GOP lawmakers did select Steve Scalise as their nominee for the job that is second in the line of presidential succession on Wednesday. The worsening debacle in the House follows the ouster of former Speaker Kevin McCarthy last week by eight Republicans voting with Democrats. But some GOP leaders are irritated that the jockeying is distracting from the imperative to find a speaker. He was still well short of the 217 votes – a majority of the current House – needed to claim the speakership on the floor. “He has no path to 217,” one top House Republican said on condition of anonymity.

CNN —House Republicans picked Rep. Steve Scalise as their nominee for speaker on Wednesday, but the Louisiana Republican lacks the votes needed to win the gavel and it remains unclear whether he will be able to win over holdouts. Scalise won out over Rep. Jim Jordan in a closed-door vote by the House GOP conference to pick their speaker nominee on Wednesday. House Republicans hold a narrow majority and Scalise can only afford to lose four GOP votes on the floor and still win the speakership. McCarthy’s ouster, which was driven by a group of hardline conservatives, has intensified deep divisions within the House GOP conference and escalated tensions. Scalise is a veteran of House GOP leadershipScalise has risen through the ranks of leadership during his time in Congress.

CNN —Federal prosecutors on Tuesday accused Rep. George Santos of stealing donors’ identities and running up thousands of dollars in fraudulent charges on their credit cards. This fresh round of charges, called a superseding indictment, effectively replaces the earlier case against Santos. In May, Santos, 35, pleaded not guilty to 13 federal charges. Pressed Tuesday on whether he would resign, Santos said: “No, I will not.”“I did not have access to my phone. Two candidates, GOP Majority Leader Steve Scalise of Louisiana and Judiciary Chairman Jim Jordan of Ohio, have already launched campaigns. He’s not the first GOP speaker to think so. But in this political climate, any Republican speaker who has to rely on Democratic votes is critically weakened and probably can’t last long. But the only way a Republican speaker will be able to pass aide to Ukraine will be to do so with Democratic help. The lack of such flexibility has been a fatal flaw of GOP speakers for years.

CNN —The US House of Representatives is bracing for a key vote Tuesday over Speaker Kevin McCarthy’s political future as GOP Rep. Matt Gaetz of Florida pushes for his ouster. House Speaker Kevin McCarthy speaks with reporters at the U.S. Capitol in Washington, DC, October 3, 2023. No House speaker has ever been ousted through the passage of a resolution to remove them. If a procedural vote fails, then there would be a vote directly on whether to remove McCarthy as speaker, which would take only a majority to succeed. Drew Angerer/Getty ImagesTo force a vote, a member must go to the House floor and announce their intent to offer the resolution to remove the speaker – as Gaetz did.

CNN —Rep. Matt Gaetz is planning to attempt to oust Speaker Kevin McCarthy from the role this week after the House leader worked with Democrats to avoid a government shutdown on Saturday. “Speaker McCarthy made an agreement with House conservatives in January and since then he’s been in brazen, repeated material breach of that agreement,” Gaetz said Sunday. “Look, the one thing everybody has in common is that nobody trusts Kevin McCarthy. “I think Kevin McCarthy is a very weak speaker. “The only way Kevin McCarthy is speaker of the House at the end of this coming week is if Democrats bail him out.

CNN —Federal agencies are making final preparations with the government on the brink of a shutdown and congressional lawmakers racing against Saturday’s critical midnight deadline. “After meeting with House Republicans this evening, it’s clear the misguided Senate bill has no path forward and is dead on arrival,” McCarthy wrote on X. But there is still no consensus on what - if anything - they will put on the House floor Saturday to avoid a government shutdown. McCarthy argued on Friday that aid to Ukraine should be dropped from the Senate bill. Border security has also become a complicating factor for the Senate bill as many Republicans now want to see the bill amended to address the issue.

