CNN —Donald Trump’s former lawyer Rudy Giuliani is one step closer to being disbarred. The professional responsibility board in Washington, DC, recommended Friday that the ex-New York mayor and federal prosecutor lose his law license because of his involvement in a bogus 2020 election fraud lawsuit. Giuliani’s law license had already been suspended due to his work boosting Trump’s false assertions about his electoral loss. It is up to the DC Court of Appeals to decide whether to permanently disbar Giuliani. Earlier this week, attorney Jenna Ellis saw her Colorado law license suspended for three years because of her guilty plea in the criminal 2020 election interference case brought in Georgia.

CNN —The Texas Supreme Court said a medical exemption in the state’s abortion ban applies only when a person is at risk of death or serious physical impairment, ruling Friday against women who sued the state with claims that the ban had put their health at risk. “Because the trial court’s order opens the door to permit abortion to address any pregnancy risk, it is not a faithful interpretation of the law,” the state Supreme Court said. The Texas Supreme Court said the challengers did not prove the abortion ban, with its narrow medical emergency exemption, violated the state constitution. “Today, the Supreme Court of Texas unanimously upheld the Human Life Protection Act, one of our state’s pro-life laws,” said Paxton, a Republican. The ruling called on the Texas Medical Board to issue more guidance to clear up confusion around when the exemption applies.

CNN —Now that a New York jury has convicted former President Donald Trump of all 34 felony charges of falsifying business records, the next obvious question is: Can a convicted felon run for president? A further question is more complicated: Could Trump, as a felon, vote for himself? And now to the more difficult question …Can a convicted felon vote? Trump is now a Florida resident – and Florida voters, in 2018, overwhelmingly backed a referendum to reenfranchise convicted felons. In New York, after a law passed in 2021, any convicted felon who is not incarcerated is eligible to register to vote.

Merchan could sentence Trump to probation or up to 4 years on each count in state prison, with a maximum of 20 years. The New York case is no different. Shortly after Trump was convicted, his attorney Todd Blanche asked Merchan for an acquittal of the charges notwithstanding the guilty verdict. Trump’s conviction means little for his three other criminal cases, which will continue to proceed as they were prior to him being found guilty in the New York case. Trump’s federal election subversion criminal case has been on hold while the US Supreme Court considers his claims of presidential immunity.

CNN —A federal appeals court, including two Donald Trump appointees, ruled Tuesday that the Democratic-lean of Washington, DC’s, population does not make its jury pool too biased to try a January 6 Capitol rioter case. The DC US Circuit Court of Appeals, in an opinion written by Barack Obama-appointed Judge Patricia Millett and joined by Judges Gregory Katsas and Neomi Rao, both Trump appointees, rejected the version of the argument put forward by Webster. “Webster asserts that the District overwhelmingly voted for President Biden and historically votes for Democratic candidates. … That may be,” Millett wrote. “Generalized disapproval of criminal conduct — even the specific conduct at issue in a defendant’s case — says nothing about a juror’s ability to be impartial in deciding whether a particular individual committed a crime or not.”

Wilmington, Delaware CNN —The judge in Hunter Biden’s gun case issued a series of pretrial rulings Friday, handing wins to both sides and setting the contours of the upcoming trial. Federal Judge Maryellen Noreika sided with prosecutors on a key question about what they need to prove about Biden’s drug use when he bought a gun in 2018. Prosecutors said in court that they only want to introduce a small slice of the laptop material at trial. Lawyers said the trial could last up to two weeks, including jury selection, with the potential to go longer. She also limited what references prosecutors could make at trial to his lavish spending habits at the time of the gun purchase, narrowing such evidence to spending connected to drug use.

