CNN —Months before Donald Trump was indicted for mishandling classified documents, a federal judge said that investigators had “strong evidence” that the former president “intended” to hide classified documents at his Mar-a-Lago resort, according to newly released court documents. Judge Beryl Howell cited, among other things, the discovery of additional classified documents found at Mar-a-Lago months after the FBI’s search of the property in the summer of 2022. The ruling was among hundreds of pages of previously sealed filings that were publicly docketed Tuesday in the criminal classified documents case against Trump. Nauta has been charged alongside Trump and Mar-a-Lago property manager Carlos De Oliveira in the case, facing charges of mishandling sensitive or classified materials and obstruction. The task before Judge Aileen Cannon, who is presiding over the classified documents case of Donald Trump, is not easy. She must protect Mr. Trump’s constitutional rights while also ensuring the prompt and fair administration of justice. Still, it is inexcusable that she is utterly failing to keep the case moving along in a fair but timely manner. And unfortunately, there isn’t much that the special counsel in the case, Jack Smith, can do about it. The volume of classified records subject to discovery is not outside the norm, and if the defendant were not Donald Trump, this would be a relatively routine Espionage Act prosecution for unlawful retention of classified records.

If she does not course-correct, she’s headed for another shellacking by the circuit – and possible removal from the case. That statute outlines the parameters between a president’s official and personal records, and sets up processes for how official documents are preserved. If this were true, the mere fact that Trump took the documents with him from the White House would inherently turn them into personal records. In an unusual order last month, Cannon asked attorneys on the classified documents case to submit briefs on potential jury instructions defining terms of the Espionage Act, under which Trump is charged over mishandling 32 classified records.
