Former President Donald Trump and other defendants accused of illegally trying to interfere in the 2020 election in Georgia on Friday submitted a formal application to appeal a judge's ruling allowing Fulton County District Attorney Fani Willis to remain on the case. McAfee's ruling said Willis could continue her prosecution if Wade left the case, and the special prosecutor resigned hours later. Lawyers for Trump and other defendants then asked McAfee to allow them to appeal his ruling to the Georgia Court of Appeals, and he granted that request. CNN —Former President Donald Trump and several of his co-defendants in the Georgia election subversion case are appealing a judge’s ruling that let Fulton County District Attorney Fani Willis remain on the election subversion case. The defense attorneys on Friday asked the Georgia Court of Appeals to overturn Judge Scott McAfee’s initial decision that allowed Willis and her office continue to pursue the case but only if Nathan Wade, the special prosecutor with whom she had a romantic relationship, resigned. While Wade has since left the case, defense attorneys still want the appellate court to disqualify the entire Fulton County DA’s office. “DA Willis has covered herself and her office in scandal and disrepute, as she has squandered her credibility and repeatedly and flagrantly violated the heightened ethical standards demanded of her position,” the appeal states. However, the judge added, “Georgia law does not permit the finding of an actual conflict for simply making bad choices – even repeatedly.”The district attorney’s office declined to comment.

ATLANTA (AP) — The charges against former President Donald Trump in the Georgia election interference case seek to criminalize political speech and advocacy conduct that the First Amendment protects, his lawyers argued in a court filing challenging the indictment. Fulton County Superior Court Judge Scott McAfee plans to hear arguments on that filing and on two pretrial motions filed by former Georgia Republican Party chair David Shafer during a hearing set for Thursday. Lawyers for Shafer argue that he acted legally when he and other state Republicans signed a certificate asserting that Trump won the 2020 presidential election in Georgia and declaring themselves the state’s “duly elected and qualified” electors. McAfee is forging ahead with the case even as Trump and other defendants have said they plan to seek a ruling from the Georgia Court of Appeals to disqualify District Attorney Fani Willis. The charges against him include impersonating a public officer, forgery, false statements and writings, and attempting to file false documents.

In a case that has prompted outrage from voting-rights activists for years, a Texas appeals court reversed itself on Thursday and acquitted a woman who had been sentenced to five years in prison for illegally casting a provisional ballot in the 2016 election. The decision came two years after the Texas Court of Criminal Appeals, the state’s highest criminal court, ruled that the lower appeals court, the Second Court of Criminal Appeals, had misconstrued the illegal voting statute under which Crystal Mason was found guilty in 2018. Ms. Mason, 49, of Fort Worth, had been charged with illegally voting in the 2016 general election by casting a provisional ballot while she was a felon on probation. Ms. Mason, who has remained free on bond, appealed her conviction. In 2020, the Second Court of Appeals ruled that whether or not she knew she was ineligible to vote was “irrelevant to the prosecution.”

Tom Hayes, the first trader jailed worldwide for interest rate rigging, lost his appeal against his conviction in a London court on Wednesday. Hayes, a former star Citigroup and UBS trader, was convicted in 2015 of conspiracy to defraud by manipulating Libor, a benchmark rate once used to price trillions of financial products globally. His appeal against his conviction was heard alongside that of Carlo Palombo, a former Barclays trader convicted in 2019 of skewing Libor's euro equivalent, Euribor. (AP) — A requirement for Pennsylvania voters to put accurate handwritten dates on the outside envelopes of their mail-in ballots does not run afoul of a civil rights law, a federal appeals court panel said Wednesday, overturning a lower court ruling. A divided 3rd U.S. Circuit Court of Appeals ruled to uphold enforcement of the required date on return envelopes, a technical mandate that caused thousands of votes to be declared invalid in the 2022 election. A lower court judge had ruled in November that even without the proper dates, mail-in ballots should be counted if they are received in time. The city of Berkeley, Calif., has agreed to repeal a landmark climate rule that would have banned natural gas hookups in new homes, throwing into question the fate of dozens of similar restrictions on gas in cities across the country. LONDON (AP) — A British financial trader, who has been described as the ringleader in the manipulation of a key interest rate before and after the global financial crisis, lost his appeal Wednesday to have his conviction quashed. At a three-day hearing in London earlier this month, the men’s lawyers argued that their convictions were “unsafe” and should be quashed. An appeal to the Supreme Court has to be made within 14 days. The scandal emerged in 2012 when some banks were accused of submitting fake numbers on purpose to have the LIBOR set at a rate that better suited them. LIBOR has been phased out in recent years, partly because it was seen by many as worsening the 2008 financial crisis.

A federal appeals court late Tuesday ruled against Texas in its bitter clash with the federal government, deciding that a law allowing the state to arrest and deport migrants could not be implemented while the courts wrestled with the question of whether it is legal. A three-judge panel of the U.S. Court of Appeals for the Fifth Circuit, which has a reputation for conservative rulings, sided in its 2-to-1 decision with lawyers for the Biden administration who have argued that the law violates the U.S. Constitution and decades of legal precedent. The panel’s majority opinion left in place an injunction imposed last month by a lower court in Austin, which found that the federal government was likely to succeed in its arguments against the law. CNN —A New York judge has imposed a gag order on Donald Trump, limiting the former president from making statements about potential witnesses in the criminal trial relating to hush money payments scheduled to begin next month. The order does not prevent Trump from talking about New York District Attorney Alvin Bragg, who is a public figure, or Merchan himself. Trump criticized Merchan, his daughter and one of Bragg’s prosecutors in the hours before Merchan issued his order. The district attorney’s office had requested the gag order last month to remain in place for the duration of the trial. A large suburban Philadelphia county has joined dozens of other local governments around the country in suing the oil industry, asserting that major oil producers systematically deceived the public about their role in accelerating global warming. As the week began, it looked as though Donald Trump would finally face consequences — or at least, a consequence — for his actions. Last month, a New York state trial court found the former president liable for inflating his net worth and misleading banks and insurers in order to receive favorable loans for his various businesses and commercial enterprises. The judge, Arthur F. Engoron, imposed a penalty of $454 million, to be paid into the state’s general fund. Letitia James, New York’s attorney general, gave Trump a 30-day grace period to secure bond as he pursued appeal of the judgment. And even if he could, Trump would need to pledge at least as much in collateral to the company.
