U.S. District Judge Nina Morrison in Brooklyn on Wednesday issued a temporary restraining order against Rare Breed Triggers LLC and Rare Breed Firearms LLC, and their owners Lawrence DeMonico and Kevin Maxwell. The department said this meant the devices qualified as machine guns under federal law, and said the devices did not qualify for limited exceptions permitting their sale. Rare Breed operates in Fargo, North Dakota, and, according to court papers, Maxwell is also its general counsel. AR-15 style rifles have been used in many recent mass shootings. Attorney General Merrick Garland said the Justice Department will do "everything in its power to protect the American people from gun violence and to hold accountable those that flood our communities with illegal guns."
The U.S. Justice Department announced on Friday a new rule targeting pistol attachments known as "stabilizing braces," implementing a key move in the Biden administration's efforts to beef up gun control regulations. A stabilizing brace is an attachment to a pistol that functionally turns it into a short-barreled rifle, similar to a sawed-off shotgun. The new rule clarifies that pistols modified by a stabilizing brace are subject to those additional requirements, department officials said. The new rule gives owners, manufacturers and distributors 120 days to report their stabilizing braces to the ATF tax-free. They may also remove the stabilizing brace or turn in any pistol modified by a stabilizing brace to the ATF.

Jan 2 (Reuters) - India has raised windfall tax on petroleum, crude oil and aviation turbine fuel, according to a government order dated Jan. 2. It raised windfall tax on crude oil to 2,100 rupees ($25.38) per tonne from 1,700 rupees ($20.55), effective on Tuesday, the order said. The federal government also raised export tax on diesel to 7.5 rupees per litre from 5 rupees, while raising the windfall tax on ATF to 4.5 rupees per litre from 1.5 rupees, the document showed. India, the world's largest consumer and importer of oil, has been buying Russian crude barrels at well below a $60 price cap agreed by the West. The country in July imposed the windfall tax on crude oil producers and levies on exports of gasoline, diesel and aviation fuel after private refiners sought overseas markets to gain from robust refining margins, instead of selling at lower-than-market rates in the country.

CNN —The US Food and Drug Administration is falling down on the job of policing online tobacco retailers, according to a highly critical new report from the US Department of Health and Human Services’ Office of Inspector General. “It is unclear to what extent FDA conducted additional oversight of these online tobacco retailers at later dates and found subsequent violations that could result in FDA taking enforcement actions,” the report says. While it can be difficult to police online retailers due to the sheer volume and the internet’s “wild West” nature, as one FDA official described it in the report, it says the FDA could do better by collaborating more closely with ATF on the oversight of these online retailers. The report recommends that the FDA finish making rules about online sales, as it was supposed to do years ago, and collect data about its oversight of online retailers. What stood out to Sward in the report was the FDA’s lack of follow-up beyond warning letters to online retailers.
WASHINGTON, Nov 14 (Reuters) - The U.S. Supreme Court on Monday turned away another challenge to a federal ban imposed under former President Donald Trump on devices called "bump stocks" that enable a semi-automatic weapon to fire like a machine gun. The Supreme Court in 2019 declined to block the ban from going into effect. The justices last month rejected appeals by a Utah gun lobbyist and firearms rights groups of lower court rulings upholding the ban as a reasonable interpretation of a federal law prohibiting machine gun possession. Bump stocks use a gun's recoil to bump its trigger, enabling a semiautomatic weapon to fire hundreds of rounds per minute to let it shoot like a machine gun. Two sets of plaintiffs filed lawsuits seeking compensation for having to destroy or surrender their bump stocks in the Court of Federal Claims, which hears monetary claims against the U.S. government.
An Ohio man who's an extremist "Boogaloo Boi" has been arrested after allegedly threatening to kill federal agents and boasting online about his weapons stash, including a grenade launcher, the FBI announced. The complaint says that since at least early 2021, McKillips had been posting messages insinuating or explicitly threatening to harm the government or federal agents. McKillips was arrested on criminal complaint charges of unlawful possession of a machine gun and interstate communication of threats, the FBI said. That profile posted a photo of an AR-15 style rifle fitted with a grenade launcher on Jan. 14, 2021, the complaint said. On July 6, 2021, a confidential source reported that McKillips had posted recordings in a Signal chat room talking about burning down federal buildings and shooting federal agents.
A manhunt is underway for a suspect who shot two police officers at close range and left them hospitalized in Newark, New Jersey, on Tuesday, officials said. Police are searching for Kendall Howard, 30, describing him as “armed and dangerous” in connection with the Tuesday shooting. A Florida man has been charged with murder in connection with the death of his missing ex-wife, after human remains were found in a burn pile on his property, according to court documents. Ian Christopher Baunach, 43, was charged Monday in Hendry County, Florida, in connection with the death of Katie Samantha Baunach, who was last seen Sept. 29, the Hendry County Sheriff's Office said. Katie Baunach. After failing to make contact with Ian Baunach, officers later returned and found her car had been moved from the driveway onto the street. He did, however, admit "to being angry that Katie Baunach filed for and received a domestic violence injunction against him,” the complaint said.
One person died following a report of an active shooter inside an Arkansas hospital Wednesday morning, authorities said. CHI St. Vincent Hospital in Sherwood, Ark.
