New York CNN —A Colorado man has filed the first lawsuit against McDonald’s relating to its E. coli outbreak linked to Quarter Pounders that, so far, has led to at least 49 illnesses across 10 states, including one death. The lawsuit was filed one day after the US Centers for Disease Control and Prevention issued a food safety alert warning that dozens of people reported eating the Quarter Pounder sandwich at McDonald’s before becoming sick. The lawsuit, a copy of which was posted online by Bloomberg Law, accuses McDonald’s of product liability, negligence and breach of implied warranties. “The McDonald’s E. coli Outbreak will be one of the most significant food poisoning outbreaks this year,” Simon said in a press release. Diced onions and other types of beef patties used at McDonald’s have not been implicated in this outbreak, the FDA said.

The onions in question, according to a McDonald’s spokesperson, come from a single source and are then sliced and packaged as raw vegetables in individual bags and sent to restaurants. The Biden administration is proposing a rule that would provide women with private insurance access to over-the-counter birth control pills and other contraceptives at no cost, the White House said on Monday. “This rule, once finalized, will expand contraception coverage for 52 million women of reproductive age with private health insurance,” White House Gender Policy Council Director Jennifer Klein said during a briefing. “For the first time ever, women would be able to obtain over-the-counter contraception without a prescription at no additional cost, and health plans would have to cover even more prescribed contraceptives without cost sharing,” she said. Perrigo Co.’s Opill is currently the only daily birth control pill approved for sale without a prescription by the Food and Drug Administration, but the proposed rule covers other forms of over-the-counter contraceptives, including emergency contraception such as morning after pill Plan B, spermicides, birth control sponges, and condoms. The rule will also require that health plans cover all FDA-approved contraceptive drugs and some devices, including IUDs, without cost sharing in many cases.

Eli Lilly said on Monday it sued three medical spas and online vendors for selling products claiming to contain tirzepatide, the main ingredient in its popular weight-loss medicine Zepbound, including in the form of dissolvable tablets. Pivotal Peptides says it offers research grade tirzepatide, while MangoRx sells a compounded version, both online. Lilly has accused Pivotal Peptides of selling products claiming to contain tirzepatide directly to patients without any prescription from a medical professional, despite advertising the drugs for research purposes. Lilly said it sent a cease and desist letter to Pivotal Peptides before filing the lawsuit. Eli Lilly is seeking court orders barring the vendors from selling their drugs claiming to contain tirzepatide and unspecified monetary damages.

Tobacco product use among middle and high school students has dropped to a 25-year low, the Centers for Disease Control and Prevention and the U.S. Food and Drug Administration announced Thursday. Female students reported the biggest decline in use across the board, and Hispanic students also reported a drop in use of any tobacco product. Thousands of cases of improperly labeled Minute Maid Zero Sugar Lemonade have been recalled after they were found to contain the regular formula of lemonade with 40 grams of sugar, according to the Food and Drug Administration (FDA). Approximately 13,152 cases of mislabeled lemonade, each including 12 cans of the mistakenly sugary drink, were shipped to retail stores in Indiana, Kentucky and Ohio. In addition to the 40 grams of sugar, regular Minute Maid Lemonade contains 30 times the calories and over 20 times the total carbs of Minute Maid Zero Sugar Lemonade, according to the nutritional facts listed on Instacart. Coca-Cola issued the recall on September 10, but a press release was never publicized, according to the FDA’s enforcement report. Concerned consumers can distinguish affected cans by searching for the codes "FEB1725CNA" and "FEB1725CNB" printed on the carton and the bottom of the cans.

CNN —Coca-Cola has recalled more than 13,000 cases of Minute Maid Zero Sugar Lemonade because the mislabeled cartons actually contained the full-sugar version of the drink, according to a report from the US Food and Drug Administration. One can of Minute Maid Lemonade has 40 grams of sugar, according to product information on Amazon. Consumers can identify the recalled products by looking for codes FEB1725CNA or FEB1725CNB printed on the packaging. The recall started in early September, but a news release was not issued at the time. “No impacted product remains in the market, and all recall activities in those markets are complete,” Coca-Cola told CNN in a statement.

Novavax on Wednesday said the Food and Drug Administration has put a hold on its application for a combination shot targeting Covid and influenza and a standalone flu vaccine, sending the company's shares down sharply.
