CNN —A federal magistrate judge has denied Hunter Biden’s request to appear virtually for his first court hearing in the federal gun case against him and set his arraignment for September 26. The initial court appearance and arraignment for President Joe Biden’s son will be held at 10 a.m. ET on Tuesday before Magistrate Judge Christopher J. Burke. The deal fell apart under scrutiny from another federal judge, who had taken several recesses to allow the attorneys to regroup and see if they could resolve disagreements. Given the seriousness of the felony gun charges, prosecutors say the magistrate judge should assess Biden in person before deciding his conditions of release.

There’s another one attacking President Trump,” Committee Chairmen Jim Jordan of Ohio said in his opening statement. “The Justice Department’s got both sides of the equation covered.”Republican Rep. Mike Johnson of Louisiana alleged that the public no longer trusts the Justice Department. The Justice Department works for the American people.”The hearing comes shortly after the Justice Department indicted Hunter Biden on federal firearms charges. Republicans have alleged that the Justice Department interfered with the Hunter Biden investigation. The topic is sure to stick around as Republicans’ impeachment inquiry into President Biden will put a particular focus on how the Justice Department handled Hunter Biden’s case.

This will be Garland's first testimony before Congress since two historic firsts: the department's criminal charges against a former U.S. president, Trump, and against a sitting president's adult child. Republicans have also been critical of the department's handling of a five-year-long tax investigation into Hunter Biden, 53. Weiss' office this month charged Hunter Biden with three counts related to purchase and possession of a firearm while he was using illegal drugs. Hunter Biden intends to plead not guilty. "Singling out individual career public servants who are just doing their jobs is dangerous," Garland plans to say.

Internal Revenue Service agents have claimed in whistleblower testimony the investigation was “slow walked” and the authority of the prosecutor in charge was curtailed by the Justice Department. While the Hunter Biden case is far from typical, it touches on some of the more mundane but less-well-understood aspects of the criminal justice system. Such an order, requiring approval in this case by Garland or another senior Justice Department official, gives the prosecutor what’s typically known as “special attorney” status. This person is not subject to day-to-day supervision of the Justice Department, but must still comply with department regulations, policies and procedures. Hunter Biden, son of US President Joe Biden (R), leaves the J. Caleb Boggs Federal Building in Wilmington, Delaware, on July 26, 2023. A federal judge Wednesday denied a request by Hunter Biden to have his first court appearance on felony firearm charges be conducted via video. Judge Christopher Burke ordered Biden, the son of President Joe Biden, to appear in U.S. District Court in Wilmington, Delaware, in person for that hearing on Tuesday. The lawyer, Abbe Lowell, told the judge that Hunter Biden will plead not guilty to the charges during his appearance, "and there is no reason why he cannot utter those two words by video conference." Weiss replied that that argument was not enough to justify a virtual appearance.

The new testimony comes as House Republicans begin an impeachment inquiry into President Joe Biden and his family, potentially undercutting one element of that effort. At issue is an October 2022 meeting between prosecutors and case agents working on the Hunter Biden investigation. But the deal fell apart amid scrutiny from a judge, and Weiss subsequently requested special counsel status. Shapley, a 14-year IRS veteran who oversaw parts of the Hunter Biden probe, alleged in testimony to Congress there was political interference in the investigation. Last week, CNN and others reported on Sobocinski’s testimony, which prompted Shapley’s attorneys to dispute his recollection of the October 2022 meeting.

Hunter Biden will plead not guilty during his initial court appearance for three federal felony gun charges, his attorney said Tuesday as he denied that the son of President Joe Biden is asking for "special treatment" at his first court appearance in the case. Hunter's lawyer Abbe Lowell revealed that planned plea as he asked a judge to hold the court appearance by video conference instead of in person at U.S. District Court in Wilmington, Delaware. The court appearance has not yet been scheduled. Lowell wrote in Tuesday's letter that Biden was "not seeking any special treatment" by requesting the video conference for his first appearance in court on the charges. Lowell's letter called prosecutors' opposition "puzzling," arguing that he was making a "common-sense request in seeking a video appearance.

The octogenarian president is increasingly coming under scrutiny over his ability to serve a full second term if he wins in November 2024. But the trauma seizing Washington will soon intrude, transfixing the nation in a tumultuous 2024 election. The turmoil in the Republican Party is creating the kind of dysfunction and extremism that could turn off general election voters next year. In more placid times, the auto strike would be a dominant national issue defining a fraught political moment. But it’s just one of many crises threatening to overwhelm a political system that appears on the verge of a serious malfunction.

