The heated exchange between Trump’s attorney Todd Blanche and Cohen marked the biggest blow to the prosecution’s case so far. But the DA also must prove the actual business records crime, for which Trump has been charged with 34 counts of falsifying business records in the first degree. How I see it, Cohen’s testimony only satisfied half the equation beyond a reasonable doubt. Weisselberg could be the linchpin to validate Cohen’s claims about Trump agreeing to reimburse him through Trump Organization, as a business expense. If so, there would have been no intent to falsify the business records.

US District Judge Carl Nichols, who presided over Bannon’s trial, had paused Bannon’s sentence while an appeal of his conviction played out. He has given Bannon until Thursday to respond to the DOJ’s request. Douglas H. Wigdor, an attorney who has represented eight of Weinstein’s accusers, including two of the “prior bad acts” witnesses at his New York criminal trial, criticized the ruling. Prosecutors say they’ll want to question him about what they claim is false testimony he gave on the stand at that trial last November. Trump only spoke three times during Monday’s session, acknowledging to the judge he understood his rights as a criminal defendant. Throughout the day Trump often engaged with his attorneys, whispering to them and sharing notes as they debated motions with the Manhattan District Attorney’s Office. Trump looked toward Merchan as the judge addressed the prospective jurors to explain the case and their instructions as potential jurors. Entering and exiting the courtroom, Trump had to walk right past Manhattan District Attorney Alvin Bragg, who brought this case against Trump and was seated in the fourth row behind his prosecutors. Trump will be back at the defendant’s table on Tuesday, when Merchan will continue questioning the prospective jurors who could ultimately decide whether to convict Trump in the first criminal trial of a former president.
