Missouri voters approved a ballot measure enshrining abortion rights in the state constitution, NBC News projects, effectively undoing the state’s near-total abortion ban and delivering a victory to abortion rights activists. In early September, a circuit court judge ruled that the campaign did not meet legal requirements to qualify for the ballot. But the state Supreme Court soon stepped in, reversing that judgment and clearing the way for the amendment to go before voters. Missouri joins a string of red states where voters have acted to expand abortion rights after state legislatures passed bans following the 2022 Dobbs decision. Nine other states considered constitutional amendments concerning abortion rights in this election, including Arizona, Colorado, Florida, Maryland, Montana, Nebraska, Nevada, New York and South Dakota.

Arizona voters on Tuesday approved an amendment enshrining abortion rights in the state constitution, NBC News projects. A fundamental right to abortion is part of the Arizona Constitution once and for all. In April, the conservative-leaning Arizona Supreme Court ruled to reinstate a near-total ban on abortion from 1864. Arizona for Abortion Access, the coalition of reproductive rights organizations behind the ballot effort, had shattered the record for the number of valid signatures gathered for a ballot initiative in the state. Constitutional amendments to enshrine abortion rights were on the general election ballots in nine other states Tuesday: Colorado, Florida, Maryland, Missouri, Montana, Nebraska, Nevada, New York and South Dakota.

Outside of the eight states with the ballot measures, certain cities and municipalities in three states, as well as Washington, D.C., have allowed noncitizens to vote in some local elections. Supporters of the ballot measures have argued that they are a way to get ahead of any potential problems related to noncitizen voting. Passage of the amendments marks the latest chapter of Republican's ongoing efforts to put unfounded claims of noncitizen voting at the center of a broader political strategy. Former President Donald Trump has long made false claims that noncitizen voting is resulting in widespread fraud and that Democrats have helped migrants enter the country to cast those ballots. Republican Bernie Moreno, a Colombian immigrant who became a high-profile Cleveland car dealer, has unseated Sen. Sherrod Brown, D-Ohio, NBC News projects. Republicans flipped another Democratic-held seat in a state Trump carried easily, West Virginia, on Tuesday and were aiming to capture another in Montana. Moreno’s victory also ends, for now, the 50-year political career of Brown, first elected as a state representative in the post-Watergate era. For decades Brown had fashioned himself as an unapologetic liberal and progressive tightly aligned with working-class voters, particularly organized labor. The messaging strategy, rooted in Trump’s Buckeye State popularity, bolstered Moreno even as Brown and the Democrats sought to exploit his shortcomings.

Democrat Angela Alsobrooks has won Maryland’s Senate race, NBC News projects, defeating popular former Republican Gov. Larry Hogan and becoming the first Black woman elected to represent the state in the Senate. It also means that, for the first time in history, Maryland will have a Black senator, governor and mayor of its largest city, Baltimore. A ballot measure that would have enshrined abortion rights in Florida's constitution failed on Tuesday, NBC News projects, after a political fight that was among the most hotly contested in the state this election cycle. The amendment won majority support from Florida voters, but it needed to cross the 60% threshold to pass under state law. Its defeat is a setback for reproductive rights groups in the red-leaning state and a victory for Republican Gov. Even though the ballot measure failed, the NBC News Exit poll found that 65% of Florida voters said abortion should be legal in all or most cases. Another ballot measure DeSantis opposed, the effort to legalize the use of recreational marijuana in Florida, also failed on Tuesday, NBC News projected.

An effort to legalize the use of recreational marijuana in Florida has failed at the ballot box, NBC News projects. Despite endorsements running the gamut from the Florida Democratic Party to former President Donald Trump, Amendment 3, which would have legalized the recreational use and manufacturing of marijuana in the state, failed to get the 60% voter support needed to pass a state constitutional amendment. Florida voters expanded eligibility for medical use in a successful 2016 statewide vote. For the foreseeable future, however, recreational use of the drug will remain illegal in Florida. We don’t need that in Florida,” DeSantis said of the drug, also urging voters to reject Amendment 4, which would enshrine Roe-era reproductive health protections in the Florida Constitution.

Bomb threats were reported across five key battleground states, both to polling places and government offices where votes are counted. The FBI, which engaged with local and state officials, confirmed that some of the threats originated from Russian email domains. “There were no major issues across the state” in the election process, said Nevada Secretary of State Francisco Aguilar. CNN —Republican Tim Sheehy will defeat three-term Montana Sen. Jon Tester, CNN projects, adding to Republicans’ newly won Senate majority. Montana has long been a deep-red state in presidential elections — and every other statewide office is currently held by a Republican. Still, his seat – alongside Democratic-held seats in two other red states, Ohio and West Virginia – was a prime Republican target this year. Gen Z voters who struggle with cursive could slow the vote count, Nevada's secretary of state said. He attributed higher numbers of problematic mail ballots to young voters without signatures. States in the US require a voter's signature on mail and absentee ballots, and several states require additional verifications, including comparing that signature to the voter's signature on file. As the state continues to process mail ballots this week, those figures — which are already higher than in 2020 and 2022 — are expected to increase. Hundreds of thousands of mail ballots, or about 1%, were rejected across the country during the 2022 midterm elections, NPR reported at the time.