CNN —Longstanding abortion restrictions like waiting periods and provider regulations are now under legal attack in states where Roe v. Wade’s reversal prompted voters to amend their state constitutions to protect abortion rights. But the success abortion rights advocates have had in passing such measures in purple states and even Ohio – where Republicans have dominated recent elections – is notable. Anti-abortion activists say that abortion rights advocates are stretching the constitutional amendments beyond their meaning, suggesting that voters in other states should be wary. Abortion rights advocates say that the legal landscape differs state by state, so it’s difficult to predict the litigation that could come out of the proposed amendments if adopted. There are campaigns for initiatives to expand abortion rights in several other states, but only in a few states so far have abortion rights advocates cleared the required hurdles to guarantee the proposals will be on the ballot.

US District Judge Aileen Cannon will hear arguments from defense attorneys on two separate bids to throw out charges in the case. Trump is accused by special counsel Jack Smith of taking classified national defense documents from the White House after he left office and of resisting the government’s attempts to retrieve the materials. Trump has obtained permission from the judge to skip Wednesday’s proceedings, which will start at 10 a.m. On Tuesday, hundreds of pages of previously sealed court filings were posted publicly as part of efforts by the former president to have the charges against him thrown out. She expressed “concern” the special counsel’s office had sought redactions of information in the newly unsealed filings after previously giving its OK for that information to be published in full in earlier court filings.

CNN —Followers of former President Donald Trump were meant to be startled when they were sent an email Tuesday, addressed from “President Trump,” with this arresting subject line:“They were authorized to shoot me!”The preview line in the email did not back down. The judge, Beryl Howell, cited the discovery of additional documents with classified markings found in Trump’s Mar-a-Lago bedroom months after the FBI search. CNN —Months before Donald Trump was indicted for mishandling classified documents, a federal judge said that investigators had “strong evidence” that the former president “intended” to hide classified documents at his Mar-a-Lago resort, according to newly released court documents. Judge Beryl Howell cited, among other things, the discovery of additional classified documents found at Mar-a-Lago months after the FBI’s search of the property in the summer of 2022. The ruling was among hundreds of pages of previously sealed filings that were publicly docketed Tuesday in the criminal classified documents case against Trump. Nauta has been charged alongside Trump and Mar-a-Lago property manager Carlos De Oliveira in the case, facing charges of mishandling sensitive or classified materials and obstruction. The case against Trump, brought last summer, is currently in front of Judge Aileen Cannon in Fort Pierce, Florida.

CNN —Former Trump adviser Steve Bannon should begin serving a four-month prison sentence now that a federal appeals court has upheld his contempt-of-Congress conviction, the Justice Department told a federal judge Tuesday. US District Judge Carl Nichols, who presided over Bannon’s trial, had paused Bannon’s sentence while an appeal of his conviction played out. He has given Bannon until Thursday to respond to the DOJ’s request. Circuit rejected defendant’s appeal on all grounds, including the primary argument on appeal: the requisite mental state required for a contempt of Congress violation,” the Justice Department wrote. The timing of when Bannon will be expected to report to prison is still unclear.

CNN —A county redistricting plan in Texas that a Donald Trump-appointed judge deemed “a clear violation” of the Voting Rights Act is back before a notoriously conservative appeals court. After the 2021 Census, the Republican-led county commission broke up that district, locking in four majority-white districts instead. Their opponents argue that Congress did not intend for multiple “classes” of minorities to be considered together when assessing a map’s Voting Rights Act compliance. At issue is a map drawn by state lawmakers that included a second majority African American district in Louisiana’s six-district congressional plan. The Supreme Court’s intervention, the groups argued Wednesday, “is needed to ensure that harm is not repeated.”The Supreme Court could allow the newly drawn congressional districts to be used in this year’s election. Throughout the process, Republican lawmakers suggested in public statements that a primary motivation was to adhere to court orders and draw a second majority Black district. The Supreme Court is already weighing a separate equal protection challenge over South Carolina’s congressional maps. Given the delay in the Supreme Court issuing its decision, the lower court has ruled that the 2024 elections can proceed under the map it previously deemed unconstitutional.

