WASHINGTON — Rep. Dan Goldman, D-N.Y., plans to file a resolution in the House on Thursday that would express support for the 22nd Amendment of the Constitution, which sets the term limits for the president. However, he could introduce it as a privileged resolution to force Republicans to vote on the matter. The resolution, which NBC News obtained Wednesday, reaffirms that the 22nd Amendment "applies to two terms in the aggregate as President of the United States" and reaffirms that it "applies to President-elect Trump." The resolution lists a number of instances in which Trump has joked or floated the idea of serving longer than two terms in the White House or being a dictator. To amend the Constitution and modify term limits for president, both the House and the Senate would need to approve amendment language by two-thirds votes.

But holding the White House and Senate majority for another few weeks doesn’t guarantee Democrats will have an easy time processing the final batch of Biden appointees. “There is a push across the board from the White House and the Senate for Democrats to show up and do the job they were elected to do,” a senior White House official, asking for anonymity to speak candidly, told CNN. The White House official pointed to how Republican Texas Sen. John Cornyn on Saturday promised “no weekends, no breaks” to confirm Trump’s Cabinet once he took power, and the White House official encouraged Democrats to show that dedication to judges in Biden’s final stretch. “Regardless of party, the American people expect their leaders to prioritize the rule of law and ensuring the criminal justice system can function effectively in every stated,” said White House spokesperson Andrew Bates. Arizona Attorney General Kris Mayes said Sunday that she has “no intention” of dropping the criminal case against a group of President-elect Donald Trump’s allies who sought to overturn the results of the 2020 election in Arizona. “I have no intention of breaking that case up. I have no intention of dropping that case,” Mayes, a Democrat, told MSNBC’s Ali Velshi. Bernie Sanders, I-Vt., on Sunday defended keeping Justice Sonia Sotomayor on the Supreme Court, after some Democrats have reportedly considered pressuring her to step down while President Joe Biden is still in office. He added that he’s heard “a little bit” of talk from Democratic senators about asking Sotomayor, who is serving a lifetime appointment to the Supreme Court, to step aside. Sonia Sotomayor, who is 70, is serving a lifetime appointment to the Supreme Court. If Sotomayor were to die during Trump’s term, she would likely be replaced by a conservative justice, pushing the now 6-3 conservative court further to the right. She died in September 2020 and Trump, then serving his first term, appointed the conservative Justice Amy Coney Barrett to replace her, leading to the court’s current conservative makeup.
