CNN —Boris Epshteyn, a close adviser to Donald Trump and former White House aide, pleaded not guilty on Tuesday to election subversion charges stemming from an April indictment in Arizona. Epshteyn, who appeared in court Tuesday via phone, is one of 18 defendants who, according to the indictment, “schemed to prevent the lawful transfer of the presidency to keep Unindicted Coconspirator 1 in office against the will of Arizona’s voters.”While Trump is not among those charged in Arizona, the details in the indictment suggest he is “Unindicted Coconspirator 1.”The scheme, according to the indictment, called for the fake electors to fraudulently vote for Trump, “falsely claiming to be the duly elected and qualified Electors for President and Vice President of the United States from the State of Arizona.”Epshteyn joined the Trump campaign in 2016 and is considered one of the former president’s most loyal advisers, speaking with him regularly. He was alongside Trump during his arraignment in his New York hush money case and traveled with him to arraignments in Georgia and Washington, DC. Others charged in the indictment include former Trump White House chief of staff Mark Meadows, along with former Trump attorneys Rudy Giuliani, John Eastman and Christina Bobb. All have pleaded not guilty.

“Is this a political war to the knife?”I was not familiar with that term – “war to the knife” – but Bannon also recently used it in an interview with ex-Fox News host Tucker Carlson. Ousted from White House role in 2017Bannon’s tenure in Trump’s White House was relatively short; he was fired in August 2017, part of a major reorganization under then-chief of staff John Kelly, who was brought in to control a chaotic atmosphere. As chief strategist at the White House, Bannon was known for large whiteboards full of lists of priorities – things that still ring true in the priorities he outlined over the weekend. Courts, Congress and mismanagement kept Bannon and Trump from achieving many of these goals in Trump’s first term. Anticipating the potential for a second Trump term, there are any number of supporters who are mapping out how to make the most of it.

Some Trump allies, including another veteran of his 2016 campaign and the Trump White House, former campaign manager Kellyanne Conway, have downplayed the former president’s comments. Earlier this month, Conway noted that Trump’s Justice Department did not try to prosecute Hillary Clinton despite the chants of “Lock her up!” at 2016 campaign rallies. But other allies have responded more forcefully to Trump’s conviction in his New York hush money trial. He was sentenced to four months in prison, and a federal judge earlier this month ordered him to report to prison by July 1. Once a top adviser to Trump’s 2016 campaign and a senior White House aide, the bombastic Bannon is now a right-wing podcaster with a following of loyal Trump supporters.

Former President Donald Trump has spent years attacking Hunter Biden, President Joe Biden's only surviving son, and raising campaign cash on his unfounded claims that the Biden family is corrupt and above the law. Long before Hunter Biden was found guilty Tuesday of three federal gun crimes, Trump made the 54-year-old lawyer and recovering drug addict the centerpiece of his bare-knuckle campaign against Joe Biden during the 2020 presidential election. The latest Trump ads on Google and YouTube are also devoid of any mention of Hunter Biden. "Trump and Republicans have accused Hunter Biden of being at the center of a massive web of corruption involving his father as vice president. The Trump campaign announced May 31 that in the 24-hour period after the former president's conviction it raised over $50 million.

CNN —Rudy Giuliani was processed in Phoenix on Monday, weeks after pleading not guilty in Arizona to charges of allegedly conspiring to overturn the 2020 presidential election results. Giuliani was served on May 17 in Palm Beach, Florida, at his 80th birthday bash held by a GOP operative. Arizona prosecutors spent weeks trying to track down the former New York City mayor and eventually found him based on his podcasts. A grand jury in Arizona handed up indictments last month charging over a dozen Trump allies, including the fake electors and several individuals connected to his campaign, over their efforts to overturn his 2020 election loss. Goodman added that Giuliani “will be fully vindicated.”The Arizona indictment is just the latest legal woe for Giuliani stemming from his time as Trump’s attorney after the 2020 presidential election.

A Georgia appeals court on Wednesday halted the criminal election case against Donald Trump in the state pending the outcome of his bid to disqualify the district attorney prosecuting the former president. The order by the Georgia Court of Appeals all but guarantees that Trump and eight co-defendants in the case will not stand trial before the November presidential election, where Trump is the presumptive Republican nominee. The appeals court said it would hear arguments on Oct. 4 on Trump's effort to boot Fulton County District Attorney Fani Willis from the case. The appeals court must rule on the question by March 14, 2025, according to the court's website. The appeals court order Wednesday halting the case also applies to Rudy Giuliani, David Shafer, Robert Cheeley, Michael Roman, Mark Meadows, Cathy Latham, Jeffrey Clark and Harrison Floyd.

Former New York Mayor Rudy Giuliani departs the U.S. District Courthouse after he was ordered to pay $148 million in his defamation case in Washington, U.S., December 15, 2023. The D.C. Bar's Board on Professional Responsibility on Friday recommended that Rudy Giuliani be barred from practicing law in the nation's capital. This report follows one from last year in which a disciplinary board for the D.C. Bar also recommended disbarment for Giuliani. Now, the case heads to the D.C. Court of Appeals, which will decide whether Giuliani, who formerly served as the mayor of New York City, will be disbarred. Giuliani has already had his law license suspended in New York, where a New York court ruled that he made "demonstrably false and misleading statements" following the 2020 presidential election.

