Trump and his allies had hoped to use arraignments to get media attention, media reports previously said. The sheriff who oversees the jail system has said Trump's mugshot and fingerprints will be taken for the National Crime Information Center. A presidential historian said in March that if Trump's mugshot is made public, it'll likely cement himself as "folk hero" among his supporters. At the arraignment, Trump and the other defendants will be formally presented with the criminal charges and can enter pleas. Trump is the first former president to face any criminal charges for a first, second, third, or fourth time.

Washington CNN —Former President Donald Trump will surrender on Thursday to be booked on more than a dozen charges stemming from his efforts to reverse Georgia’s 2020 election results, the fourth time this year the former president has faced criminal charges. Trump is expected to travel from his Bedminster, New Jersey, golf club to Atlanta to turn himself in at the notorious Fulton County jail. And earlier this month, Trump was placed under arrest in Washington, DC, and arraigned on charges brought by Smith in his investigation into attempts to overturn the 2020 election. Trump falsely claimed victory after the 2020 election, and then tried to overturn the results in Georgia and other states. In a series of phone calls, he pressured Georgia election officials to help his efforts, including Secretary of State Brad Raffensperger.

And yet, the flurry of activity on Tuesday in Fulton County, Georgia, showed that more than two years after Trump’s effort to defy the will of voters, the wheels of justice are grinding forward and that consequences may be nearing. Eastman later defiantly claimed the country had crossed a “Rubicon” in the Georgia case and declared he still believed the election was stolen – despite a mountain of evidence to the contrary. And Rudy Giuliani, the hero of 9/11, is set to meet with the Fulton County District Attorney’s Office on Wednesday to discuss a bond agreement, sources told CNN. The motion also proposed a second option: that the federal court could simply issue an order barring Willis from arresting Meadows prior to next week's hearing. The order from Judge Steve Jones in U.S. District Court in Atlanta came shortly after Fulton County District Attorney Fani Willis urged the judge to reject Meadows' request. A judge on Wednesday denied former White House chief of staff Mark Meadows' bid to quickly move the Georgia election interference case to federal court in order to avoid arrest . I gave 2 weeks for people to surrender themselves to the court," Willis wrote in an email Tuesday morning. Earlier Wednesday, Kenneth Chesebro, another co-defendant in the Georgia case, filed a motion in Fulton County Superior Court demanding a speedy trial.

Eastman said in a statement he would surrender, the day after agreeing to a $100,000 bond agreement. "I am here today to surrender to an indictment that should never have been brought," Eastman said in the statement. Trump on Monday agreed to post a $200,000 bond and accepted bail conditions that would bar him from threatening co-defendants or witnesses in the case. In a 41-count Georgia indictment unveiled last week, Trump and 18 other defendants were charged with racketeering and other crimes over their efforts to reverse Trump's loss in the state to Biden. Prosecutors are seeking a trial in March, but the number of defendants and complexity of the case could lead to delays.

Former Trump chief of staff Mark Meadows asked a federal judge Tuesday to immediately move the Georgia criminal election interference case out of state court in order to protect him from being arrested, court filings showed. As an alternative, the federal court could simply issue an order barring Fulton County District Attorney Fani Willis from arresting Meadows this week, his attorney proposed in the 19-page filing. Meadows and 18 other co-defendants in Willis' case, including Trump, face a Friday deadline to surrender to jail. Meadows seeks to move the state-level case to federal court. CNN —The first two of President Donald Trump’s co-defendants surrendered at the Fulton County jail on Tuesday, setting the tone for how the defendants will be processed and how the case will progress. They had signed a bond agreement with Fulton County District Attorney Fani Willis on Monday. Hall was given an inmate identification number and released after spending roughly an hour at the jail on Tuesday. Willis has charged Trump and 18 of co-defendants of participating in schemes to meddle with Georgia’s election results. Trump, who agreed to a $200,000 bond on Monday, said he plans to turn himself in on Thursday.

Some of Donald J. Trump’s co-defendants in the election interference case in Georgia began turning themselves in on Tuesday, while others tried to get the sprawling criminal case moved out of state court and into federal court. Those motions lay the groundwork for what will be the first major legal fight in the case, which was filed in Superior Court in Atlanta last week. Most of the defendants, including Mr. Trump, plan to turn themselves in this week, as ordered by Fani T. Willis, the district attorney of Fulton County, Ga., who is leading the investigation. Another prominent Trump ally, John Eastman, turned himself in on Tuesday and was booked at the jail. Mr. Eastman, a chief architect of Mr. Trump’s effort to reverse his 2020 election loss, said in a statement that the indictment “represents a crossing of the Rubicon for our country, implicating the fundamental First Amendment right to petition the government for redress of grievances.”

