The ruling was not related to a defense effort to disqualify Fani T. Willis, the district attorney of Fulton County, Ga., who is leading the case. Count 5 concerned a call that Mr. Trump made to David Ralston, who was then the speaker of the Georgia House. During that conversation Mr. Trump pressed Mr. Ralston to call a special legislative session to appoint new electors. Mr. Trump and his former personal lawyer, Rudolph W. Giuliani, had faced the most charges, at 13 apiece. They include Mark Meadows, the former White House chief of staff, and John Eastman, a legal architect of the plot to deploy fake electors in swing states that Mr. Trump lost.

CNN —The presiding judge in the Georgia criminal case against Donald Trump and his allies has thrown out some of the charges against the former president and several of his co-defendants. The partial dismissal by Georgia Superior Court Judge Scott McAfee leaves most of the sprawling racketeering indictment intact. Trump was named in three of the counts specifically, meaning the former president is now facing 88 charges over the four criminal indictments in Georgia, New York, Washington, DC, and Florida. Prosecutors alleged that Trump and some of his co-defendants violated the law by pressuring members of the Georgia legislature to unlawfully appoint presidential electors. “It was interesting that the judge made room for the possibility of an appeal by the state.

Read previewFormer President Donald Trump got a rare bit of good news on Wednesday as the judge overseeing his criminal case in Georgia dismissed three of the counts against him. And the judge did not dismiss the vast majority of the counts in the indictment, dismissing six out of 41 counts overall. So far, 10 criminal counts against Trump remain. Trump himself pressured Georgia Secretary of State Brad Raffensperger to "find" 11,780 votes that would flip the election results in his favor. He wrote that prosecutors didn't sufficiently explain how public officials would have violated their oaths of office if they allowed Trump a victory.

Just five days after Election Day in 2020, a conservative lawyer named Kenneth Chesebro emailed a former judge who was working for the Trump campaign in Wisconsin, James R. Troupis, pitching an idea for how to overturn the results. Through litigation, Mr. Chesebro said, the Trump campaign could allege “various systemic abuses” and, with court proceedings pending, encourage legislatures to appoint “alternative” pro-Trump electors that could be certified instead of the Biden electors chosen by the voters. “At minimum, with such a cloud of confusion, no votes from WI (and perhaps also MI and PA) should be counted, perhaps enough to throw the election to the House,” Mr. Chesebro wrote to Mr. Troupis, referring to the swing states of Wisconsin, Michigan and Pennsylvania. Mr. Troupis quickly brought Mr. Chesebro into the Trump legal team, directed him to lay out the plans in a series of memos now central to the indictment of Mr. Trump and a month later — with the help of Reince Priebus, the former White House chief of staff — secured a meeting with Mr. Trump at the White House.

This undercuts his recent testimony to state prosecutors in which he said the fake electors were contingent on winning the litigation. Chesebro told Troupis in late 2020 that it was “really not necessary” to link the GOP electors to ongoing litigation. “I have sent it to the White House this afternoon. The real decision makers,” Troupis responded, though he didn’t identify who at the White House received the memo. In the December 6, 2020, memo, Chesebro laid out the plan to put forth slates of Republican electors in seven key swing states that Trump lost, including Wisconsin.

"I would expect Trump to try to act up," former White House attorney Ty Cobb, who worked under Trump, told the Times. He and his criminal defense attorneys, Susan R. Necheles and Todd Blanche, must also avoid annoying the judge. However, it seems they have already succeeded in doing the complete opposite during a February hearing to set a date for the hush money trial. Judge Juan Merchan, overseeing the case, insisted that the attorneys stop mentioning Trump's schedule as a reason to delay the trial.

LONDON (AP) — Voters in two districts in England delivered new blows to beleaguered Prime Minister Rishi Sunak, electing opposition-party lawmakers in seats that Sunak’s Conservatives had held for years. Labour Party candidate Damien Egan won the House of Commons seats of Kingswood in southwest England, and Labour's Gen Kitchen took Wellingborough in the country’s center, results announced Friday showed. The Conservatives won both by large margins at the last national election in 2019 but saw support collapse in Thursday's special elections. The hard-right Reform party — formerly known as the Brexit Party — came third, putting more pressure on the Conservatives. The Conservatives pointed to the low turnout — less than 40% of eligible voters cast ballots — as a sign British electors are not enthusiastic about Labour.

CNN —While the 2024 presidential race seems set in stone as a rematch between President Joe Biden and former President Donald Trump, it’s also true that things happen. Back in November 1872, for instance, the newspaper publisher and Democratic presidential candidate Horace Greeley died after Election Day but before the casting of Electoral College votes. No one knows for sure what would happen if a candidate died or for some reason needed to withdraw from the race. The process of replacing a presidential candidate very much depends on when the vacancy occurs – during the primary process and before the party convention; during the convention or after the convention; or before or after people vote in November. When he dropped out of the presidential race, it set off a chaotic dash to replace him.

MADISON, Wis. (AP) — A Republican member of the Wisconsin Elections Commission who has faced calls to resign after falsely declaring that former President Donald Trump won the state claimed Thursday that he's done more for Black people than any other white Republican. Bob Spindell, who is white, made the remark after two members of the public called for him to resign during a commission meeting. “There is no white Republican that has done more for the Black community than me, so I suggest you go back and take a look at my past record,” Spindell said. WASHINGTON (AP) — The Supreme Court on Thursday heard two hours of historic arguments in a Colorado case to remove former President Donald Trump from the ballot. Murray gave well-rehearsed arguments that won the day in the Colorado Supreme Court, whose 4-3 ruling that Trump was ineligible got the case to Washington. Salmon Chase, who was then the chief justice of the Supreme Court, heard the case while acting as an appellate judge. Going into the case, the prevailing view of legal experts was the Supreme Court would keep Trump on the ballot. Would it mean a reelected President Trump suddenly becomes ineligible.

CNN —The Georgia state Senate on Friday passed a resolution creating a special committee to investigate Fulton County District Attorney Fani Willis amid allegations of an improper affair with her lead prosecutor in the 2020 election subversion case against former President Donald Trump. The resolution, which cleared the GOP-controlled state Senate 30-19, allows the special committee to subpoena people and evidence while putting witnesses under oath for their testimonies. “This resolution is about an officer of the state of Georgia, within a subdivision of the state of Georgia, and how they are using state funds,” Dolezal said on the Senate floor. Willis and Wade have not directly addressed the accusations, and the Fulton County district attorney’s office has not yet commented on the allegations specifically.
