CNN —Lilly Ledbetter, whose gender pay equity legal fight was the inspiration for the Fair Pay Act of 2009, has died at age 86, according to the team making a film about her life. In the 1990s, after 19 years of working for Goodyear, Ledbetter learned she had been making thousands of dollars less each month that other – male – managers. Lower courts in Colorado had concluded that Masterpiece Cakeshop and the bakery’s owner, Jack Phillips, had violated Autumn Scardina’s rights by refusing to make her a pink cake with blue frosting because of her identity as a transgender woman. Scardina had initially filed a discrimination complaint with the Colorado Civil Rights Division after Phillips refused to make the cake she wanted to order to celebrate her birthday and her identity as a transgender woman. Justice Melissa Hart, writing for the majority, said Scardina should have challenged that decision in an appeals court, rather than file a new lawsuit. The U.S. Supreme Court in 2018 ruled in Phillips’ favor but on narrow grounds that avoided setting a major precedent allowing people to claim religious exemptions from anti-discrimination laws. But in June 2023, in a case billed as a sort of sequel, the 6-3 conservative majority U.S. Supreme Court held the First Amendment protected web designer Lorie Smith from being compelled by Colorado to provide services to same-sex weddings.

Brazil’s Supreme Court cleared X to resume service in the country Tuesday, after the social media platform reversed course and started complying with court rulings that billionaire owner Elon Musk had previously vowed to resist. Supreme Court Justice Alexandre de Moraes, who had been locked in a months-long feud with Musk, gave X the green light to resume operations in Latin America’s largest country effective immediately. In the decision, Moraes said X had met all the necessary requirements to start operating again in the country. Moraes, in his Tuesday decision, ruled that Brazil’s telecommunications regulator Anatel must work to allow X to come back online within 24 hours. A new X representative, lawyer Rachel de Oliveira Conceicao, was tapped in late September, when X also said it had started to block accounts ordered by the court.

WASHINGTON — The Supreme Court on Tuesday takes on another battle over restrictions on firearms as the justices consider the Biden administration's move to ban "ghost gun" kits that allow people to assemble deadly weapons at home while skirting existing regulations. The challengers focus on the text of the Gun Control Act, saying in their brief that the law simply doesn't apply to gun kits. The ATF does not have unilateral authority to ban ghost guns, with Congress required to act if it wants to do so, they argue. Those defending the availability of ghost gun kits say that they are mostly used by hobbyists, rejecting the government's argument that criminals favor them. Although it is a gun case, the legal question does not turn on the right to bear arms under the Constitution's 2nd Amendment.

Roberts was shaken by the adverse public reaction to his decision affording Trump substantial immunity from criminal prosecution. The Roberts Court has been in sync with the GOP political agenda largely because of decisions the chief justice has authored: For Trump and other Republicans. But the politically charged valence deepened in the justices’ resolution of the case against former President Trump on election-interference charges from 2020. By contrast, the modern day Democrats’ historic success at winning the popular vote hasn’t translated into nearly as much governing power for them. Over this record run of popular vote success, Democrats have already twice lost the Electoral College – and thus the White House – while winning more votes. Amazingly, Republicans won unified control of government in two elections when Democrats won a plurality of the national presidential vote: 2000 and 2016. The Democrats’ popular vote winning stretch began in 1992 with Clinton’s victory over George H.W. The highest share of the popular vote Democrats have won over this period is the 52.9% that Obama garnered in 2008.

The Federal Supreme Court (STF) in Brazil suspends Elon Musk's social network after it fails to comply with orders from Minister Alexandre de Moraes to block accounts of those being investigated by the Brazilian justice system. Elon Musk's X is getting back up and running in Brazil after a months-long standoff between the company and the country's federal supreme court minister, Alexandre de Moraes. "X is proud to return to Brazil," the company wrote in a post on X from its global government affairs account. Rather than comply, Musk initially closed X's headquarters in Brazil, and said he wouldn't employ a legal representative there for a time. G1 Globo news reported that users were regaining access to X on Tuesday after the court authorization.

CNN —The Supreme Court on Tuesday signaled a willingness to uphold a Biden administration regulation on “ghost guns,” mail-order kits that allow people to build untraceable weapons at home and that are turning up at crime scenes with greater frequency. The difference here, she said, is that the ghost guns are marketed to be built into guns and serve no other conceivable purpose. President Joe Biden’s administration told the court in briefing that police departments have faced an “explosion of crimes involving ghost guns” in recent years. In 2017, police submitted about 1,600 ghost guns recovered at crime scenes for tracing. After that decision, a lower court stepped in to block the regulations as applied to two manufacturers.

WASHINGTON — The Supreme Court on Monday turned away a Biden administration appeal in a dispute over emergency room abortion care in Texas, leaving in place a lower court victory for the Republican-led state. Circuit Court of Appeals in favor of Texas on the question of whether a federal law concerning emergency room care in some cases trumps state abortion restrictions. In the meantime, a lower court ruling that allows emergency room doctors to perform abortion in some situations remains in place. The administration appealed to the Supreme Court, but asked the justices to hold the case until it decided the Idaho dispute. Over the summer, Solicitor General Elizabeth Prelogar urged the court to throw out the appeals court ruling so that new developments could be considered afresh.

“I have had two spectacular Notre Dame law clerks. The traditional elite law schools dominate Supreme Court clerkships, with many justices hiring clerks from the same law schools they themselves attended and maintaining close links with faculty members. Barrett, who graduated from Notre Dame Law School, is the only member of the current court not to have a law degree from Harvard or Yale.
