Pursuant to a 2013 Supreme Court decision, DOJ monitors only go inside polling places with the agreement of local officials, unless they have a court order. In their federal lawsuits, Missouri and Texas officials argued that their state laws did not permit federal officials to be present at polling places. Florida did not file a lawsuit, but Secretary of State Cord Byrd told the Justice Department in a letter Friday that state law does not allow DOJ officials in polling places. The DOJ was allowed to monitor polling places, he wrote, but was not allowed to send observers inside without a federal court order. Armed federal law enforcement officers are generally prohibited from entering polling places, which are secured by local law enforcement agencies.

Here's a look at some of the key counties to watch across the seven presidential battleground states, ordered by the state's final poll closing time (in Eastern Standard Time). Mitt Romney won more than 80% in Forsyth in 2012, but Trump won just two-thirds of the vote there eight years later. In 2020, Joe Biden won this county by only 4 points over Trump, while Hillary Clinton carried it by 13 points in 2016. While Trump won it by 3 points in 2016, Biden won Maricopa by 2 points four years later. And that Democratic gain helped the party flip Wisconsin in 2020, given that Biden won the state by just 20,000 votes.

The data make it clear that most provisional ballots are likely to come from voters with outstanding mail ballots, rather than voters who’ve already returned deficient mail ballots. And they also make it clear that those provisional ballots may favor Vice President Kamala Harris and the Democratic Party. Voters who have returned deficient mail ballots and have yet to fix them can vote on Election Day, typically by provisional ballot. Meanwhile, as mentioned above, an estimated 35,000 might cast provisional ballots after having not returned their mail ballots at all. There may well be future litigation revisiting, yet again, whether to count provisional ballots cast by people who previously returned deficient mail ballots.

Voting has now wrapped up in all seven swing states and most others. But no swing states have been called, and the race will hinge on their results.
