court. A number of those anonymous grand jurors were spotted in the cafeteria and then going to the grand jury room on the courthouse's third floor, according to NBC. Trump last week revealed that Smith had told his lawyers on Sunday that the former president was a criminal target of that investigation and had been offered a four-day window to testify to the grand jury. Smith in early June obtained a grand jury indictment of Trump in Florida federal court on several dozen criminal counts related to his retention of classified government documents at his Mar-a-Lago club after he left office in early 2021.

Former President Donald Trump's 2024 campaign said Wednesday that it has raised $6.6 million since news of his federal indictment broke, including more than $4.5 million online. In an announcement, the campaign said an additional $2.1 million came in at a pre-planned fundraiser Tuesday night at Trump's Bedminster golf course in New Jersey. Altogether, that's a bit more than half of the $12 million Trump's campaign previously announced raising in the six days following the news in late March that he had been indicted in New York City.
