One measure on the ballot in New York state this November means two very different things to its supporters and its opponents. Advocates of the measure argue that it is simply a way to codify New Yorkers’ right to reproductive care. The Coalition to Protect Kids-NY has taken to calling the measure the “Parent Replacement Act.” The group argues that the measure would be used to strip rights from parents and push transgender rights for minors, in particular. The coalition's website includes no articles or other information about the ballot measure seeking to codify a right to abortion. Hochul’s office has helped lead the state’s Democratic Party to spend over $1 million to advertise in favor of the measure, including local ads, campaign yard signs and mailers.

Lower courts in Colorado had concluded that Masterpiece Cakeshop and the bakery’s owner, Jack Phillips, had violated Autumn Scardina’s rights by refusing to make her a pink cake with blue frosting because of her identity as a transgender woman. Scardina had initially filed a discrimination complaint with the Colorado Civil Rights Division after Phillips refused to make the cake she wanted to order to celebrate her birthday and her identity as a transgender woman. Justice Melissa Hart, writing for the majority, said Scardina should have challenged that decision in an appeals court, rather than file a new lawsuit. The U.S. Supreme Court in 2018 ruled in Phillips’ favor but on narrow grounds that avoided setting a major precedent allowing people to claim religious exemptions from anti-discrimination laws. But in June 2023, in a case billed as a sort of sequel, the 6-3 conservative majority U.S. Supreme Court held the First Amendment protected web designer Lorie Smith from being compelled by Colorado to provide services to same-sex weddings.

The Department of Justice should investigate four of the nation’s biggest operators of youth residential treatment facilities for civil rights violations and fraud, Sen. Ron Wyden, D-Ore., argued Wednesday in letters to Attorney General Merrick Garland. Sen. Ron Wyden, D-Ore., led a two-year probe into residential treatment facilities for at-risk youth. Wyden said these were clear violations of federal Medicaid rules prohibiting residential treatment facilities from restraining children to discipline them, and from simultaneously restraining and secluding children. Acadia and UHS have both paid multimillion-dollar settlements in recent years to resolve DOJ probes into their hospitals and psychiatric centers. However, those cases did not focus on youth facilities run by the companies, which Wyden is asking the DOJ to investigate.

With a new academic year well underway, more than 60 colleges and universities are still under federal investigation over antisemitic and Islamophobic incidents during the campus protests that swept the United States after the Oct. 7 attacks in Israel, according to the Department of Education. The Education Department’s Office for Civil Rights has opened inquiries into dozens of schools over the past year, checking for violations of Title VI of the Civil Rights Act of 1964, which prohibits discrimination based on ethnicity or race. Documents released by the department show that around 80 percent of the Oct. 7-related investigations it undertook stemmed from complaints about antisemitism, and that many of those complaints came to the department through conservative and pro-Jewish legal advocacy groups, including several founded by high-ranking former Education Department officials. Under federal scrutiny, which carries the risk of losing federal funding, dozens of schools still facing government inquiries have moved quickly to pre-empt large campus disruptions and enforce stricter limits on certain types of speech and demonstrations.

Three former Memphis police officers were convicted Thursday of federal witness tampering charges related to the deadly beating of Tyre Nichols in 2023, according to NBC News affiliate WMC. Demetrius Haley, Justin Smith and Taddarius Bean were accused of depriving Nichols of his rights through excessive force, obstructing justice through witness tampering and other crimes. Haley was found guilty of one count of conspiracy to witness tamper and one count of obstruction of justice for witness tampering. Bean and Smith were found guilty on only one count, obstruction of justice for witness tampering, WMC reported. The witness tampering charges carry possible sentences of up to 20 years in prison.

The U.S. Department of Justice has launched a review and evaluation of the 1921 race massacre in Tulsa, Oklahoma, Assistant Attorney General Kristen Clarke said. “When we have finished our federal review, we will issue a report analyzing the massacre in light of both modern and then-existing civil rights law,” said Clarke, who oversees the Justice Department’s civil rights enforcement efforts. The review will be conducted under the Emmett Till Unsolved Civil Rights Crime Act, which allows the Department of Justice to investigate death-resulting civil rights crimes that occurred on or before Dec. 31, 1979. The massacre started after a Black man was accused of assaulting a white woman. “Although a commission, historians, lawyers and others have conducted prior examinations of the Tulsa Massacre, we, the Justice Department, never have.”Clarke said the department is examining available documents, witness accounts, scholarly and historical research and other information related to the massacre.
