CNN —A New Mexico judge on Thursday is set to consider the “Rust” movie armorer’s motion to be released from prison, months after similar charges against actor Alec Baldwin were dismissed due to prosecutorial misconduct. At her trial, prosecutors argued she repeatedly violated safety protocol and was negligent in performing her duties, allowing six live rounds on to the set. Her defense attorney argued she was scapegoated for the safety failures of film set management and other crew members. But just days after his trial began, Judge Mary Marlowe Sommer threw out the charges and ruled prosecutors did not properly turn over evidence to the defense. The judge called the withholding of evidence “intentional and deliberate” and dismissed the case with prejudice, meaning it cannot be brought again.

In the seven most competitive Senate races, Democratic campaigns and outside groups launched 33 TV ads on abortion just in the last week, according to the ad-tracking firm AdImpact. Just one Republican ad, a Spanish-language spot from an outside group targeting Democratic Sen. Jacky Rosen of Nevada, mentioned abortion. Some Republicans warned that the party's failure to counter abortion attacks cost them crucial seats that year. In Arizona, Republican Senate candidate Kari Lake has softened her position on abortion rights. That’s why Maricopa County has spent over $864,000 in federal funds and more than $3 million in county funds to bolster its election security and processes over the past four years. Officials readily shared their worries with CNN, citing death threats, harassment, baseless lawsuits, onerous public-records requests and various security threats spurred by false claims about voter fraud. Amid these challenges, budgets for election security have been squeezed in several ways. Thousands of election workers across the country have reported receiving harassing, offensive or hostile communications, including since the 2022 midterms, according to the Department of Justice’s Election Threats Task Force. As recently as Tuesday, Trump threatened to prosecute and imprison election officials if he wins in November, as he cast doubt on the integrity of the upcoming election.

Two special prosecutors said Monday they will file a criminal obstruction of justice charge against a former Kansas police chief who directed warrant searches of a publisher and his newsroom over its retrieval of public information. As of Monday, prosecutors hadn't filed any criminal charges against former Marion Police Chief Gideon Cody. It was not immediately clear if they would be seeking a felony or misdemeanor charge against Cody. The special prosecutors are working with the Colorado Bureau of Investigation, which stepped in at the request of the Kansas Bureau of Investigation. “The findings will be incorporated into charges which will be sought in Marion County District Court,” the report said.
