The testy clashes have come to be expected as Trump's lawyers carry into the courtroom the bombastic, and often antagonistic, style that defines his campaign trail demeanor. There's no doubt that the lawyers, with some exceptions, have struggled to score major points with judges and in fact have often provoked their ire. Both cases have been defined by contentious exchanges between judges and Trump and his lawyers. In November, for instance, they pushed unsuccessfully for a mistrial in the fraud case, accusing Judge Arthur Engoron of “tangible and overwhelming” bias. Chutkan has repeatedly admonished Trump’s lawyers for political arguments, once telling attorney John Lauro during debate over whether restrictions could be placed on Trump's speech that though she knew he had a “message” to convey, she didn't want campaign rhetoric in court.

The ruling stemmed from an antitrust lawsuit James, the Federal Trade Commission, and six other states filed against Shkreli. The former president publicly fulminated against Judge Lewis Kaplan as “nasty” and a “Trump-hating guy” and bucked courtroom etiquette. Trump accused Kaplan of being heartless for not suspending the trial so that he can attend the funeral of his mother-in-law. But Haley has only implicitly criticized Trump’s assault on democracy, false claims of electoral fraud and tumultuous term in office. This attitude is consistent with Trump’s apparent belief that rules that apply to other Americans don’t constrain him. “That aside, it’s just remarkable how much the former president has gotten away with in court.

CNN —New York’s top court has dismissed an appeal from Donald Trump’s lawyers to remove the gag order placed on the former president in the New York Attorney General’s civil fraud trial. New York’s appellate court had reinstated the order from Judge Arthur Engoron, which prohibited Trump and his attorneys from making public statements about the courtroom staff in the $370 million trial that wrapped up this month, in November, 2023. Tuesday, the New York’s Court of Appeals dismissed the appeal, stating that “no substantial constitutional question is directly involved.”The order, initially issued by Engoron in October, bars Trump from making public statements about court staff after Trump made numerous comments about a clerk, who the former president said is biased against him. The judge had twice fined Trump for violating the order. The judge last year found that Trump is liable for fraud in the civil case, and he plans to issue a full decision in the bench trial by the end of this month on damages and six additional claims.

The New York Court of Appeals dismissed Trump's challenge to the order "upon the ground that no substantial constitutional question is directly involved." The court also dismissed Trump's motion to stay the gag order "as academic," likely because the trial is over. The gag order barred Trump from making public statements about the staff of Manhattan Supreme Court Judge Arthur Engoron.

Former U.S. President Donald Trump looks on, as the trial of himself, his adult sons, the Trump Organization and others in a civil fraud case brought by state Attorney General Letitia James continues, in New York City, U.S., October 3, 2023. A New York appeals court Thursday reinstated a gag order on Donald Trump in his $250 million civil business fraud trial. The order bars Trump from making public statements about the staff of Manhattan Supreme Court Judge Arthur Engoron, who is presiding over the ongoing trial. Engoron had imposed that order on Trump, and later his attorneys, after they repeatedly targeted the judge's principal law clerk, Allison Greenfield. In its order Thursday, a four-judge appellate panel lifted a temporary suspension of the gag order, which was put in place while Trump appealed the speech restrictions.

The financial watchdog overseeing the Trump Organization informed a New York judge on Wednesday about $40 million in cash transfers that were not previously disclosed as required to that court-appointed monitor. A review of bank statements since January shows that there were "three cash transfers exceeding $5 million each, totaling approximately $40 million," she wrote. Kise's statement referenced Jones' last regular report to the judge, which she sent in August. In that previous letter, Jones notified Engoron about what she described as issues of incompleteness and inconsistency in certain disclosures to lenders and others by the Trump Organization. A spokeswoman for New York Attorney General Letitia James had no comment on Jones' letter.

The deals came with conditions about Trump’s net worth and, sometimes, liquidity, and they often required annual submissions of his financial statements. But, testifying for the defense, managing director David Williams said the bankers viewed clients' reports of their net worth as “subjective or subject to estimates” and took its own view of such financial statements. The attorney general's office, however, has maintained that such adjustments were never intended to account for the alleged fraud. He asserted in his own testimony this month that his lenders cared more about property locations and the parameters of the deals than they did about the financial statements. “Are you aware of any time Deutsche Bank didn’t adhere to its own guidelines in making loans to President Trump?” defense attorney Jesus M. Suarez asked.

New York CNN —Donald Trump urged a New York appeals court to continue to pause the gag order against him in his civil fraud trial, saying that threats to the judge and his law clerk do not “justify” limiting the former president’s constitutional right to defend himself. Lawyers for the New York attorney general’s office and the court last week urged the appeals court to put the gag order back in place following “serious and credible” threats that have inundated Judge Arthur Engoron’s chambers since the trial began in October. Trump’s attorneys wrote in a filing Monday that the former president has never threatened the judge or his principal law clerk and they can’t be held responsible for actions taken by others. At the time the appeals court judge said he would lift the gag order to allow a fuller panel of judges to weigh in given the constitutional issues at play. Nor have President Trump or his counsel ever made a statement referencing the Principal Law Clerk’s religion, appearance, or private activities,” they told the appeals court.

NEW YORK (AP) — Donald Trump's company no longer prepares the sweeping financial statements that New York state contends were full of deceptive numbers for years, an executive testified Monday at the former president's civil fraud trial. Trump's 2014 to 2021 “statements of financial condition” are at the heart of state Attorney General Letitia James' lawsuit against him, his company and some of its key figures. The defendants deny wrongdoing, but James says they misled lenders and insurers by giving them financial statements that greatly inflated Trump's asset values and overall net worth. Trump asserts that his wealth was understated, not overblown, on his financial statements. During cross-examination, Hawthorn acknowledged that Trump's financial statements could have been audited by the company, rather than just compiled, though he noted that auditing wasn't required.

However the ex-president’s appeal ends against a limited gag order imposed in his federal election subversion case, he can expect a benefit. A judgment in Trump’s favor on the gag order – which has been temporarily frozen while the appeal is heard – would pale against his four criminal trials and his current civil fraud trial in New York. How the gag order case reflects Trump’s intense challenge to accountabilityThe gag order appeal is entwined with complex arguments on the breadth of the First Amendment and the extent to which courts have the right to regulate its scope in order to protect their officers and proceedings and the administration of justice. Trump’s legal team argued that any restrictions on his comments represent an unconstitutional assault on his rights to freedom of political speech. The incitement issue is not a hypothetical one in the gag order case.

Trump's legal team argued against his gag order in his upcoming election interference trial. AdvertisementA panel of three judges on Monday appeared highly skeptical of arguments from Donald Trump's legal team seeking to revoke a gag order that bars him from attacking potential witnesses in his election interference criminal case. Depending on "the context," Lauro argued, Trump would be permitted to pressure possible witnesses not to cooperate with prosecutors. The gag order in the election interference case is separate from a gag order in another ongoing civil trial against Trump in New York. He found that Trump violated it earlier in November, though an appeals court on Thursday temporarily lifted the order.