CNN —Donald Trump’s former lawyer Rudy Giuliani is one step closer to being disbarred. The professional responsibility board in Washington, DC, recommended Friday that the ex-New York mayor and federal prosecutor lose his law license because of his involvement in a bogus 2020 election fraud lawsuit. Giuliani’s law license had already been suspended due to his work boosting Trump’s false assertions about his electoral loss. It is up to the DC Court of Appeals to decide whether to permanently disbar Giuliani. Earlier this week, attorney Jenna Ellis saw her Colorado law license suspended for three years because of her guilty plea in the criminal 2020 election interference case brought in Georgia.

Smartmatic and Newsmax have since been embroiled in the years-long defamation case, which is slated to go to trial this September in Delaware Superior Court, barring an out-of-court settlement. Smartmatic further accused Newsmax of intentionally “destroying relevant evidence” by deleting texts and emails from senior officials. Fox News famously paid more than $787 million to Dominion Voting Systems to settle a case last year over similar 2020 election lies on its airwaves. A trial could put Newsmax’s financial future in peril, but there is one major difference between the Newsmax and Fox cases. The network denies wrongdoing and maintains that its 2020 election coverage is protected by the First Amendment.

Part of the reason for those modest hopes was the fact that the defense case would not include testimony by the defendant. Later, the charging conference to agree on jury instructions showed how daunting the law is that Trump faces. All of that is bad news not just for Costello, whose clash with Merchan won Trump’s praise outside the courtroom Monday, but also for the defense. Because Costello was one of Trump’s only witnesses, there is also the risk that he — and the jury’s reaction to his poor attitude — will taint the defense case overall. There was little the defense could do about the law in the charging conference beyond their usual able argument.

CNN —Followers of former President Donald Trump were meant to be startled when they were sent an email Tuesday, addressed from “President Trump,” with this arresting subject line:“They were authorized to shoot me!”The preview line in the email did not back down. The judge, Beryl Howell, cited the discovery of additional documents with classified markings found in Trump’s Mar-a-Lago bedroom months after the FBI search. Trump is a master sensationalist, so place the email subject line where he says he’s in physical harm within his oeuvre of over-the-top and untrue allegations. How to get people to open fundraising emailsThe email address where I get fundraising pitches from politicians received seven such messages from Trump on Tuesday. So it goes for Menendez, who is likely pleased to have his legal drama playing out in relative obscurity. More recently, Fetterman mocked the senator’s defense, which relies in part on pointing the finger of blame on Nadine Menendez, his wife. Republicans in Washington, as they’ve done during these first two weeks of the Menendez trial in New York, have been consistently deferential to the New Jersey Democrat. Rep. Andy Kim, a popular Democrat from South Jersey, is expected to win the nomination to succeed Menendez. Andrew Giuliani, pressed for a thought on the senator’s trial or the allegations against him, shrugged.

CNN —Rudy Giuliani has agreed to never again publicly accuse two Georgia election workers of tampering with votes in the 2020 election, a false accusation that he has repeated frequently and that led to his bankruptcy. With the agreement, Giuliani is forfeiting a yearslong verbal and legal battle he’s waged with the election workers, Ruby Freeman and her daughter, Shaye Moss. “Today ends his efforts to profit off of lies about these two heroes of American democracy,” the workers’ attorney Michael Gottlieb said in a statement. The trial provided a searing glimpse into the harassment election workers suffered while prominent Trump supporters spread lies about the 2020 election. CNN —The defense rested its case in Donald Trump’s criminal hush money trial on Tuesday after roughly 90 minutes of testimony – and without the former president taking the stand. Here are takeaways from the final day of testimony in the Trump hush money trial:Trump doesn’t take the standOver the last several months, Trump repeatedly teased that he would take the stand in his own defense. “That was a lie,” Blanche alleged of Cohen’s testimony he spoke to Trump about moving forward with the hush money deal. Prosecutor Susan Hoffinger also tried to remind jurors that it was Trump – not Cohen – who was on trial in this case. Eight times a day during his felony trial, the former president of the United States must stand and honor 12 jurors and six alternates as they walk past, eyes straight ahead or down, casting no glances at him. It’s inspiring to watch these ordinary citizens as sovereign soldiers for justice. On Monday, this calm processional was disrupted, as jurors were forced to hurry out after a pro-Trump witness for the defense mocked the authority of the court. Moments later, Justice Juan Merchan ordered the courtroom immediately cleared and reporters fled in a frenzy. Michael Cohen had testified earlier that Costello and Rudy Giuliani were assigned by Trump to open a “back channel” to Cohen to keep him in the Trump fold.

The witness, attorney Robert Costello, was called by the defense to attack the credibility of key prosecution witness Michael Cohen. Within minutes of taking the stand, Costello was in open conflict with New York Supreme Court Justice Juan Merchan, the judge presiding over the case. "If you don't like my ruling you don't say 'Jeez," you don't give me side eye, and you don't roll your eyes," the judge scolded. "You don't say 'strike it,'" the judge told the witness, adding that it's his job, not the witness' to strike testimony.
