The execution will be the first attempt to use a new execution method since the 1982 introduction of lethal injection, now the most common execution method in the United States. CNN —Alabama is poised to carry out the first known execution using nitrogen gas Thursday to put Kenneth Smith to death for his role in a 1988 murder for hire. The state, in court records, indicated the redactions were made to maintain security. Smith’s team again Thursday morning appealed to the US Supreme Court and requested a stay of execution. “But the way that they’re constructing this, the way that they’re doing it, the way that they’re being silent, the way that they’re holding back information, yes, it’s incredibly concerning. “The thing you’ve got to do primarily is set rules and enforce them,” said John S. Martin Jr., a former U.S. District Court judge in Manhattan. In Ms. Carroll’s defamation trial, Mr. Trump seemed almost to be goading Judge Kaplan into throwing him out of the courtroom. After his two recent confrontations with the judges, Mr. Trump held news conferences before cheering supporters in the lobby of his building at 40 Wall Street. Ms. Carroll’s defamation trial is being heard by a nine-person jury in Federal District Court, with Judge Kaplan overseeing the proceedings. During his diatribe, Mr. Trump refrained from attacking any staff members.

During a break after Ms. Carroll had spent the morning testifying about what happened after she accused Mr. Trump of raping her, one of her lawyers complained, out of the jury’s presence, that Mr. Trump had been overheard speaking at the defense table. He said “witch hunt” and “it was a con job,” loudly enough that jurors could hear, said Shawn Crowley, one of Ms. Carroll’s lawyers. Judge Lewis A. Kaplan, who had sparred all morning with Mr. Trump’s lawyer, Alina Habba, over her objections to Ms. Carroll’s testimony, appeared to be losing his patience. The jury said Carroll hadn't proven that Trump raped her. One issue that wasn’t decided in that first trial was how much Trump owed for comments he made about Carroll while he was still president. CNN —Joseph Emerson, the Alaska Airlines pilot who allegedly attempted to shut off the engines of a passenger plane mid-flight in October, was indicted on 84 counts in an Oregon court Tuesday. The grand jury indicted Emerson on one count of endangering aircraft in the first degree and 83 counts of recklessly endangering another person -– one for each person aboard the aircraft at the time of the October 22 incident. Emerson’s attorneys applauded the grand jury’s decision not to charge him with 83 counts of attempted murder. According to an affidavit filed by prosecutors, Emerson told investigators he “had consumed ‘magic mushrooms’ approximately 48 hours prior” to the incident. During the incident, he said he thought he was dreaming while commuting back to California in the cockpit jump seat of a Horizon Air flight.

Photo: dado ruvic/ReutersA U.S. appeals court has sided with Intel, vacating a roughly $2.2 billion patent-infringement verdict won by VLSI Technology , which argues that some technology in Intel’s microprocessors infringe on VLSI’s patents. The U.S. Court of Appeals for the Federal Circuit affirmed a jury’s verdict that Intel infringed on one of VLSI’s patents and reversed the verdict that Intel infringed on another of the company’s patents. The Federal Circuit sent the case back for further proceedings to determine how much Intel owes in damages.

The jury ruled last week that the egg producers used various means to limit the domestic supply of eggs to increase the price of products during the 2000s. The damages verdict was reached Friday in the Northern District of Illinois. According to federal antitrust law, the damages are automatically tripled, bringing the total to over $53 million. Court documents on the verdict were not readily available Friday evening, but statements from the manufacturers' attorney and one of the egg producers confirmed a total of about $17.7 million. Email messages sent to the United Egg Producers and United States Egg Marketers representatives were not immediately returned Friday.

INDIANAPOLIS (AP) — An Illinois jury ruled this week that several major egg producers conspired to limit the U.S.'s supply of eggs in order to raise prices in a lawsuit first filed 12 years ago. The suppliers include the family company of an Indiana egg farmer running for the U.S. Senate in the state. Attorneys for the four egg suppliers named in the lawsuit did not immediately return phone messages on Wednesday. Other food manufacturers joining as plaintiffs in the lawsuit against the egg producers are General Mills, Inc. and Nestle USA, Inc. The jury found the egg suppliers who participated in the conspiracy were Cal-Maine Foods, Inc., United Egg Producers, Inc., United States Egg Marketers, Inc. and Rose Acre Farms, Inc., a southern Indiana-based company previously chaired by John Rust.

