CNN —The first criminal trial of Donald Trump is officially underway. Prosecutors and Trump’s attorneys delivered opening statements and the first witness – a former National Enquirer publisher – was called Monday in the historic and unprecedented criminal trial of a former president. “The defendant Donald Trump orchestrated a criminal scheme to corrupt the 2016 presidential election,” said prosecutor Matthew Colangelo told jurors. At the hearing, Trump’s attorneys came to an agreement with the New York attorney general’s office on the terms of that $175 million bond. Trump’s attorneys representing him in the civil matter later stopped by the criminal trial and spoke to cameras in the hallway outside the courtroom where Trump sat at the defense table.

CNN —Special counsel Jack Smith’s obstruction case in the classified documents prosecution survived an early test, with a federal judge on Thursday denying several bids by Donald Trump’s co-defendants to dismiss charges against them. Judge Aileen Cannon rejected efforts by Trump’s co-defendants Walt Nauta and Carlos De Oliveira to toss obstruction charges they faced. Nauta works as Trump’s personal valet, and De Oliveira has worked as property manager at Trump’s Florida Mar-a-Lago estate. The Florida judge still has yet to decide several motions by Trump to toss charges against him in connection with allegedly mishandling classified documents and attempting to thwart the Justice Department’s investigation. Attorneys for De Oliveira argued that the obstruction charges he faced should be dismissed because he was not aware of the grand jury subpoenas issued for classified documents kept at Mar-a-Lago when he allegedly moved boxes around the resort.

CNN —The first criminal trial of former President Donald Trump is here. Trump has complained that he cannot get a fair jury in Manhattan, where the jurors must live. He was fined twice for violating a gag order imposed by New York Judge Arthur Engoron in his civil fraud trial. This payment is not part of the charges against Trump, but prosecutors have said that the testimony would help establish a pattern of payments. Merchan also denied prosecutors’ request to show E. Jean Carroll’s deposition from her defamation case against Trump because it would be “building in a trial into a trial.”

New York Supreme Court Judge Juan Merchan is a seasoned jurist who is no stranger to Trump’s orbit. In the lead-up to the start of the trial, Trump fanned the flames on social media with his views on the judge. “Judge Merchan was always well-prepared, accessible, and – most importantly in the Weisselberg matter – a man of his word. Trump also claimed Judge Merchan has ruled against him in pretrial motions “because his daughter makes money by working to ‘Get Trump.’”Loren Merchan has not commented publicly on the case. CNN —Three months ago, Donald Trump took the stand before a jury of nine in a New York courtroom without his typical bombast or ranting. “The record will reflect that Mr. Trump just rose and walked out of the courtroom,” Judge Lewis Kaplan announced, in case any jurors had missed it. “I mean, our whole case was about the fact that Donald Trump is unable to follow the law, unable to follow the rules. But just having political views about Trump, for or against, won’t be a reason for potential jurors to be dismissed. When Kaplan asked jurors a series of questions individually, Trump turned in his chair to watch each person speak.

Letitia James won a $454 million judgment against Trump, his penalty for a decade of fraud. She and Trump are now fighting over her claims that he withheld evidence from her fraud probe. "The Court is well within its authority to determine if Defendants and their counsel facilitated that perjury by withholding of incriminating documents," James argued in Tuesday night's letter. AdvertisementAt a hearing in April of 2022, he compared getting Trump's documents to "pulling teeth." Out of some 900,000 documents turned over, only ten were "custodial" Trump documents, meaning business files in the former president's direct custody.

Lara Trump has a long history of echoing his election fraud claims, according to a CNN KFile analysis of her past statements as a commentator and surrogate for the former president. There is no evidence of widespread fraud in the 2020 election, as even some state GOP election officials and former Trump Attorney General William Barr have acknowledged. But in the years since the 2020 election, Lara Trump has continued to push claims of fraud. In the same interview, Trump also added the GOP needed to “trust mail-in voting.”Neither the RNC nor Lara Trump responded to multiple requests for comment. “No, we don’t believe that.”On her internet show and podcast, and in public events, she often spread outlandish and nonsensical claims about the 2020 election.

