☆ Analysis: John Roberts remains confounded by Donald Trump as election approaches

The former star appellate lawyer who allies once cast as the smartest person in the room remains confounded by the realities of Donald Trump. Roberts was shaken by the adverse public reaction to his decision affording Trump substantial immunity from criminal prosecution. The Roberts Court has been in sync with the GOP political agenda largely because of decisions the chief justice has authored: For Trump and other Republicans. But the politically charged valence deepened in the justices’ resolution of the case against former President Trump on election-interference charges from 2020. Harvard Law School professor Richard Lazarus, a longtime friend of Roberts, spent time with him in July immediately after the Trump decision was issued.

Assuming the Senate continues confirming pending nominees when it returns in November, the next president is poised to inherit the smallest number of judicial vacancies since when George H.W. CNN —Former NFL stars Chad “Ochocinco” Johnson and James Harrison will fight in an exhibition mixed martial arts (MMA) bout in New Orleans next year, the pair announced on social media Wednesday. Johnson first said it was a three-round bout before Harrison said it would actually last five rounds. CNN —Two climate activists in their early 20s were sentenced to prison by a London court Friday for throwing soup over Vincent Van Gogh’s “Sunflowers” painting during a protest against fossil fuels. CNN —New York City Mayor Eric Adams has been indicted on at least one federal criminal charge, multiple sources familiar with the matter tell CNN. The indictment follows a monthslong federal investigation into campaign fundraising violations and foreign influence. The mayor is expected to have several days to turn himself in, according to sources familiar with the case. New York City campaign finance records show Arkan donated $1,500. As part of their investigation, FBI agents seized Adams’ cell phones days after the raid on Suggs’ home.

Washington CNN —Vice President Kamala Harris’ vow to gut the Senate’s filibuster rule to pass a bill codifying abortion rights has cost her an endorsement from a leading Senate moderate: Joe Manchin. Asked about Harris’ past support for gutting the filibuster, Manchin said: “Well, she said she supported banning fracking too, and she changed that. Senate GOP Whip John Thune attacked Harris over her filibuster comments and vowed to preserve the delay tactic if he is elected as majority leader. “I think they’re willing to change the filibuster over a whole range of issues,” Thune said of the Democrats. I think the same is true for women’s rights, workers’ rights, so common sense gun measures to reduce gun violence.

Bryan Kohberger, the man accused in the murders of four University of Idaho students, was transported by plane Sunday morning from the Idaho county where he was being jailed to another county where his trial will be held. Latah County District Judge John Judge had ruled in favor of lawyers for Kohberger, 29, who argued a trial in Latah County would be unfair because of the intense pretrial publicity creating a "mob mentality" against the defendant. "While the issue of extensive, sensationalized coverage is not unique to Latah County," Judge added, "it is potentially more impactful given the volume of coverage coupled with the smaller population." Despite the change, Latah County prosecutors and Kohberger's public defenders are expected to remain through the trial. Some of the victims' families have expressed frustration over the trial's delay and had pressed for the case to remain in Latah County so that its residents could represent the jury.
