CNN —Special counsel Jack Smith said Wednesday that he is appealing a judge’s decision to throw out the indictment against Donald Trump concerning his handling of classified documents. This means the shock ruling would be reviewed by judges from the 11th US Circuit Court of Appeals based in Atlanta. Cannon in her ruling on Monday had said that Smith’s appointment as special counsel was unconstitutional, warranting the dismissal of the case against Trump. Her decision was at odds with the rulings of judges across the country that rejected attacks on the legality of special counsel appointments. Absent a move to speed the appeal in the Trump documents case, it will likely take several months for the appeal to play out in the Atlanta-based appeals court.

That means Trump, his co-defendants and potential witnesses against them are no longer barred from discussing the case among each other. The FBI said Sunday that the shooter at Trump’s rally in Pennsylvania acted alone and that it is still actively investigating the shooter’s background – including working to gain access to his phone. “We are working to get access to the phone,” Kevin Rojek, special agent in charge of the FBI’s Pittsburgh field office, said Sunday. Rojek confirmed the gun used in the shooting was an AR-style rifle that was purchased legally. Two Democratic Senate committee leaders asked the Justice Department to appoint a special counsel to investigate whether Supreme Court Justice Clarence Thomas broke federal tax and ethics laws, the senators said Tuesday. "The evidence assembled thus far plainly suggests that Justice Thomas has committed numerous willful violations of federal ethics and false-statement laws," the senators alleged in the letter. It also "raises significant questions about whether he and his wealthy benefactors have complied with their federal tax obligations," Wyden and Whitehouse wrote. Charges against Trump not likely affectedThe people who pushed their way into the Capitol aren’t the only ones who are facing the obstruction charge. CNN —Former Honduran President Juan Orlando Hernandez has been sentenced to 45 years in prison and given an $8 million fine by a US judge for drug trafficking offenses. He has previously denied the charges against him and at his sentencing on Wednesday insisted that he is innocent and was “wrongly and unjustly accused.”In March, a jury in New York found Hernandez guilty on three drug trafficking charges after a two-week trial in Manhattan federal court. He was extradited from Honduras after the US Department of Justice filed three drug-trafficking and firearms related charges against him in 2022. In exchange, prosecutors said, Hernández received millions of dollars in bribes that he used to fuel his rise in Honduran politics. Hernández was president of Honduras from 2014 until 2022.

Trump is arguing that Jack Smith – who has brought charges against Trump in Florida and Washington, DC – was unlawfully appointed as special counsel. At the center of Trump’s argument is the claim that the Attorney General Merrick Garland does not have legal authority to appoint someone as special counsel who hasn’t confirmed by the Senate. The Justice Department says the attorney general has ample authority to appoint “inferior officers,” which would include special counsels. “This Court should hold as a matter of law that the Attorney General lawfully appointed the Special Counsel,” the attorneys wrote. Almost inverse from Trump, Biden argued that special counsel David Weiss was unlawfully appointed because he was already in the federal government and therefore not fully independent.

CNN —Donald Trump’s attorneys on Friday ridiculed special counsel Jack Smith’s gag order request in the former president’s classified documents case in Florida, calling it an unconstitutional attack on the 2024 Republican candidate and a ploy to help Joe Biden keep the presidency. “In Jack Smith’s most recent shocking display of overreach and disregard for the Constitution, the Special Counsel’s Office asks the Court to enter an unconstitutional gag order as one of the release conditions on the leading candidate in the 2024 presidential election,” Trump’s attorneys wrote in a new filing, repeating their previous arguments against gag orders. The former president was in New York at the time. Prosecutors’ original ask for a gag order was thrown out by Federal Judge Aileen Cannon, who determined that they had not fully conferred with Trump’s attorneys before filing the request. Trump’s false claims “invite” threats and harassment against law enforcement agents involved in the case, prosecutors wrote, similar to those “that have occurred when other participants in legal proceedings against Trump have been targeted by his invective.”

In a letter to House Speaker Mike Johnson, a Justice Department official cited the department's longstanding policy not to prosecute for contempt of Congress officials who don't comply with subpoenas because of a president's claim of executive privilege. Garland is the third attorney general to be held in contempt of Congress. He has defended the Justice Department, saying officials have gone to extraordinary lengths to provide information to the committees about special counsel Robert Hur's classified documents investigation, including a transcript of Biden's interview with him.

WASHINGTON — The Republican-controlled House on Wednesday narrowly voted to hold Attorney General Merrick Garland in contempt of Congress, a major escalation in the GOP's war against a justice system the party has portrayed as unfairly targeting Donald Trump. At issue was Garland's failure to hand over audio of special counsel Robert Hur's interview with President Joe Biden about his handling of classified documents. It's also unheard of for Justice Department prosecutors to go after the head of their agency over a contempt issue. Last month, both the House Judiciary and Oversight committees approved a report recommending that the House hold Garland in contempt for defying congressional subpoenas pertaining to the audio recording. Unable to come up with any wrongdoing by the president, they have now trained their sights on the attorney general," Nadler said.
