The announcement is a win for South Korea and some automakers that earlier this month sought approval to use the commercial electric vehicle tax credit to boost consumer EV access. The $430 billion U.S. Inflation Reduction Act (IRA) passed in August ended $7,500 consumer tax credits for purchases of electric vehicles assembled outside North America, angering South Korea, the European Union, Japan and others. Treasury said it was using "longstanding tax principles" to determine consumer leasing could qualify for the EV tax credit. The commercial credit does not, however, have the sourcing restrictions of the consumer credit. That law lifts the 200,000-vehicle per manufacturer cap that had made Tesla (TSLA.O) and General Motors (GM.N) ineligible for EV tax credits starting Jan. 1.

CNN —The Biden administration on Tuesday finalized tougher pollution standards for heavy-duty vehicles like large trucks, delivery vans and buses starting with model year 2027. While the new rule is much tougher than current standards, environmental and public health groups have called for even more stringent standards. California’s new rule for heavy-duty vehicles, for example, is 90% stronger than current regulations. And earlier this year, state regulators in California critiqued EPA’s pollution rule for missing the bigger picture on the move to electric trucks. The agency is also expected to release new proposed light and medium-duty vehicle emissions standards for 2027 and beyond model year vehicles in the spring.

WASHINGTON — The House Jan. 6 committee met Sunday to finalize its plans to issue at least three criminal referrals for former President Donald Trump, NBC News has learned exclusively. NBC News previously reported that obstruction, conspiracy and incitement of an insurrection were among the charges the committee was considering to recommend against Trump. The criminal referrals carry no official legal weight, and it remains up to the Justice Department to decide whether or not to charge Trump and anyone else the committee might refer. The committee also plans to refer several Republican members of Congress to the House Ethics Committee for their defiance of congressional subpoenas, NBC News has learned. “None of the subpoenaed members complied,” Raskin said during Sunday’s meetings, presenting the findings of the subcommittee responsible for referrals.

Reuters first reported in July the planned loan to Ultium Cells LLC from the government's Advanced Technology Vehicles Manufacturing (ATVM) loan program. Last week, workers at the $2.3 billion Ultium plant in Ohio voted to join the UAW, a win for the union, which is seeking to organize the growing EV supply chain. GM and LG Energy are considering an Indiana site for a fourth U.S. battery plant. The Energy Department said the $3 billion would provide an estimated $40 billion in additional loan authority for a total estimated available authority under ATVM of about $55.1 billion before the Ultium loan. The ATVM loan program in July closed on a $102.1 million loan to Syrah Technologies LLC (SYR.AX) for expansion of a facility producing a key component for batteries.

A Republican-led county in Arizona that flouted a statutory deadline for election certification ended up certifying its results Thursday shortly after a judge ordered officials there to take action. Officials in Cochise County voted 2-0 to accept the results of the Nov. 8 election, enabling statewide certification to move forward Monday. Ann English, the sole Democrat on the three-member Board of Supervisors, and Vice Chair Peggy Judd, a Republican, voted to approve the election results. Hobbs lauded Pima County Superior Court Judge Casey McGinley's order compelling the county to canvass its results. Voters in Cochise County largely favored Lake, a prominent election denier who has refused to concede.

Nov 2 (Reuters) - The U.S. Securities and Exchange Commission on Wednesday proposed new rules aimed at better preparing the mutual fund industry for distressed market conditions, including a new pricing mechanism that has drawn opposition from fund managers. The market disruptions of March 2020 reinforced the fact that liquidity can deteriorate rapidly, said the SEC, which adopted the proposal in a 3-2 vote. The proposed rule would require mutual funds, and some exchange-traded funds, to ensure that at least 10% of their net assets are highly liquid. The new requirements would also demand a hard daily closing time for mutual funds, and the use of "swing pricing," which involves adjusting a fund's value in line with trading activity so redeeming investors bear the costs of exiting without diluting remaining investors. Mutual funds managed $4.1 trillion, or 63%, of assets held in 401(k) plans at the end of June, as well as $5.1 trillion, or 43%, of IRA assets, according to the Investment Company Institute.

The open enrollment period for health insurance plans under the Affordable Care Act starts on Nov. 1. Also known as Obamacare, the law helps low and middle-income Americans who do not have access to affordable health insurance coverage through an employer. U.S. House of Representatives Speaker Nancy Pelosi, who like Biden is a Democrat, said in a statement the fix will bring down healthcare costs and expand access to affordable coverage. Republicans say the remedy contradicts the text of the law and that it will significantly increase spending on Obamacare plans.

The settlement resolves a long-running whistleblower lawsuit in Boston federal court that a former employee pursued on the government's behalf. Biogen in July disclosed it reached a potential settlement, which was subject to government approval. As a reward, Bawduniak will receive $250 million of the federal government's $843.8 million share of the settlement. Another $56.2 million will be paid to 15 states, the Justice Department said.
