Lawyers for Gov. Ron DeSantis of Florida asked a federal judge on Friday to step down from a case brought by Disney, saying his comments in two unrelated court proceedings last year displayed a bias toward the company. John Guard, the Florida chief deputy attorney general, made the request to Mark E. Walker, the chief judge for the Northern District of Florida, on behalf of Mr. DeSantis. Judge Walker is presiding over the early stages of a Disney lawsuit, filed last month, that accused Mr. DeSantis and a board that oversees government services at Walt Disney World of engaging in “a targeted campaign of government retaliation.”In their motion to disqualify Judge Walker, Mr. Guard and lawyers for the five members of the board said two remarks from last year “could reasonably be understood to reflect that the court has prejudged Disney’s retaliation theory here, and therefore create significant doubts about the court’s impartiality.”In both instances, Judge Walker brought up Disney in hearings for unrelated cases, briefly citing actions by Mr. DeSantis and his allies in the Florida Legislature against the company as examples of retaliatory conduct, according to the filing. Judge Walker made one of the remarks, at a hearing in a case involving intellectual freedom on college campuses, a day after Mr. DeSantis “publicly refuted” the notion that he was taking “retaliatory” action against Disney, the filing said.

DeSantis had replaced the board with his preferred picks after he and his allies targeted Disney's special tax district. In doing so, the judge had "used the State's contemplated dissolution of Disney's special district as an example of retaliatory conduct," DeSantis' lawyers argued. "The Court's comments seemingly reflect its opinion on whether the State punished Disney's speech by revoking Disney's 'special status,'" they wrote.

The Australian police are investigating why an experienced officer used a Taser on a 95-year-old woman who had approached him “at a slow pace” while holding a steak knife. The woman, Clare Nowland, who is 5-foot-2 and 95 pounds, uses a walker and has dementia. She was left in critical condition after a senior constable used the weapon on her on Wednesday morning in the care facility where she lives, causing her to fall and hit her head, according to the police. “At the time she was Tasered, she was approaching police — but it is fair to say, at a slow pace,” Peter Cotter, the New South Wales Police assistant commissioner, said at a news conference on Friday. “She had a walking frame, but she had a knife.”The news conference was held after people in the community, rights activists and advocates for those with disabilities expressed outrage, asking whether the officer’s use of force had been necessary.
Kathmandu CNN —British mountaineer Kenton Cool has set a record for the most Mount Everest summits by a non-Nepali after reaching the top of the world’s highest mountain for the 17th time. According to a post on Cool’s Instagram account, the trio reached the top of Everest at 1:30 am British Summer Time, which is 6:15 am Nepal time. On Monday, 46-year-old Pasang Dawa Sherpa reached the mountain’s apex for the 26th time, tying his countryman Kami Rita Sherpa for the number of all-time ascents. “Unfortunately, when accidents do happen on the mountain, more often than not the tragedy tends to strike the Nepalese workers who are there supporting foreign climbers,” Ballinger told CNN. All we can do is fight and advocate for the increased regulation of the mountaineering industry in Nepal.”

MANCHESTER, England, May 17 (Reuters) - Manchester City marched into the Champions League final for the second time in three seasons after outclassing holders Real Madrid 4-0 for a 5-1 aggregate victory at a raucous Etihad Stadium on Wednesday. With Inter Milan awaiting in the final, City will now be huge favourites to finally deliver the trophy Abu Dhabi's Sheikh Mansour has craved since buying the club in 2008, having lost to Chelsea two years ago. Just as in the Spanish capital, City took an early stranglehold with Real barely stringing two passes together and finding it almost impossible to escape their own half. City toyed with the 14-times champions for the rest of the half and could have been further ahead. With their place in the Istanbul showpiece secured, City can win their fifth Premier League title in six seasons this weekend and they also have an FA Cup final to look forward to.

DroneUp, a Walmart -backed startup competing alongside Amazon and others in the nascent drone delivery market, is cutting jobs across the company, CNBC has learned. DroneUp is one of several startups racing to make drone delivery a reality. UPS , Amazon and Alphabet 's Wing unit are also in various stages of developing their own drone delivery services. Attempts at scaling commercial drone delivery in the U.S. have been slow moving, largely due to technical challenges and a lengthy regulatory approval process with the Federal Aviation Administration. The economic downturn has also proven a setback for some drone delivery operators.
Consumers barely kept up with inflation in April, as retail sales increased but fell short of expectations, the Commerce Department reported Tuesday. The advanced sales report showed an increase of 0.4%, below the Dow Jones estimate for 0.8%. Excluding auto-related figures, sales increased 0.4%, which was in line with expectations. As the numbers are not adjusted for inflation, the headline increase equaled the 0.4% monthly rise in the consumer price index. Miscellaneous store retailers led gainers with a 2.4% increase, while online sales rose 1.2% and health and personal care retailers saw a 0.9% rise.

Buffett's company made its disclosures in a regulatory filing listing its U.S.-traded stocks as of March 31. Capital One shares rose 5.7% in after-hours trading following Berkshire's disclosure of a 9.92 million share stake worth about $954 million. In Monday's filing, Berkshire also revealed a new $41.3 million stake in Diageo Plc (DGE.L), the maker of alcoholic beverages including Johnnie Walker and Guinness. BERKSHIRE BUYS MORE APPLE, BANK OF AMERICADespite the selling, Berkshire still invests in several financial services companies. Berkshire also has dozens of operating businesses including the BNSF railroad, Geico car insurance, and many energy, manufacturing and consumer units.