CNN —Judge Aileen Cannon has indefinitely postponed former President Donald Trump’s classified documents trial in Florida, citing significant issues around classified evidence that would need to be worked out before the federal criminal case goes to a jury. In an order Tuesday, Cannon cancelled the May trial date and did not set a new date. By indefinitely postponing the classified documents trial, Cannon’s order pushes it closer to the 2024 election – and potentially afterward. Although Trump’s attorneys have continuously asserted in court filings that a pre-election trial would be “unfair.”The further delayed trial also could put Trump’s two federal cases on a collision course. Trump is charged in the Florida case with mishandling classified documents and with working with two co-defendants, Walt Nauta and Carlos De Oliveira, to obstruct the Justice Department’s investigation.

United States Supreme Court Associate Justice Ketanji Brown Jackson. Alex Wong/Getty ImagesJustice Ketanji Brown Jackson warned that absolute immunity could turn the Oval Office into "the seat of criminal activity in this country." She said there would no incentive for presidents to follow the law while in the White House if they could never face criminal prosecution. "There are lots of people who have to make life and death decisions" and still face the risk of criminal prosecution, she said. I think that we would have a really significant opposite problem if the president wasn’t chilled," she said.

Trump himself has continued to lobby for absolute immunity, including before his appearance at a New York court where he’s on trial for business fraud. Dreeben told Barrett that the indictment against Trump is substantially about private conduct, meaning that a trial could proceed even if the Supreme Court finds some immunity for Trump’s official actions. Liberal justices weren’t impressed with Trump’s absolute immunity claimsIt was pretty clear where the court’s three liberals will be when the opinion lands. Justice Sonia Sotomayor asked Joshua Turner, the lawyer for the state of Idaho, about specific, real-life scenarios where pregnant people required emergency abortions. Later, she returned to the hospital, Sotomayor said, and received an abortion "because she was about to die." Pregnancy can be dangerous, particularly in the United States, which has the highest rate of maternal mortality in the developed world. About 10% to 20% of pregnancies end in miscarriage and many don’t require medical intervention, but some may require treatment using the same procedure used in an abortion. Miscarriages can put someone’s life at risk because of serious blood loss or infection if the miscarriage is not complete.

When Prelogar argues before the Supreme Court, she is arguing in front of several alumni of the US Office of the Solicitor General. She also clerked for her current boss, Attorney General Merrick Garland, when he was a DC Circuit judge, before her Supreme Court clerkships. She went on to litigate Supreme Court cases for private firms and worked on special counsel Robert Mueller’s investigation. The court’s far-right wing, perhaps in an attempt to keep those two justices on their side, framed the case as a federal overreach into state power. Turner, Idaho’s attorney, shot back that mental health could essentially open a loophole. Conservatives have long opposed allowing exceptions to strict abortion bans for mental health. Justice Samuel Alito, a fellow conservative, picked up on that same theme, repeatedly pressing Prelogar to explain whether the Justice Department views mental health as a way around Idaho’s abortion ban. That is exactly the kind of political influence that the Supreme Court, especially under Roberts, has generally tried to avoid.

CNN —Special counsel Jack Smith’s obstruction case in the classified documents prosecution survived an early test, with a federal judge on Thursday denying several bids by Donald Trump’s co-defendants to dismiss charges against them. Judge Aileen Cannon rejected efforts by Trump’s co-defendants Walt Nauta and Carlos De Oliveira to toss obstruction charges they faced. Nauta works as Trump’s personal valet, and De Oliveira has worked as property manager at Trump’s Florida Mar-a-Lago estate. The Florida judge still has yet to decide several motions by Trump to toss charges against him in connection with allegedly mishandling classified documents and attempting to thwart the Justice Department’s investigation. Attorneys for De Oliveira argued that the obstruction charges he faced should be dismissed because he was not aware of the grand jury subpoenas issued for classified documents kept at Mar-a-Lago when he allegedly moved boxes around the resort.
