☆ Chaos in House GOP intensifies with Scalise’s speakership bid in peril

GOP lawmakers did select Steve Scalise as their nominee for the job that is second in the line of presidential succession on Wednesday. The worsening debacle in the House follows the ouster of former Speaker Kevin McCarthy last week by eight Republicans voting with Democrats. But some GOP leaders are irritated that the jockeying is distracting from the imperative to find a speaker. He was still well short of the 217 votes – a majority of the current House – needed to claim the speakership on the floor. “He has no path to 217,” one top House Republican said on condition of anonymity.

CNN —House Republicans picked Rep. Steve Scalise as their nominee for speaker on Wednesday, but the Louisiana Republican lacks the votes needed to win the gavel and it remains unclear whether he will be able to win over holdouts. Scalise won out over Rep. Jim Jordan in a closed-door vote by the House GOP conference to pick their speaker nominee on Wednesday. House Republicans hold a narrow majority and Scalise can only afford to lose four GOP votes on the floor and still win the speakership. McCarthy’s ouster, which was driven by a group of hardline conservatives, has intensified deep divisions within the House GOP conference and escalated tensions. CNN —Federal prosecutors on Tuesday accused Rep. George Santos of stealing donors’ identities and running up thousands of dollars in fraudulent charges on their credit cards. This fresh round of charges, called a superseding indictment, effectively replaces the earlier case against Santos. In May, Santos, 35, pleaded not guilty to 13 federal charges. Pressed Tuesday on whether he would resign, Santos said: “No, I will not.”“I did not have access to my phone. Two candidates, GOP Majority Leader Steve Scalise of Louisiana and Judiciary Chairman Jim Jordan of Ohio, have already launched campaigns. He’s not the first GOP speaker to think so. But in this political climate, any Republican speaker who has to rely on Democratic votes is critically weakened and probably can’t last long. But the only way a Republican speaker will be able to pass aide to Ukraine will be to do so with Democratic help. The lack of such flexibility has been a fatal flaw of GOP speakers for years.

CNN —Federal agencies are making final preparations with the government on the brink of a shutdown and congressional lawmakers racing against Saturday’s critical midnight deadline. “After meeting with House Republicans this evening, it’s clear the misguided Senate bill has no path forward and is dead on arrival,” McCarthy wrote on X. But there is still no consensus on what - if anything - they will put on the House floor Saturday to avoid a government shutdown. McCarthy argued on Friday that aid to Ukraine should be dropped from the Senate bill. Border security has also become a complicating factor for the Senate bill as many Republicans now want to see the bill amended to address the issue.

CNN —The House is expected to take up a GOP stopgap bill to extend government funding on Friday – but House Speaker Kevin McCarthy appears to lack the votes to pass it and Congress is still on track to trigger a government shutdown. McCarthy is gearing up to have his chamber consider a GOP stopgap bill with border provisions attached as House GOP leaders have insisted that border security must be addressed as part of the spending fight. “I still got time, I got time to do other things,” McCarthy responded when asked by CNN’s Manu Raju what will happen if the stopgap bill fails. Separately, House GOP leaders brought a series of spending bills to the floor Thursday evening as they try to show conservatives they are working in good faith to advance full-year funding bills. CNN —Former House Speaker Nancy Pelosi on Wednesday defended her approach to the first impeachment of then-President Donald Trump in 2019, in her first public comments on the Republican effort to launch an inquiry into President Joe Biden. As CNN previously reported, the speaker’s announcement “directing” a House committee to open a formal inquiry into Biden meant there would be no floor vote to formally authorize the effort, according to a GOP source. CNN —It would be a mistake to presuppose these are the final days of Sen. Mitch McConnell’s record-setting run as the Republican leader in the Senate. In January, Trump referred to Barrasso as McConnell’s “flunky” during a radio interview in Barrasso’s home state of Wyoming. Trump views McConnell as an enemyNo Senate leader will be able to maintain a flawless relationship with Trump, but McConnell’s has been particularly fraught. McConnell’s wife, Elaine Chao, who served in Trump’s administration as transportation secretary, has more recently been the subject of racial insults from Trump. But given that Biden, McConnell and Feinstein are public officials, voters are entitled to a high level of transparency. CNN —Speaker Kevin McCarthy deflected questions about the additional charges filed Thursday against former President Donald Trump in the case alleging mishandling of classified documents during his time in the White House, instead pointing to President Joe Biden. In his latest defense of Trump, McCarthy questioned why Biden had classified documents from his time as a senator and why the president hasn’t been indicted, but would not engage on the new charges that Trump is facing. “What concerns me is you have a sitting president that has a situation like this, but even worse, that had documents, but nothing’s happened,” McCarthy told CNN’s Manu Raju. Trump, who already faced 37 criminal charges in the case, was charged with an additional count of willful retention of national defense information and two additional obstruction counts. In one recent example, CNN reported earlier this month that McCarthy told Trump in a private phone call that he personally backed the idea of expunging Trump’s two impeachments and would bring it up to the conference to gauge support, a source said.

Most importantly for Trump and the House Republicans doing his bidding, it could distract from the legal storm around the former president. After only one presidential impeachment in the first two centuries of US history, Biden’s would be the fourth impeachment in around 25 years if House Republicans follow through. The document contained no proof of the allegations or any evidence Biden took part in his son’s work for the firm. McCarthy had for months deflected calls for the impeachment of Biden from the most radical members of his conference. McCarthy insisted on Tuesday that he was only contemplating an impeachment inquiry – rather than a full-scale drive to an impeachment vote – in the House.

CNN —Donald Trump’s legal troubles deepened earlier this week when he was informed by special counsel Jack Smith that he’s the target of the criminal investigation into the aftermath of the 2020 election – the clearest sign yet that the former president could soon face more criminal charges. But without more detail, it’s hard to know exactly what shape the charges will take or what Trump 2020 election-related conduct they are aimed at. Among the potential charges Trump has been warned about is one pertaining to witness tampering, according to the Wall Street Journal and other outlets. Trump’s alleged involvement in a criminal conspiracy has been invoked in the litigation around the House select committee that investigated January 6’s pursuit of Trump lawyer John Eastman’s emails. That ruling pointed both to the obstruction of an official proceeding statute and the general conspiracy statute.

The West Virginia Democrat’s model has served him well with repeated statewide wins in one of the most conservative pro-Trump states in the nation. For now, Manchin’s noncommittal answers are worrying some of his Democratic colleagues. Polls show that both Biden and Trump, the front-runner for the GOP nomination, are unpopular. It argues, therefore, that 79 electoral votes are potentially at risk for Biden from the involvement of a third-party challenger. Such a challenger would also need to win states where Biden won big, and at least some conservative bastions.