CNN —The House is expected to take up a GOP stopgap bill to extend government funding on Friday – but House Speaker Kevin McCarthy appears to lack the votes to pass it and Congress is still on track to trigger a government shutdown. McCarthy is gearing up to have his chamber consider a GOP stopgap bill with border provisions attached as House GOP leaders have insisted that border security must be addressed as part of the spending fight. “I still got time, I got time to do other things,” McCarthy responded when asked by CNN’s Manu Raju what will happen if the stopgap bill fails. Separately, House GOP leaders brought a series of spending bills to the floor Thursday evening as they try to show conservatives they are working in good faith to advance full-year funding bills. Meanwhile, the Senate is working to advance a bipartisan stopgap bill that would keep the government open through November 17 and provide additional aid to Ukraine and disaster relief.

McCarthy, though, has stopped short of committing to putting a Senate-passed short-term spending bill on the floor, knowing that doing so could mean a call for his ouster. During a call with the Republican conference Saturday afternoon, McCarthy pushed members to rally around a short-term spending bill that includes funds for border security. That would give House Republicans a position from which to begin negotiations with the Senate. It’s taking away leverage from House Republicans,” said GOP Rep. Garret Graves of Louisiana. But House Republicans marked their bills up at far lower levels after a rebellion from conservatives.

More broadly, it could raise fresh doubts about the capacity of a polarized nation – featuring an ever more extreme and performative Republican Party in ex-President Donald Trump’s image – to govern itself. But the Republican majority is so thin – the speaker can lose only four votes with its current margin – and the party is so bitterly divided, that past experience may be a poor predictor of outcomes. So handing a win to the critical Republicans on whom the GOP majority depends may be a poor strategy. Rep. Now, his proxies in the House GOP are effectively weaponizing an impeachment inquiry of Biden to try to again destroy Trump’s potential opponent in the next presidential election. CNN —Former House Speaker Nancy Pelosi on Wednesday defended her approach to the first impeachment of then-President Donald Trump in 2019, in her first public comments on the Republican effort to launch an inquiry into President Joe Biden. As CNN previously reported, the speaker’s announcement “directing” a House committee to open a formal inquiry into Biden meant there would be no floor vote to formally authorize the effort, according to a GOP source. Skipping an impeachment inquiry vote would mark a departure from McCarthy’s previous comments on the matter, but the speaker earlier Wednesday placed the blame squarely on his predecessor. They’ve had what nine months of collecting information, they have nothing.”The House did hold a vote to launch the first impeachment inquiry into Trump, but about a month into probe. CNN —It would be a mistake to presuppose these are the final days of Sen. Mitch McConnell’s record-setting run as the Republican leader in the Senate. In January, Trump referred to Barrasso as McConnell’s “flunky” during a radio interview in Barrasso’s home state of Wyoming. Trump views McConnell as an enemyNo Senate leader will be able to maintain a flawless relationship with Trump, but McConnell’s has been particularly fraught. McConnell’s wife, Elaine Chao, who served in Trump’s administration as transportation secretary, has more recently been the subject of racial insults from Trump. Any successor would have to navigate Trump’s control of the party – and the very real potential that Trump could return to the White House.

Also in the Senate, California’s Dianne Feinstein, 90, has been ill and displayed apparent cognitive decline in public in recent months. But given that Biden, McConnell and Feinstein are public officials, voters are entitled to a high level of transparency. Biden, for instance, would be 86 by the time his second term ends, which represents his biggest vulnerability in the 2024 election. Remarkably, in an age where major questions divide on party lines, 69% of Democrats shared that view. Should Biden, if he wins a second term, experience a similar moment to McConnell, questions about the continuity of US leadership would reverberate around the world and offer openings for US adversaries.

CNN —Speaker Kevin McCarthy deflected questions about the additional charges filed Thursday against former President Donald Trump in the case alleging mishandling of classified documents during his time in the White House, instead pointing to President Joe Biden. In his latest defense of Trump, McCarthy questioned why Biden had classified documents from his time as a senator and why the president hasn’t been indicted, but would not engage on the new charges that Trump is facing. “What concerns me is you have a sitting president that has a situation like this, but even worse, that had documents, but nothing’s happened,” McCarthy told CNN’s Manu Raju. Trump, who already faced 37 criminal charges in the case, was charged with an additional count of willful retention of national defense information and two additional obstruction counts. In one recent example, CNN reported earlier this month that McCarthy told Trump in a private phone call that he personally backed the idea of expunging Trump’s two impeachments and would bring it up to the conference to gauge support, a source said.

