SPRINGFIELD, Ill. AP —The Illinois Supreme Court on Thursday overturned actor Jussie Smollett’s conviction on charges that he staged a racist and homophobic attack against himself in downtown Chicago in 2019 and lied to police. Emailed messages seeking comment were sent Thursday to Foxx’s office and to Smollett’s attorney, who have argued that Smollett has been victimized by a racist and politicized justice system. Testimony at his trial indicated Smollett paid $3,500 to two men whom he knew from “Empire” to carry out the attack. A state appellate court ruling upheld Smollett’s conviction, declaring that no one promised Smollett he wouldn’t face a fresh prosecution after accepting the original deal. Illinois Supreme Court Chief Justice Mary Jane Theis and Justice Joy Cunningham took no part in Thursday’s decision.

The Consumer Financial Protection Bureau on Thursday issued a finalized version of a rule saying it will soon supervise nonbank firms that offer financial services likes payments and wallet apps. That would include popular services from Apple and Google , as well as payment firms like PayPal and Block . "Digital payments have gone from novelty to necessity and our oversight must reflect this reality," said CFPB Director Rohit Chopra. A year ago, the CFPB said it wanted to extend its oversight to tech and fintech companies that offer financial services but that have sidestepped more scrutiny by partnering with banks. The CFPB said the rule will take effect 30 days after its publication in the Federal Register.

Intuit shares fell 6% in extended trading on Thursday after the finance software maker issued a revenue forecast for the current quarter that trailed analysts' estimates due to some sales getting delayed. Intuit called for second-quarter earnings of $2.55 to $2.61 per share, with $3.81 billion to $3.85 billion in revenue. At Thursday's close, Intuit shares were up about 9% so far in 2024, while the S&P 500 has gained almost 25% in the same period. "There is no time to waste on a needlessly protracted Washington scuffle, thus I'll be withdrawing my name from consideration to serve as Attorney General," he said. That's partly due to higher inventory levels, which rose 19% in October compared to last year. Existing home sales rose 3.4% in October, the group said. Stock futures edged lower on Thursday evening with Wall Street poised to end the week with gains in the three major averages. S&P 500 futures dipped 0.1%, while Nasdaq 100 futures were lower by 0.3%. All three major averages are on track for a positive week, led by the Nasdaq Composite's gain of 1.56%. That's a change from last week, when Wall Street's postelection rally appeared to stall. Intuit — Shares of the financial software company fell almost 5% despite an earnings report that beat expectations. Intuit reported $2.50 in adjusted earnings per share on $3.28 billion of revenue for its fiscal first quarter. SL Green Realty — The commercial real estate stock dipped more than 1% after SL Green announced a $400 million stock sale . Ross reported $5.07 billion in revenue, below the $5.15 billion expected by Wall Street. Analysts surveyed by LSEG were looking for earnings of 38 cents per share and revenue of $357 million.

New York CNN —BJ’s Wholesale Club is hiking the price of its annual membership fee for the first time since 2018. The warehouse store chain, a smaller rival to Costco and Sam’s Club, announced Thursday that the cost will increase by $5 to $60 per year for its basic plan. Annual fees have been one of the biggest profit-generating areas for BJ’s, helping it offset expenses to keep its prices down. Meanwhile, Sam’s Club last raised its fees in 2022. The company has fewer stores than its major competitors, and its locations are a little smaller, though BJ’s carries a wider variety of items.

While the S & P 500 and Nasdaq 100 have both pushed to new all-time highs in November, market breadth indicators have mostly not confirmed those recent highs. Market breadth indicators like these are equal-weighted, meaning they simply count the number of stocks fulfilling a certain requirement. The change in that indicator over the last six weeks tells us that about 20% of the S & P 500 members have registered a sell signal on their point & figure charts! This chart shows the percent of stocks above their 200-day moving average, as well as the percent of stocks above their 50-day moving average as we quoted above. The S & P 500 continues to make higher lows, but a push below 5,850 would break that pattern which has been in place since August.

The founder of the first gold-tracking ETF is still bullish on the commodity two decades later. "Things are looking good for the rest of this year and for next year," George Milling-Stanley told CNBC's "ETF Edge" this week. Even the postelection pullback in gold futures and the SPDR Gold Shares ETF (GLD) hasn't tarnished the record run this year. "This is why we've seen the stock market go up dramatically, why we've seen the cryptocurrencies go up dramatically." But the precious metal, and in turn, the GLD ETF, are "starting to claw back some of the lost ground," Milling-Stanley said.