And yet, every day, people across America hire a real estate agent to help them sell a home. While state governments license real estate agents, NAR has an extensive code of ethics it expects members to adhere to. NAR and the brokerages have vowed to appeal the verdict, which means real estate commissions aren’t going anywhere immediately. Last month Redfin, an internet real estate company, left the association. The longer-term impact of the verdict may be that the pairing of buyer’s agent commission and seller’s agent commission will eventually be separated.

Chicago-based Conagra Brands must pay out $3.1 million in compensatory damages and $4 million in punitive damages to Reese, according to the Cook County Circuit Court verdict. Consumers can check if their cooking spray cans are vented by looking at whether the bottom of the can has four small U-shaped slits, Smith said. The cooking spray that exploded near Reese had been stored on a shelf about 18 inches (46 centimeters) above the stove, according to Flowers. “In a commercial kitchen, that’s a sort of normal place where people leave their cooking spray cans when they’re actually using them. The redesign was not related to the lawsuits and was part of an effort to standardize the company’s cans, Conagra said.

LOS ANGELES (AP) — A series of court challenges are seeking to upend longstanding real estate industry practices that determine the commissions agents receive on the sale of a home — and who foots the bill. But already the NAR and several real estate brokerages are facing another lawsuit over agent commission rules. As home prices have soared in recent years, pushing the national median sales price to $394,300 as of September, so have agents’ commissions. Traditionally, that works out to a 5% to 6% commission split roughly evenly between the buyer’s and seller’s agents. “The real solution is for buyers to be able to finance the buyer-agent commissions as part of their mortgages.

CNN —A federal bankruptcy judge ruled Thursday that bankruptcy proceedings will not shield Infowars host Alex Jones from more than $1.1 billion in damages he owes the families of Sandy Hook shooting victims who won a civil defamation case against him in Connecticut last year. The families filed a motion in May asking the court to force Jones to pay the trial damages and rule out the possibility of a forced settlement in Chapter 11 proceedings. Jones and other InfoWars personalities called the massacre a hoax and accused the victims’ families of being crisis actors. Infowars filed bankruptcy last July in the middle of their trial. The summary judgments issued Thursday only addressed Alex Jones’ bankruptcy proceedings, not those of his company, which were not filed under traditional Chapter 11 bankruptcy.

Opinion: Why Lindsey Graham wasn’t indicted

(It shouldn’t be confused with the regular grand jury, whose duty it was to decide whether to indict those under criminal investigation.) The special grand jury completed its duties in December. Using the extra layer of a special grand jury is often reserved for complex corruption cases. There are multiple explanations for why some people may not have been indicted despite the special grand jury’s recommendations. Willis may simply have not presented to the regular grand jury some individuals she considered less than provably guilty.

CNN —The Fulton County special purpose grand jury investigating former President Donald Trump’s efforts to overturn his 2020 election loss in Georgia recommended charges against 39 people, the unredacted grand jury report made public Friday shows. The lengthy list of recommended charges underscores how widespread the special grand jury’s investigation was into efforts to overturn the 2020 election. The indictment also included 30 unindicted co-conspirators alleged to have taken part in the conspiracy, including some people the special grand jury recommended charges against. The special grand jury report was only a recommendation, and the district attorney decided which charges to bring to a grand jury last month before the indictment was returned. The charges against the fake electors were among the most contested in the special grand jury report.

CNN —A federal judge ruled that the jury hearing E. Jean Carroll’s defamation lawsuit will only need to decide how much money Donald Trump will have to pay her, after the judge found the former president was liable for making defamatory statements. Judge Lewis Kaplan said that a federal jury’s verdict earlier this year against Trump will carry over to the defamation case set to go to trial in January involving statements Trump made in 2019 about Carroll’s sexual assault allegations. “The truth or falsity of Mr Trump’s 2019 statements therefore depends – like the truth or falsity of his 2022 statement – on whether Ms Carroll lied about Mr Trump sexually assaulting her,” the judge ruled Wednesday. “The jury’s finding that she did not therefore is binding in this case and precludes Mr Trump from contesting the falsity of his 2019 statements.”Kaplan ruled the trial set for January 15 will be limited to damages. Although her initial lawsuit was filed in 2019, the judge previously allowed Carroll to include comments Trump made at a CNN town hall earlier this year.
