In an instant, the impacts of her state’s restrictive laws on abortion care became clear: Had Bell been bleeding from a car accident or a burst appendix, doctors could help her right away. But because she was having a miscarriage in a hospital in Georgia, surgery had to wait. Several others restrict it to certain points in pregnancy, including Georgia, which limits abortion to the first six weeks of pregnancy. Bell’s pregnancy was at 18 weeks — too early for her fetus to survive outside the womb but well past Georgia’s limit. Doctors told Bell she’d have to wait, unless her condition grew worse: Georgia makes people wait 24 hours before they can have an abortion except in medical emergencies.

Sen. Bernie Sanders, I-Vt., on Sunday defended keeping Justice Sonia Sotomayor on the Supreme Court, after some Democrats have reportedly considered pressuring her to step down while President Joe Biden is still in office. He added that he’s heard “a little bit” of talk from Democratic senators about asking Sotomayor, who is serving a lifetime appointment to the Supreme Court, to step aside. Sonia Sotomayor, who is 70, is serving a lifetime appointment to the Supreme Court. If Sotomayor were to die during Trump’s term, she would likely be replaced by a conservative justice, pushing the now 6-3 conservative court further to the right. She died in September 2020 and Trump, then serving his first term, appointed the conservative Justice Amy Coney Barrett to replace her, leading to the court’s current conservative makeup.

CNN —Supreme Court Justice Sonia Sotomayor has made clear she has no plans to step down, according to people close to her, despite calls from some on the left that President Joe Biden should try to name a successor before President-elect Donald Trump takes office. “She’s in great health, and the court needs her now more than ever,” said one person close to the justice. Some progressives have suggested Sotomayor, the most senior liberal on the conservative Supreme Court, should step down so that Biden could try to name a replacement in the short window before Trump takes office in January. Vermont Sen. Bernie Sanders said Sunday that he doesn’t think Sotomayor should step down from the court. In May, Sotomayor told an audience at Harvard University that she sometimes cries after the court hands down its decisions.

A firebrand legal adviser to the President-elect and a conservative lawyer under consideration for the post of Attorney General appear to be setting the stage for investigations and prosecution of Donald Trump’s legal adversaries, including Special Counsel Jack Smith and New York Attorney General Letitia James. The threats come as Trump campaign aides say that the president-elect considers his choice for attorney general to be his most important single appointment. Paoletta is among several people under consideration to run the Justice Department, people familiar with the matter tell NBC News. All of those people have claimed—without citing any specific evidence— that the federal prosecutions of Trump by Smith were politically motivated. The Supreme Court’s 6-3 decision left many questions unanswered and lower courts have not yet wrestled with them. But the Supreme Court majority ruled that a president’s power to direct the Justice Department’s investigative and prosecutorial work is within his exclusive constitutional authority. It’s not guaranteed that just because Trump has massive power he will spurn constitutional checks and balances. No other president has come into office armed with a Supreme Court ruling that grants significant immunity to presidents for official acts. Attempts to prosecute Trump’s political foes on spurious grounds, meanwhile, could theoretically see mass resignations of Justice Department staff.

NEW YORK — Rapper Tekashi 6ix9ine struck a deal to end his current jail stint, agreeing to serve a month behind bars for violating the terms of his release after a felony conviction, prosecutors said Wednesday. The deal with federal prosecutors was described in a letter partially endorsed by a Manhattan federal judge. It calls for the entertainer to be sentenced to a month in jail, followed by a month of home incarceration, a month of home detention and a month of curfew. The terms of the deal also call for Tekashi 6ix9ine to submit to supervision from the court’s Probation Department for another year. In April 2020, Tekashi 6ix9ine was freed months early from his prison sentence after complaining that his ailments made him particularly susceptible to the coronavirus, which was spreading through the nation’s jails and prisons.

Being elected president will likely result in the federal criminal cases against him being dismissed, while his state criminal cases could at the least be frozen until after he leaves office. Trump’s legal team, meanwhile, is evaluating its next steps for how to get all four criminal cases resolved, and plan to argue soon that all of the cases “must stop immediately,” according to a source directly involved in the discussions. But the balance of the evidence from the NBC News Exit Poll suggests that Trump owes his victory to more common, less polarizing factors that drive many elections year in and year out. That included a striking shift of Latino voters into the GOP column compared with 2020 — they backed Trump by 13 points more. Women broke for Harris, 54%-44%, while men favored Trump, 54%-44% — a gap in support amounting to 22 percentage points. South Dakotans voted down a ballot measure that would have put abortion rights in the state constitution, instead keeping the state’s near-total ban on abortion. Voters have overturned state abortion bans in a number of red states since the Supreme Court’s Dobbs decision, but South Dakota is an extremely conservative state. Life Defense Fund first sued Dakotans for Health in June, challenging the abortion petition signatures the organization submitted to the state. A judge dismissed the motion, which prompted Life Defense Fund to file an appeal in state Supreme Court. A state Supreme Court justice kicked it back to a lower court.

Arizona voters on Tuesday approved an amendment enshrining abortion rights in the state constitution, NBC News projects. A fundamental right to abortion is part of the Arizona Constitution once and for all. In April, the conservative-leaning Arizona Supreme Court ruled to reinstate a near-total ban on abortion from 1864. Arizona for Abortion Access, the coalition of reproductive rights organizations behind the ballot effort, had shattered the record for the number of valid signatures gathered for a ballot initiative in the state. Constitutional amendments to enshrine abortion rights were on the general election ballots in nine other states Tuesday: Colorado, Florida, Maryland, Missouri, Montana, Nebraska, Nevada, New York and South Dakota.

Since it is a state case, Trump does not have the power to pardon himself next year after he is sworn into office. Federal cases in DC and FloridaTrump’s election victory is poised to have the greatest impact on the two federal criminal cases brought against him by Smith in Washington, DC, and Florida. ProPublica reported last week that two Texas women died after they faced delays in getting miscarriage care because of the state’s abortion ban. ProPublica’s coverage in September linked two deaths to Georgia’s abortion ban. “The nature of the strict abortion ban in Texas does not allow us as medical professionals to do our jobs,” they wrote. But reproductive rights advocates said stories about the consequences of abortion bans resonate with voters in any part of the country.
