By Thursday evening, after a series of court battles and escalating appeals, the Texas Supreme Court had issued a temporary stay of execution. CNN —Texas death row inmate Robert Roberson sat praying in a cell Thursday night, just feet from the execution chamber where he was set to die by lethal injection for the “shaken baby” death of his toddler. Just over 90 minutes before Roberson’s execution was set to begin, the House committee was able to secure a temporary restraining order against the state, pausing the execution. Roberson’s case is called into questionAdvocates for Roberson insist the diagnosis that his daughter died from shaken baby syndrome is inaccurate and has been discredited. Shaken baby syndrome is accepted as a valid diagnosis by the American Academy of Pediatrics and supported by child abuse pediatricians who spoke with CNN. Since 1992, courts in at least 17 states and the US Army have exonerated 32 people convicted in shaken baby syndrome cases, according to the National Registry of Exonerations.

Texas is preparing to put a man to death Thursday in what would be the nation’s first execution involving a case of “shaken baby syndrome,” a diagnosis that has been re-evaluated in more recent years, leading to the overturning of similar convictions. Prosecutors argued that Nikki must have been shaken to death because she had been diagnosed with “the triad” — a swollen and bleeding brain and retinal hemorrhaging — symptoms once believed to be indisputable evidence of shaken baby syndrome. In 2009, the American Academy of Pediatrics changed the name of shaken baby syndrome to the more broadly defined “abusive head trauma” to include injuries caused by mechanisms other than shaking alone. It is now medical consensus that other medical conditions, including infections, accidental trauma and pre-existing illnesses, can also cause the symptoms associated with shaken baby syndrome. Hundreds of possible shaken baby and abusive head trauma cases are reported to hospitals in the U.S. every year, according to a nonprofit advocacy group.

Fulton County prosecutors asked a Georgia appeals court this week to restore six charges against former President Donald Trump that were tossed in his indictment over attempts to overturn his 2020 election loss in the state. In a court filing, prosecutors from Fulton County District Attorney Fani Willis' office requested that the state's Court of Appeals reinstate six counts, including three against Trump, that she said Fulton County Superior Court Judge Scott McAfee wrongly discarded earlier this year. "The trial court erred by quashing six counts of the indictment in this case, each of which alleged the crime of Solicitation of Violation of Oath by Public Officer," they wrote. The three solicitation counts against Trump included accusations that he solicited Georgia House Speaker David Ralston and twice solicited Georgia Secretary of State Brad Raffensperger. WASHINGTON — The Supreme Court on Wednesday allowed the Biden administration at least in the short term to enforce its latest attempt to curb climate-harming carbon emissions from coal- and gas-fired power plants that contribute to climate change. The Supreme Court is often skeptical of major agency actions but it has bucked that reputation in recent weeks. Under the proposed rule, the EPA wants to require “carbon capture,” a technique that uses solvents to remove carbon dioxide from a power plant’s emissions. The appeals court in July declined to block the regulation, saying the major questions doctrine did not apply on this occasion. In court papers, the challengers sought to portray the new regulation as being essentially the same as the one the Supreme Court struck down.

They were barricading the doors, trying to figure out how to protect the children.”Fifty children at the hospital each will receive roughly $60,000. “The state recognized that this was really a bad decision and harmed a lot of people,” she said of the drill. “We regret that our patients, staff and community were negatively affected by the unfortunate incident in December 2022,” she said. CNN —Fulton County District Attorney Fani Willis has asked the state’s Court of Appeals to reinstate six counts in the election subversion case against Donald Trump and his co-defendants, including three specifically against the former president. The court filing brings the aftermath of the 2020 presidential election, and the effort to overturn Trump’s election defeat, back into the spotlight as early voting begins in Georgia in the 2024 election. The counts relate to Trump and his co-defendants’ alleged efforts to have state officials appoint a fake slate of electors for the state following his loss in the 2020 election. A federal appeals court has fast-tracked the Commodity Futures Trading Commission's case challenging the right of the event exchange Kalshi to offer U.S. political election contracts. Kalshi touted its presidential election contracts on electronic signs in New York City's Times Square over the weekend. The CFTC told the appellate court that election contracts "are susceptible to market manipulation" and also pose a risk to election integrity or how the public views the integrity of elections. Kalshi CEO Tarek Mansour, in a statement, said his company is "confident" that the law allows election contracts. As of Monday, Kalshi had booked more than $7 million in contracts on the presidential election outcome.

Attorneys general in 14 different states filed lawsuits against TikTok last week. The suits mirror earlier ones against Big Tobacco and Purdue Pharma, legal experts told BI. The Sackler family, owners of Purdue Pharma, ultimately paid over $3 billion in settlements for misleading advertising related to their products. Purdue Pharma later filed for bankruptcy, but the Supreme Court struck down a $7 billion bankruptcy plan in June that would have given the Sackler's immunity from future civil suits. With the prospect of that federal ban looming next year, a slew of federal lawsuits helps shape public opinion and "pressure lawmakers to act," Rahmani said.
