Persistent inflationary pressures have led to depressed levels of consumer spending all year, according to Bank of America. Consumers are still spending — in fact, they're spending more than they are earning — as employment levels and hourly wage growth remain fairly strong . Some analysts see an opportunity to pick up shares of battered-down retail stocks. According to Barclay's Yih, spending levels "almost have to be worse" next year. LPL's Roach similarly expects consumers spending to hit a roadblock in the coming months.

"We're disappointed, of course," Anthony Caso, a lawyer for Eastman, said of the court's decision not to hear the appeal. In decisions in 2022, U.S. District Court Judge David Carter in Santa Ana ordered certain emails to be turned over, including those related to court efforts by Trump and Eastman to delay congressional certification of Biden's victory. Carter ruled that Trump and Eastman had "more likely than not" committed a crime in trying to obstruct Congress. Eastman has sought to erase the judge's determination that the "crime-fraud" exception applied to some of the emails. Trump is the frontrunner for the Republican nomination to face Biden in the 2024 election.

Washington CNN —The Supreme Court said Monday that it will not take up a longshot challenge to Donald Trump’s eligibility to run for president because of his alleged role in the January 6, 2021, attack on the US Capitol. This case is separate from the other 14th Amendment challenges against Trump in Minnesota and Colorado, which are scheduled for trials later this year. “The framers of Section 3 of the 14th Amendment specifically designed it to remove overwhelming popular pro-insurrectionists from the ballot. At least two other similar challenges to Trump’s eligibility have been brought in recent weeks by groups seeking to keep the former president from returning to the Oval Office. Trump denies wrongdoing and has vowed to fight to remain on the presidential ballot.

DocGo was already under scrutiny when its no-bid contract with New York City came to light, prompting questions about what services the company was providing — as well as the quality of those services. Neither the company nor city officials were willing to voluntarily disclose details of the contract. Earlier this month, New York City Comptroller Brad Lander said there were “numerous outstanding issues and concerns” that prompted him to reject the city's $432 million no-bid emergency contract with DocGo. DocGo began as a medical services company, describing itself on its website as delivering “high-quality medical care outside traditional hospital or clinic settings across our service lines: Mobile Health Care, Medical Transportation and Remote Patient Monitoring/Chronic Disease Management. The company has been trying to land a lucrative contract, valued in the billions of dollars, with the federal government

Twelve high-yield issuers have raised $9.6 billion this week, making it the busiest week since November 2021, according to JPMorgan. This stands in stark contrast to the same period in 2022, when only 25% of a total $81 billion was secured debt, according to Informa Global Markets data. According to rating agency Fitch, junk debt defaults are expected to reach 4.5% of all outstanding U.S. junk debt by the end of 2023, up from 2.8% in July. The extra level of protection and high investment returns are ensuring strong demand for new junk debt. The loans are part of a $9.4 billion debt package - the largest since last year's buyout of Twitter by billionaire Elon Musk.

New York City has put DocGo in charge of key tasks, including helping to manage its main intake center at a Manhattan hotel. The police in the Buffalo suburb of Cheektowaga, where some migrants relocated from New York City are staying, say they are investigating the interactions DocGo had with the victims and suspects in two alleged sexual assaults before the police arrived. In one instance, a migrant was accused of assaulting another migrant staying at one of the hotel shelters DocGo operates, and in another instance a migrant was accused of assaulting a DocGo subcontractor. DocGo’s chief executive, Anthony Capone, said the company was “devastated by what happened” and was fully cooperating with law enforcement. After the assault allegations, New York City temporarily halted migrant relocations to Buffalo, and Ms. Hochul has sent National Guard troops to the hotels where they are staying.

The Hong Kong government was seeking a court injunction against the publication or distribution of “Glory to Hong Kong” with “seditious intention” on the internet or in other media. But Judge Anthony Chan denied the request, ruling that what the government wanted was too broad and effectively targeted everyone in Hong Kong. He wrote that the injunction could have had a “chilling effect” on free speech in Hong Kong. Numerous people in Hong Kong have been arrested or charged for playing the song in public under an expansive national security law that Beijing imposed on the territory in 2020. The injunction case has been closely watched in the Hong Kong business and tech communities.

As relationship transgressions go, “phubbing” — a portmanteau of “phone” and “snubbing” — is, on the surface, fairly benign. A recent study linked higher levels of phubbing to marital dissatisfaction, and a 2022 study found it can lead to feelings of distrust and ostracism. One study found that those who phub a lot are more likely to be phubbed themselves, creating a kind of ripple effect. He said the issue comes up among the couples he works with on an almost weekly basis. Fortunately for most couples, it’s a relatively easy issue to fix, he said.

A Hong Kong judge said on Friday that he would rule next week on a government request to ban a popular pro-democracy song from the internet, in a case that could force Google and other companies to restrict access to the song. At issue is “Glory to Hong Kong,” which was the anthem of the 2019 protests that ended with Beijing taking tighter control over Hong Kong. The authorities argue that the song is an insult to China’s national anthem and could make people believe that Hong Kong is an independent nation. The government is seeking an injunction to prohibit the publication or distribution online of “Glory to Hong Kong.” Anyone violating the injunction could face prison for contempt of court. The case is being closely watched by tech companies, because it has raised the specter of more government control of online speech in Hong Kong.

CNN —Probes into Gilgo Beach serial killings suspect Rex Heuermann now reach across the country as investigators are examining his connections to Las Vegas and South Carolina, where the suspect has owned property. The couple has since sold the first property, the records show, and it is unclear whether they still own the second. Heuermann has pleaded not guilty in the murders of Melissa Barthelemy, Megan Waterman and Amber Costello. FBI investigators were also seen talking to neighbors in the rural South Carolina neighborhood on Tuesday. Prosecutors have detailed a trove of evidence used to connect Heuermann to at least three of the Gilgo Four killings, including credit card bills, cell phone data and DNA evidence.

Authorities have said the suspect, Rex Heuermann, obsessively followed the case of the “Gilgo Four,” a group of four women whose remains were uncovered more than a decade ago near Long Island’s Gilgo Beach. The source said one such object includes a doll found in the house but not in the children’s rooms. Though prosecutors have said Heuermann is the prime suspect in the fourth killing of Brainard-Barnes, he has yet to be charged in the case. Among the hundreds of firearms found hidden in Heuermann’s home were pistols, revolvers and semi-automatic rifles, a source said. Three of the women – Costello, Waterman and Brainard-Barnes – worked as escorts and Barthelemy was a sex worker, according to police.
