WASHINGTON — Divided House Republicans stumbled last week in their effort to pass Speaker Mike Johnson’s bill to fund the government. “A government shutdown is always a bad idea, at any time,” Senate Minority Leader Mitch McConnell, R-Ky., told reporters. The speaker’s initial strategy had called for a six-month continuing resolution (CR) tied to the SAVE Act, legislation backed by Republican presidential nominee Donald Trump requiring proof of citizenship to vote. It’s unclear whether Johnson this week will try to tweak the SAVE Act approach or try something entirely different. Republicans see the SAVE Act as a mechanism to try to force politically vulnerable Democrats into a difficult position.

Eight states will have constitutional amendments backed by Republican lawmakers on the November ballot designed to make clear that only American citizens can vote in elections in those states. But it’s already illegal for noncitizens to vote in elections in those states and at the federal level, and it rarely happens. Trump, the GOP presidential nominee, has long made false claims that noncitizens are voting in elections and that Democrats have helped them enter the country to cast those ballots. No state constitution in the U.S. allows noncitizens to vote. While Americans for Citizen Voting said it has no formal or informal relationship with the Trump campaign or the RNC, its chairman, Paul Jacob, said at a recent press conference that he hopes the ballot measures will help improve voter turnout.

Washington CNN —A six-month House GOP government funding plan cleared a key hurdle on Tuesday, but remains at risk of failing as Speaker Mike Johnson attempts to navigate a shutdown fight with his narrow majority. The House voted 209-206 to approve a rule to govern debate for the funding plan, which includes a controversial measure that targets noncitizen voting. But at least six House Republicans have come out against the funding bill, which is enough to sink it in the House amid Democratic opposition, and the bill is considered dead-on-arrival in the Democratic-controlled Senate. The six-month funding plan from House Republicans would extend government funding until March 2025. Many House conservatives are also generally opposed to short-term funding bills, arguing instead in favor of spending cuts.

It is already a crime to register or vote as a noncitizen in all state and federal elections, though Washington, D.C., and a handful of municipalities in California, Maryland and Vermont allow noncitizen voting in local elections. Republican attorneys have filed an assortment of lawsuits across the county that vary in both what types of election rules they target and how seriously election law experts believe the case should be taken. The legal fight against mail voting has taken GOP lawyers to states beyond the typical presidential battlegrounds. In addition to the case targeting Mississippi’s post-election day mail ballot receipt deadline, Republicans filed a lawsuit challenging the major expansion of mail voting enacted by New York lawmakers last year. To arrive at the claim that the states’ voter rolls are bloated, Republicans are using a formula that has previously been rebuked in federal court.

CNN —The legal battle over a controversial Texas immigration law could eventually give the Supreme Court a chance to revisit a historic ruling that largely struck down Arizona’s “show me your papers” law and reaffirmed the federal government’s “broad, undoubted power” over immigration. “It would have been incredibly difficult for the 5th Circuit to let this law stand under existing Supreme Court precedent,” she said. ‘Show me your papers’ lawThe Arizona law is a high-profile example of what happens when states attempt to take immigration policy into their own hands. Jan Brewer signed the Support Our Law Enforcement and Safe Neighborhoods Act, known as SB 1070, into law in 2010. A member of Canada’s Parliament testified on Tuesday that high school students from China were transported by bus to vote for him in a party election that is at the center of a federal inquiry into interference in Canadian elections by China and other foreign countries. Testifying during a public hearing in Ottawa, the Parliament member, Han Dong, a Chinese-Canadian politician formerly from Prime Minister Justin Trudeau’s Liberal Party, said that he had met and sought the support of the students from a private high school in 2019, but that he did not know who had chartered or paid for the bus on the day of the election. A Canadian intelligence report disclosed during the hearing said there were indications that a “known proxy agent” of the Chinese Consulate had provided the students “with falsified documents to allow them to vote” even though they did not reside in Mr. Dong’s electoral district. Noncitizens over the age of 14 can register and vote in party elections as long as they show proof they live in an electoral district.

CNN —Republican lawmakers and activists in several presidential battlegrounds are pushing ballot measures to change how elections are run in their states. And in Arizona, a so-called ballot referral moving through the Republican-controlled Legislature would upend the state’s widely used, no-excuse vote-by-mail system. Constitutional amendments in Wisconsin and ballot referenda in Arizona are not subject to the approval of governors in those states. “Wisconsin’s status as a swing state makes election integrity measures important locally, nationally and internationally.”If approved, the Wisconsin measures would be in effect for this year’s elections. Katie Hobbs has vetoed a raft of legislation – ranging from efforts to get rid of red-light cameras to prohibiting ranked-choice voting in the state’s elections.