CNN —Hunter Biden sued the Internal Revenue Service on Monday, alleging its agents illegally released his tax information and that the agency failed to protect his private records. He is seeking, among other things, all documents involving the disclosure of the tax information, $1,000 for each unauthorized disclosure and attorneys fees. The lawsuit, which was filed in federal court in Washington, DC, does not name the two IRS agents turned whistleblowers as defendants. The IRS agents went public with their allegations concerning the Justice Department’s handling of investigation into Hunter Biden earlier this year. After the judge would not sign off on the deal, talks broke down between US attorney David Weiss’ office and Hunter Biden’s attorneys.

Inside the White House, neither was an unexpected development. Biden had just arrived back to the White House from a five-day swing through Asia when McCarthy formalized his impeachment plans Tuesday. An element of the White House strategy is keeping Biden focused on his governing duties while discrediting House Republican investigators. White House officials have also steadfastly refused to weigh in, describing it was a family matter. The president and first lady have kept him close amid his legal proceedings, and Hunter has appeared at family events and White House functions.

The indictment comes weeks after the collapse of a plea deal that would have averted a criminal trial and distracting headlines for President Joe Biden. Trump's include federal indictments over the handling of classified documents and efforts to overturn his 2020 election loss to Joe Biden. Trump also pointed to the lack of connection to Joe Biden in the gun charge plea agreement. Federal prosecutors investigating Hunter Biden have not indicated Joe Biden is connected over the course of their yearslong probe. Two FBI agents who worked on the Hunter Biden case testified separately behind closed doors this week to lawmakers about allegations of political interference in the case.

Federal prosecutors charged Hunter Biden, the president’s son, with lying about his drug use when he purchased a handgun in 2018. The indictment could lead to a high-profile trial of Biden next year, coinciding with his father’s re-election campaign. That agreement would have resolved the Justice Department’s long-running investigation without Biden serving prison time. Prosecutors could still file charges against Biden in that case. Speaker Kevin McCarthy said on Tuesday that the House would proceed with a formal impeachment investigation focused on whether President Biden and his family benefited from what Republicans have contended were corrupt activities by Hunter Biden.

WHAT IS AN IMPEACHMENT INQUIRY? An impeachment inquiry is a formal step that can precede a House vote on whether to approve articles of impeachment and eventually a trial in the Senate. It did not hold a full impeachment inquiry before bringing impeachment charges in the final weeks of Trump's presidency following the Jan. 6, 2021, Capitol attack. Weiss has said prosecutors will seek to indict Hunter Biden on tax and gun charges by Sept. 29. REUTERS/Jonathan Ernst/File Photo Acquire Licensing RightsWASHINGTON, Sept 6 (Reuters) - U.S. prosecutors said in a court filing on Wednesday they will seek an indictment of President Joe Biden's son, Hunter, by Sept. 29 in his tax and firearms case. "The government intends to seek the return of an indictment in this case before that date," Weiss wrote in a status report to U.S. District Judge Maryellen Noreika. In July, Noreika rejected a proposed plea deal that would have resolved the tax and gun charges, raising concerns over its legality and the scope of immunity it offered Hunter Biden. Republicans in Congress have raised the possibility of impeaching President Biden over his son's business dealings and accuse the Department of Justice of giving him a "sweetheart deal."

CNN —Special counsel David Weiss intends to seek an indictment against President Joe Biden’s son, Hunter Biden, relating to gun charges by the end of the month, the Justice Department said Wednesday. However, after his plea deal to resolve two tax charges fell apart in court, the future of the gun deal has been in limbo. Hunter Biden’s gun-related legal troubles relate to a firearm he purchased in October 2018. In addition to the gun case, Weiss is still weighing whether to charge Hunter Biden with tax crimes. Hunter Biden’s tax-related legal jeopardy emerged after he repeatedly missed IRS deadlines to pay his taxes on time.

The gun charge that Weiss indicates he will seek from a grand jury prohibits people who are users of illicit drugs from possessing a firearm. Federal prosecutors plan to ask a grand jury to indict Hunter Biden , the son of President Joe Biden , on gun-related charge before Sept. 29, they revealed in a court filing Wednesday. But Hunter Biden has been under criminal investigation by the U.S. Attorney's Office in Delaware, which Weiss leads, since 2018. Shortly afterward, Weiss said Hunter Biden would likely face trial in either California or Washington, D.C., for the tax crimes. Weiss's office has said the gun agreement is now off the table, and that it is not valid because it was not signed by the U.S.
