“No company is too big to ensure that their products do not damage our environment and public health. All New Yorkers have a basic right to clean water, yet PepsiCo’s irresponsible packaging and marketing endanger Buffalo’s water supply, environment, and public health,” James said in a statement. PepsiCo is the single largest identifiable contributor to the plastic waste contaminating the Buffalo River, according to the lawsuit. Microplastics have also been found in fish species that are known to inhabit Lake Erie and the Buffalo River, as well as Buffalo's drinking water supply, according to the lawsuit. The lawsuit alleges that the opposite is happening, and that PepsiCo misled the public about its efforts to combat plastic pollution.

NEW YORK (AP) — New York City officials say retailers and food delivery companies must do more to halt the proliferation of unsafe e-bike and e-scooter batteries, after a fire blamed on an electric scooter's lithium ion battery killed three people over the weekend. Fire officials said the fire broke out on the ground floor of the building. City officials have blamed off-market batteries and chargers that don't meet safety standards for many of the fires, and they have lobbied the federal government to strengthen regulations governing the sale of e-bikes and batteries. City officials haven't said whether the battery that caused Sunday's fire came from a vehicle used to make deliveries for one of the food service apps, and they didn't immediately respond to a Tuesday email seeking further information. Tens of thousands of the city's food delivery workers rely on e-bikes to get dinner to customers quickly, and Deputy Mayor for Operations Meera Joshi singled out the delivery industry during remarks at a City Hall news conference Tuesday, noting that time is money for delivery workers.

LAS VEGAS (AP) — New York Jets quarterback Aaron Rodgers said his goal is to return from a torn Achilles tendon by mid-December, NBC's Melissa Stark reported during the telecast of the Jets' game at Las Vegas on Sunday night. Rodgers had hinted recently he hopes to return before the end of the season, but this is the most specific he has been. He suffered what was thought to be a season-ending injury in the opener against the Buffalo Bills. However, Rodgers, who was on the sideline, told Stark he “just wasn’t feeling it” about throwing passes during pregame warmups as he has the last several weeks. Rodgers said he has been working on a weight-limiting treadmill, jogging at 50% of his body weight.

ALBANY, N.Y. (AP) — New York is requiring state health officials to develop an outreach program to educate parents and doctors about the harmful impacts of medically unnecessary treatments performed on young children born intersex. Advocates for the statewide legislation say the medically unnecessary operations on infants and young children born intersex come with a slew of potential negative impacts that parents and doctors must be aware of. Various health and human rights organizations, including the Physicians for Human Rights, a U.S.-based nonprofit that advocates against human rights violations around the world, in the past have called for an end to the medical treatments. A majority of advocacy groups estimate that there are about 5.6 million people in the United States who were born intersex, according to The Associated Press. In California, a majority of state lawmakers rejected a bill in 2020 that would have banned some medically unnecessary surgeries on intersex children until they are old enough to participate in the decision.

America’s long-promised pivot to Asia was finally gathering momentum — new security deals with the Philippines and India, expanded military exercises, and plans with allies to stay ahead of Chinese technology. Some landowners had put up concertina wire and other barriers to keep people from floating or wading in the river. The counts listed in the complaint include depriving the public of access to the Pecos River and public nuisance. In that case, the court said the constitution and pre-statehood law established a right for the public to fish, boat and engage in other forms of recreation in public water. In its 2022 opinion, the court addressed whether the right to recreational access and fishing in public water also allowed the public the right to touch privately owned land below those waters. While finding that walking and wading on the privately owned beds beneath public water was reasonably necessary for fishing or recreational activities, the court also stressed that the public "may neither trespass on privately owned land to access public water, nor trespass on privately owned land from public water.”

Australia on Saturday decisively rejected a proposal to recognise Indigenous people in the constitution, in a major setback to the country's efforts for reconciliation with its First Peoples. Nationwide, with 45% of the vote counted, the "No" vote led "Yes" by 57.35% to 42.65%. A successful referendum requires at least four of the six states to vote in favor, along with a national majority. Because of Australia's time zones, voting in Western Australia was still under way as it became clear the referendum was lost. Supporters of the proposal believe entrenching an Indigenous Voice into the constitution would unite Australia and usher in a new era with its Indigenous people.
