This argument has been partially successful with US District Judge Aileen Cannon in the federal classified documents case. It is unclear whether the judge assigned to the Georgia case would be amenable to delay arguments. I expect that, as in the New York case, where the judge recently denied such a motion, Trump will seek to move the case against him to federal court. While those decisions may not be binding on the Georgia judge, they will be informative as he considers the issues. As president, Trump would have the power to scuttle the federal cases and a greater ability to avoid accountability in the state cases as well.

District Attorney Fani Willis brought charges against Trump and 18 other defendants under the Georgia Racketeer Influenced and Corrupt Organizations (RICO) Act. The charges include forgery in the first degree, false statements and writing, and violating the RICO Act. If found guilty under the RICO Act, Trump could face a minimum sentence of five years and a maximum sentence of 20 years and a fine. The Georgia courts have concluded that a pattern consists of at least two acts of racketeering activity within a four-year period in furtherance of one or more schemes that have the same or similar intent. That means the act might allow prosecutors to knit together the myriad efforts by Donald J. Trump and his allies, like Rudolph W. Giuliani, to overturn his narrow loss in Georgia in the 2020 presidential race. At its heart, the statute requires prosecutors to prove the existence of an “enterprise” and a “pattern of racketeering activity.” The enterprise does not have to be a purely criminal organization. Ga. prosecutors have found emails and texts linking members of Trump's legal team to a key voting breach, per CNN. The breach in question occurred in Coffee County, a rural GOP-heavy jurisdiction in southeastern Georgia. And some of the individuals linked to the breach in Coffee County might also be charged in the larger criminal investigation. According to individuals who spoke with CNN, investigators in Georgia have amassed evidence that the breach in Coffee County was driven by Trump's legal team so his allies could examine sensitive voting software. Per the CNN report, Georgia investigators have probed the participants of the breach, which included Misty Hampton, the Coffee County official who appeared to have written that invitation.

They have gathered evidence indicating it was a top-down push by Trump’s team to access sensitive voting software, according to people familiar with the situation. That group included members of Sullivan Strickler, a firm hired by Trump’s attorneys to examine voting systems in the small, heavily Republican Georgia county, according to text messages obtained by CNN. Friess then notified operatives who carried out the Coffee County breach and others working directly with Giuliani that Trump’s team had secured written permission, the texts show. Coffee County was the only county in Georgia that failed to certify its election results due to issues raised by Hampton at the time.

Former Georgia Lt. Gov Geoff Duncan, a Republican, said Saturday on CNN that he has been told to appear Tuesday before a Fulton County grand jury to testify about the efforts by Trump and his allies. Independent journalist George Chidi posted on social media later Saturday that he’d been told to appear before the grand jury on Tuesday too. The witnesses Willis has subpoenaed to testify when she presents her case include Duncan, Chidi and former Georgia state Sen. Jen Jordan, a Democrat. Georgia law is unusual in that special purpose grand juries – which have broad investigative powers – are not permitted to issue indictments. When the subpoenaed witnesses appear before the regular grand jury, those grand jurors will hear the witnesses’ testimony for the first time with a narrower purpose at hand: to approve or reject indictments.