The freeze is not an isolated incidentEarlier this year, McConnell could not hear reporters at a different news conference. Most importantly for Trump and the House Republicans doing his bidding, it could distract from the legal storm around the former president. After only one presidential impeachment in the first two centuries of US history, Biden’s would be the fourth impeachment in around 25 years if House Republicans follow through. The document contained no proof of the allegations or any evidence Biden took part in his son’s work for the firm. McCarthy had for months deflected calls for the impeachment of Biden from the most radical members of his conference. McCarthy insisted on Tuesday that he was only contemplating an impeachment inquiry – rather than a full-scale drive to an impeachment vote – in the House.

CNN —Donald Trump’s legal troubles deepened earlier this week when he was informed by special counsel Jack Smith that he’s the target of the criminal investigation into the aftermath of the 2020 election – the clearest sign yet that the former president could soon face more criminal charges. But without more detail, it’s hard to know exactly what shape the charges will take or what Trump 2020 election-related conduct they are aimed at. Among the potential charges Trump has been warned about is one pertaining to witness tampering, according to the Wall Street Journal and other outlets. Trump’s alleged involvement in a criminal conspiracy has been invoked in the litigation around the House select committee that investigated January 6’s pursuit of Trump lawyer John Eastman’s emails. That ruling pointed both to the obstruction of an official proceeding statute and the general conspiracy statute.

The West Virginia Democrat’s model has served him well with repeated statewide wins in one of the most conservative pro-Trump states in the nation. For now, Manchin’s noncommittal answers are worrying some of his Democratic colleagues. Polls show that both Biden and Trump, the front-runner for the GOP nomination, are unpopular. It argues, therefore, that 79 electoral votes are potentially at risk for Biden from the involvement of a third-party challenger. Such a challenger would also need to win states where Biden won big, and at least some conservative bastions.

Tommy Tuberville is being “irresponsible” and jeopardizing national security by blocking military promotions over his objections to the Defense Department’s reproductive health policies. Trump’s legal defense strategy is now entirely fused with his electoral one. His bid to regain the White House is no longer a mere political campaign but has now become about self-preservation. If Trump becomes the 2024 GOP nominee, the cloud of criminality could linger over the election until November next year. This potentially could cause havoc with Trump’s political schedule. The salience of Trump’s grievance campaign could become even more relevant in a general election.

We’re looking back at the strongest, smartest opinion takes of the week from CNN and other outlets. Not to worry, said Senate Minority Leader Mitch McConnell, a veteran of debt limit battles. McConnell’s reassurance that all will work out in the end is validated by history, but that doesn’t mean this time couldn’t be different. “If female voters are key to a Donald Trump victory in 2024, the former president should be in big trouble – but he doesn’t seem to care,” Jill Filipovic observed. “The town hall audience – selected on the basis of their intention to vote in the Republican primary in New Hampshire – appeared to be made up mostly of Trump fans.
He would not win the White House. The unanimous jury verdict was vindication for Carroll and offered a symbolic win for other women who have made assault allegations against the president. Many White House hopefuls have exited presidential races for less. Nikki Haley or prospective White House contender, Florida Gov. House Speaker Kevin McCarthy characteristically dodged commenting on the verdict after leaving debt crisis talks at the White House on Tuesday.
I think criticisms of that stance as ‘anti-feminist’ are a farce,” Ocasio-Cortez posted on Bluesky, a new social media app. Feinstein, who has been away as she recovers from shingles, is a member of the powerful Senate Judiciary Committee where her absence has created issues for Democrats as the panel works to process judicial nominees. Several other House Democrats have also expressed support or called for Feinstein to resign as a result. The spokeswoman also told CNN that Ocasio-Cortez will not primary New York Democratic Sen. Kirsten Gillibrand in 2024. Not long after, however, Republicans formally blocked a request from Senate Majority Leader Chuck Schumer to temporarily replace Feinstein on the committee.