Trump had to agree, for example, to make no threats on social media against co-defendants, witnesses and the 30 unindicted co-conspirators. The former president has excoriated special counsel Jack Smith, who indicted him twice, on social media and in speeches. Elliot Williams, a former federal prosecutor and CNN legal analyst, said that the terms were fair and did not infringe on Trump’s rights. Trump’s many late-night social media eruptions will make it hard for observers to believe that he will stick to the conditions to which he’s agreed. By Monday evening, Trump had already posted on his social media network about the bond.

I'll be going to Atlanta, Georgia, on Thursday to be ARRESTED by a Radical Left District Attorney, Fani Willis," Trump wrote on his social media platform, Truth Social. Fulton County District Attorney Fani Willis, who launched the investigation into Trump and his allies, has given the defendants until noon Friday to voluntarily surrender. Trump earlier Monday agreed to a $200,000 bond in the Georgia criminal case charging him with trying to illegally overturn the 2020 presidential election results in the state. Eastman — who's referenced but not charged as a co-conspirator in special counsel Jack Smith's federal criminal case against Trump for allegedly trying to subvert the 2020 election results — features prominently and repeatedly in the DA's indictment. Ray Smith, another Trump lawyer who was allegedly involved in the electors scheme, agreed to a $50,000 bond order, court filings show.

Attorney John Eastman on Monday was ordered to pay a $100,000 bond in the Georgia criminal case where he is accused of conspiring to overturn former President Donald Trump's loss in the state's 2020 election, a court filing shows. He is also accused of one count of criminal solicitation and one count of filing false documents. The bond for the racketeering charge was set at $20,000, while Eastman's remaining charges each carry a $10,000 bond, according to the court filing in Fulton County Superior Court. A consent bond order can be crafted in advance of a defendant's surrender so that they are not held in jail while the conditions of their release are worked out. Meanwhile, Segall argues against the authors’ claim that the amendment’s provisions are “self-executing,” that they can be applied to Trump or any other supposed insurrectionist immediately. This is acknowledged by Baude and Paulsen, to be sure, who argue at length that Chase was wrong. It should not happen, it would not work if it did happen, John Roberts and four more justices would not uphold it, and it would license political chaos to no good purpose whatsoever. And if the legal theorist’s response is that this isn’t the “best” way to deal with Trump, it’s just the way that the Constitution requires, then so much the worse for their theory of the Constitution. There is an irony here, which is that a similar kind of legal mentality influenced Trump’s campaign to overturn the results of the 2020 election.

They were the latest members of the former president’s inner circle to find out that associating with Trump could put them on cracking legal ice. There is increasing speculation over why Meadows was charged in Georgia but not in special counsel Jack Smith’s federal investigation into Trump’s election stealing efforts. Legal experts wonder whether he could be cooperating with that probe in a sign of peril for the former president. Trump’s inner circles have long faced legal problemsTrump’s co-defendants in the Georgia case are not the first to find out that the ex-president’s intolerance for the rules and conventions that normally constrain presidencies can lead them into treacherous waters. Trump once vowed to bring only “the best people” to Washington, but his acolytes often find themselves dragged into his legal storms.

The main requirements under the federal RICO law are at least two underlying crimes and participation in a criminal enterprise over a long period of time. WHY ARE PROSECUTORS USING RICO? That means prosecutors would not necessarily have to prove Trump personally broke the law but knowingly coordinated with others who did. RICO cases are inherently more complex because prosecutors must first prove the existence of a criminal enterprise. Prosecutors will need to prove that Trump and his co-defendants worked together towards a common criminal purpose, which is not always as straightforward as proving an underlying RICO crime.

Mark Meadows, Trump's former White House chief of staff, and lawyers Rudy Giuliani and John Eastman were among those charged. "Rather than abide by Georgia's legal process for election challenges, the defendants engaged in a criminal, racketeering enterprise to overturn Georgia's presidential election result," Willis said at a press conference. A third indictment, in Washington federal court, accuses him of illegally seeking to overturn his 2020 election defeat. Trump persists in falsely claiming he won the November 2020 election although dozens of court cases and state probes have found no evidence to support his claim. Willis's investigation drew on testimony from Trump advisers including Giuliani, who urged state lawmakers in December 2020 not to certify the election, and Republican state officials like Raffensperger and Governor Brian Kemp, who refused to echo Trump's false election claims.

"Trump and the other defendants charged in this indictment refused to accept that Trump lost, and they knowingly and willfully joined a conspiracy to unlawfully change the outcome of the election in favor of Trump," the indictment said. But the Trump campaign and their affiliated committees ultimately did not honor that pledge, according to campaign finance records. Over more than two months, Giuliani served as the public face of Trump's election challenges, which ultimately failed.
