A federal judge overseeing New York City’s Rikers Island jail complex on Wednesday found the city in contempt for failing to stem violence and excessive force at the facility, and said she was leaning toward taking control of the city’s jails. The judge, Laura Taylor Swain, said in a 65-page opinion that the city and its Department of Correction had violated the constitutional rights of prisoners and staff members alike by exposing them to danger, and had intentionally ignored her orders. Judge Swain’s ruling came nearly a decade after the city’s jails, which include the Rikers Island complex, fell under federal oversight in a settlement of a class-action lawsuit brought by prisoners and the Legal Aid Society. Since then, a court-appointed monitor has issued regular reports on the violence that has continued to plague the facilities. In the past two years, at least 33 people have died in the jails or shortly after being released.

New York CNN —A federal judge on Wednesday tossed a defamation lawsuit brought by an Arizona man targeted by conspiracy theorists against Fox News, accusing the right-wing network and former primetime host Tucker Carlson of spreading false narratives about the January 6 attack. As part of the bogus narrative, several right-wing personalities, including Carlson, claimed a former Trump supporter, Ray Epps, was a federal agent who helped incite the attack. “Following the dismissals of the Jankowicz, Bobulinski, and now Epps cases, FOX News is pleased with these back-to-back decisions from federal courts preserving the press freedoms of the First Amendment,” Fox News Media said in a statement. Fox had sought the lawsuit’s dismissal for some time, arguing that its hosts and guests were simply raising questions when they suggested Epps had instigated the January 6 attack. A representative for Epps did not respond to a CNN request for comment.

Exxon Mobil 's new businesses aimed at lowering carbon-dioxide emissions are a long-term growth engine that will deliver earnings by the end of the decade, according to UBS. UBS has a 12-month price target of $149 for Exxon, indicating about 22% upside from Friday's close of $121.79 per share. The oil major is investing some $20 billion in a suite of emissions-reducing businesses including carbon capture and storage, biofuels, lithium and hydrogen through 2027. Balanced growth Exxon's $20 billion investment in low-carbon businesses represents about 13% of the company's total capital expenditures through 2027. CNN —An Arizona man was arrested Monday after allegedly threatening to kill President-elect Donald Trump in a series of Facebook videos, including one in which he appears to hold up an AR-15-style rifle, according to court documents. Court documents did not directly identify Trump, only referring to him as “Individual 1.” Court documents identify “Individual 1” as a public figure, former president and the current president-elect. Last Thursday, according to court documents, Tamayo-Torres said in a video posted on Facebook, “[Individual 1] you’re gonna die, [Individual 1], your son’s gonna die. Tamayo-Torres posted a video on August 23 from Desert Diamond Arena in Glendale, Arizona, where Trump held an afternoon rally. During the rally, Trump said he will create an independent commission to investigate assassination attempts while mentioning the attempt to assassinate him at a July 13 rally in Butler, Pennsylvania.

Microsoft faces wide-ranging U.S. antitrust probe

The U.S. Federal Trade Commission has opened a broad antitrust investigation into Microsoft , including of its software licensing and cloud computing businesses, a source familiar with the matter said on Wednesday. The probe was approved by FTC Chair Lina Khan ahead of her likely departure in January. The FTC fielded complaints about Microsoft last year as it examined the cloud computing market. Until now, Microsoft has been somewhat of an exception to U.S. antitrust regulators' recent campaign against allegedly anticompetitive practices at Big Tech companies. In 2019, the Pentagon awarded it a $10 billion cloud computing contract that Amazon had widely been expected to win.

But the Supreme Court’s upcoming and potentially explosive transgender care case is dividing conservatives, with many of those same groups backing Tennessee’s ban on puberty blockers and hormone treatments, which critics say injects the state into family medical decisions and overrides parental rights. Elon Musk and Vivek Ramaswamy will visit Capitol Hill to discuss government reform with Republican congressional leaders Dec. 5, House Speaker Mike Johnson, R-La., announced Wednesday. Johnson said the entrepreneurs will "discuss major reform ideas to achieve regulatory rescissions, administrative reductions, and cost savings" with GOP lawmakers. Next week's planned meeting is the latest indication that Republican leaders in Congress are taking Musk and Ramaswamy seriously. The lawsuit said Shen Yun has made hundreds of millions of dollars by exploiting young dancers it recruits from abroad, forcing them to work grueling hours and scaring them into thinking they’d face harm if they quit. According to the website, Shen Yun, along with Fei Tian Academy of the Arts and Fei Tian College — which were also named as defendants — were founded by followers of the Falun Gong faith. After the first year, she was paid $500 a month until she “graduated” from Fei Tian College in 2019, when her salary was raised to $1,000 a month, according to the lawsuit. The lawsuit said she contracted measles when she was 14 but was not permitted to see a doctor. Instead, the lawsuit said, she was told to meditate to feel better and was required to work while she recovered.

— As President-elect Donald Trump’s incoming administration solidifies its plan for mass deportations, local law enforcement agencies are preparing to ramp up a controversial program that allows them to partner with Immigration and Customs Enforcement. It authorizes ICE to delegate to state and local law enforcement officers the ability to perform certain functions of an immigration officer. According to ICE, as of May 2024, law enforcement agencies in 21 states participated in the program. Other critics have also said the 287(g) program merely serves as a political messaging tool for conservative sheriffs. Earlier this month, the Los Angeles City Council passed an ordinance that prohibits the use of city resources in immigration enforcement.

WASHINGTON — A former FBI informant whose false claims about President Joe Biden and his son Hunter Biden were at "the heart" of the Republican impeachment inquiry against the president has now been indicted on tax charges. Alexander Smirnov, the former FBI informant charged with lying to the FBI about President Joe Biden and his son Hunter, has now been indicted on 10 separate tax-related charges. The charges against Smirnov, who had been a confidential human source for the FBI since 2010, were brought by David Weiss, the special counsel on the Hunter Biden case, which resulted in convictions on gun charges in June and tax charges in September. Before Smirnov was indicted, Rep. Jim Jordan, R-Ohio, said his claims were "the heart" of Republicans' impeachment inquiry against the president. Prosecutors said Smirnov was "actively peddling new lies that could impact U.S. elections after meeting with Russian intelligence officials" in Nov. 2023.

Tampa Bay Buccaneers quarterback Baker Mayfield filed a federal lawsuit against a financial firm owned by his father, James Mayfield, accusing the company of failing to pay back nearly $12 million taken without his authorization. "For the period of time that Plaintiffs’ funds were being funneled to Defendants, Plaintiffs were the primary source of funding and capitalization for Defendants. Under the agreement, Camwood was required to repay $11.7 million plus interest beginning Sept. 30, the lawsuit states. "It is now clear that Defendants had no intention of making Plaintiffs whole when they entered into the Settlement Agreement," the lawsuit states. The suit says that because Camwood has failed to follow through on the settlement agreement, Mayfield was left with no choice but to file a lawsuit.
