A lawyer for Johnson & Johnson’s subsidiary said in a statement that the company would seek a rehearing of the panel’s decision by the full 3rd Circuit court. Gordon’s strategy worked in bankruptcy court but set up J&J for failure when it faced the 3rd Circuit appeals panel. Gordon, at the bankruptcy conference, described the lawsuits as “completely unmanageable” and a dire threat to J&J that could go on for decades. The 7th Circuit Court of Appeals is expected to hear arguments in coming months on a challenge to the 3M subsidiary’s bankruptcy. The litigation, they asserted, should be allowed to proceed against Georgia-Pacific because the parent company did not file for bankruptcy.
3M recently said it would wind down production of PFAS, or ‘forever chemicals,’ so named because they take a long time to break down in the environment. 3M Co.’s decision to quit making “forever chemicals” represents a tactical retreat aimed at containing its potential liability over its products in legal fights expected to last for years, analysts say. 3M is defending itself against allegations that chemicals and products it has made for decades have contaminated drinking water and pose health risks. Legal and industry analysts expect 3M to be engaged for years in remediating alleged soil and water contamination from forever chemicals, which have been used in industrial and consumer products including nonstick cookware, carpeting and firefighting foam.

A conflict could arise in the future, if, for example, Aearo and 3M disagreed about the terms of a future settlement, Graham said. If that happened, Kirkland could face disqualification, loss of fees, or even potentially the dismissal of Aearo's bankruptcy case, according to the judge. Kirkland has defended 3M in the MDL, and it represents Aearo in the bankruptcy case that was meant to spur a settlement of the earplug lawsuits. The plaintiffs and the U.S. Department of Justice's bankruptcy watchdog sought to disqualify Kirkland from representing Aearo in the bankruptcy, saying it could not faithfully serve both Aearo and 3M. The case is Aearo Technologies LLC, U.S. Bankruptcy Court for the Southern District of Indiana, No.
Oct 25 (Reuters) - Post-it maker 3M Co (MMM.N) said on Tuesday it expected weak consumer spending to continue into the upcoming holiday season and cut its full-year forecasts, echoing broader concerns of an uncertain economic environment. "Consumer spending continues to be weak," 3M Chief Financial Officer Monish Patolawala said on a post-earnings call with analysts. That cut in spending has also impacted 3M, which makes equipment such as electronic accessories and power cable connectors. The diversified manufacturer, which gets 60 percent of its revenue from outside the United States, cut its full-year revenue and profit forecasts earlier on Tuesday, while also citing ongoing macroeconomic and geopolitical uncertainty. 3M reported third-quarter revenue of $8.62 billion, missing the average analyst estimate of $8.70 billion, according to Refinitiv data.