CNN —A New York appeals court has denied Donald Trump’s petition to change the venue of his upcoming hush money trial. The former president’s attorneys on Monday had urged the court to postpone the trial so it could consider whether to change the venue, arguing that Trump cannot get a fair jury in New York. But Associate Justice Lizbeth González quickly denied the motion to stop the trial after hearing arguments Monday, and there is no further argument on the motion to change the venue. Trump’s attorneys had filed the petition in the state appellate court earlier in the day, one week before his trial is set to begin. At Monday’s hearing before the appeals court, Trump attorney Emil Bove rehashed a survey and media study referenced in the former president’s previous motion submitted to Merchan to postpone based on pretrial publicity.

And if there’s one of the four criminal trials that Trump would prefer to take place first, it’s this one. But there is a clear trend of him using frivolous legal challenges to slow the road to trials. With only four weekdays until the New York trial begins, the chances that it will be further delayed are fading fast. If he’s reelected, Trump would regain presidential powers that would allow him to stall or even end the federal case against him completely. “There is no democracy without robust and uninhibited freedom of expression,” Trump attorney Steve Sadow said in a statement.

Eastman is asking a judge in California to reactivate his license following a disciplinary decision last month that rendered him unable to practice law for now. That decision prompted his law license to be made inactive over the weekend, meaning he can’t have legal clients while he appeals the decision. Until his law license was made inactive, Eastman represented about a half-dozen clients on constitutional issues, including relating to elections. Those prominent clients are now going to bat for him in his request to continue his legal work. Greene’s campaign committee and the joint fundraising committee “Put America First” have paid Eastman’s law partnership about $25,000 for legal services since 2021, according to campaign finance records.

A gag order against one of Trump’s biggest foes could score political points and help him and his co-defendants in the short term. Then, McAfee appeared to suggest a gag order may be necessary. “I don’t know a reason to have a gag order right now,” Parker told CNN. The former president already faces a gag order in his criminal hush money case that’s headed to trial later this month in New York. The ethics charges that were brought against Clark by the DC Bar’s Office of Disciplinary Counsel allege that he was dishonest and attempted to interfere with the administration of justice after the 2020 election. An attorney for Clark at the trial attempted to highlight how Clark was working on the behalf of the then-president after the election. But several former higher-ranking Justice Department officials, including then-acting Attorney General Jeffrey Rosen and then-Deputy Attorney General Richard Donoghue, testified at the trial that Clark’s efforts within the DOJ were out of line. Clark brought lawsuits challenging the validity of the DC Bar’s disciplinary proceedings against him. CNN —Former President Donald Trump has posted a $175 million bond as he appeals the judgment against him in the New York civil fraud case brought by state Attorney General Letitia James. (Trump himself was ordered to pay $454 million; the $464 million includes the disgorgement for his adult sons Don Jr. and Eric.) That prompted James to take steps to prepare to seize Trump’s assets in the event Trump failed to post bond. When the 30-day deadline hit, however, the New York appeals court stepped in and lowered the bond to $175 million, giving Trump an additional 10 days. “As promised, President Trump has posted bond,” Trump attorney Alina Habba said in a statement.

Trump's latest attacks on Merchan's daughter went further than his past comments by claiming she "just posted" a picture of him behind bars. A judge on Tuesday imposed a limited gag order on Donald Trump ahead of his criminal hush money trial in New York. Trump's statements about various figures involved in the case "were threatening, inflammatory [and] denigrating," Manhattan Supreme Court Judge Juan Merchan said in a court order. The gag order bars Trump from making public statements about likely witnesses and jurors in the case. The gag order does not specifically bar Trump from criticizing the judge. Merchan's gag order ruling on Tuesday afternoon appeared to reference Trump's remarks about his daughter.

CNN —A former Trump 2020 campaign official has been subpoenaed by officials in Arizona as part of the criminal investigation focused on efforts to overturn Joe Biden’s win, according to two sources familiar with the matter. The official, Mike Roman, is also one of Donald Trump’s co-defendants in the Georgia election subversion case. He’s being subpoenaed by prosecutors as part of a separate state-level probe overseen by Arizona Attorney General Kris Mayes, a Democrat. The subpoenas suggest the probe is accelerating ahead of the 2024 presidential election, when Trump is expected to again face Biden as the Republican nominee.
