When David C. Weiss, the U.S. attorney in Delaware, asked for special counsel status, the Justice Department says Mr. Garland approved his request quickly. A widely respected federal judge before becoming attorney general, Mr. Garland has become a favorite target of House Republicans after the Justice Department launched investigations that resulted in felony charges against former President Donald J. Trump. At the heart of the issue are assurances Mr. Weiss and Mr. Garland have given to lawmakers that Mr. Weiss had ultimate authority over the Hunter Biden case and when and where to bring charges. But they have vouched generally for the statements about Mr. Weiss’ limited authority, describing a more nuanced scenario in which Mr. Weiss had sought to partner with prosecutors in Washington, D.C., and California, only to be rebuffed, causing him to try a different approach. When Mr. Weiss eventually asked for special counsel status, the Justice Department says Mr. Garland approved his request quickly.

CNN —Attorney General Merrick Garland forcefully rebuked congressional Republicans who have accused the Justice Department of political bias as he opened a contentious House Judiciary Committee hearing in Washington on Wednesday. Even with the face-saving indictment last week of Hunter Biden, everyone knows the fix is in,” House Judiciary Chairman Jim Jordan said in his opening statement. The House Judiciary Committee has also been probing allegations from an IRS whistleblower that the Justice Department investigation into Hunter Biden was politically tainted. “House Republicans will use their time today to talk about long-discredited conspiracy theories and Hunter Biden’s laptop. Several House Republicans – including McCarthy – have floated an impeachment of the attorney general, although those calls have quieted down as House Republicans have turned their impeachment lens on President Joe Biden himself.

CNN —House Republicans and Attorney General Merrick Garland clashed Wednesday at a testy hearing that offered a preview of the coming Republican impeachment inquiry into President Joe Biden focused on allegations surrounding his son, Hunter Biden. He also didn’t engage in GOP attacks against special counsel Jack Smith’s investigations into former President Donald Trump. Judiciary Chairman Jim Jordan, one of the three committee chairs spearheading the impeachment inquiry, accused the Justice Department of not prosecuting Hunter Biden over the tax years when Hunter Biden was on the board of Ukrainian energy firm Burisma. “I’m going to say again, and again, if necessary, I did not interfere with, did not investigate, did not make determinations” on the Hunter Biden case, the attorney general said. I made him special counsel,” Garland said.

The new testimony comes as House Republicans begin an impeachment inquiry into President Joe Biden and his family, potentially undercutting one element of that effort. At issue is an October 2022 meeting between prosecutors and case agents working on the Hunter Biden investigation. But the deal fell apart amid scrutiny from a judge, and Weiss subsequently requested special counsel status. Shapley, a 14-year IRS veteran who oversaw parts of the Hunter Biden probe, alleged in testimony to Congress there was political interference in the investigation. Last week, CNN and others reported on Sobocinski’s testimony, which prompted Shapley’s attorneys to dispute his recollection of the October 2022 meeting.

They are also investigating Hunter Biden for the firearm-related charges that he was indicted for this week. FBI didn't care about Giuliani's possible Kremlin ties, Buma says"Rudy Giuliani may have been compromised by individuals suspected of being involved in Russian counterintelligence influence operations," Buma told Insider. According to Buma's disclosure, an FBI Intelligence Information Report asserted that Fuks was "a co-opted asset of the RIS" or the Russian intelligence services. As Republicans plunge forward with an impeachment inquiry looking into a complex web of allegations against President Biden, his family and his administration, witnesses they have summoned for closed-door interviews in recent weeks have undercut or pushed back against some of their major claims. In testimony this month, three witnesses from the F.B.I. The emergence of fresh evidence this week undercutting Republicans’ claims against Mr. Biden is no coincidence. It suggests that, now that the G.O.P. has decided to plow ahead with a formal impeachment inquiry, the president’s allies, including Democrats on Capitol Hill who have access to the many investigative threads Republicans have pursued, have stepped up their efforts to reveal weaknesses in the case.

Trump also pointed to the lack of connection to Joe Biden in the gun charge plea agreement. Federal prosecutors investigating Hunter Biden have not indicated Joe Biden is connected over the course of their yearslong probe. Republicans have accused the Democratic president of profiting while he served as vice president from 2009 to 2017 from his son's foreign business ventures, an accusation the White House denies. CNN —Special counsel David Weiss intends to seek an indictment against President Joe Biden’s son, Hunter Biden, relating to gun charges by the end of the month, the Justice Department said Wednesday. However, after his plea deal to resolve two tax charges fell apart in court, the future of the gun deal has been in limbo. Hunter Biden’s gun-related legal troubles relate to a firearm he purchased in October 2018. In addition to the gun case, Weiss is still weighing whether to charge Hunter Biden with tax crimes. Hunter Biden’s tax-related legal jeopardy emerged after he repeatedly missed IRS deadlines to pay his taxes on time.

“I don’t believe that a vote of the House is required to open an impeachment inquiry,” GOP Florida Rep. Matt Gaetz, who supports a Biden impeachment and sits on the House Judiciary Committee, told CNN. Another factor that could complicate the fall timeline for an impeachment inquiry: Government funding expires at the end of September. Officially moving ahead with an impeachment inquiry could help keep angry conservatives off McCarthy’s back. During the call, one skeptical committee member pressed Jordan on the purpose of an impeachment inquiry, according to a source on the call. “The Republicans in Congress, though well meaning, keep talking about an Impeachment ‘Inquiry’ on Crooked Joe Biden.

In the Republican coalition, it is a moment that has culminated decades of change – and one that points to years of turbulence ahead. Overwhelming majorities of Republican voters dismiss the charges against Trump. In Gallup’s latest annual survey of trust in institutions, Republicans expressed less faith in 10 of the 16 measured. Veteran GOP pollster Whit Ayres points to another, more personal, reason so many GOP voters have discounted the charges against Trump. Trump is the Republican most effectively riding that wave now, but it seems unlikely to recede whenever he fades from the political scene.

CNN —A federal judge in Delaware dismissed two tax misdemeanor charges against Hunter Biden that were filed as part of his now-defunct plea deal, paving the way for special counsel David Weiss to potentially bring more charges in another jurisdiction as part of his continuing probe. After the plea deal collapsed earlier this month, Weiss’ prosecutors asked District Judge Maryellen Noreika to dismiss the charges in Delaware, so new charges could potentially be brought in California or Washington, DC. Hunter Biden’s lawyers agreed that the charges should be dismissed, because they were only brought in Delaware as part of the earlier plea agreement. The two charges brought in Delaware were misdemeanors, for failing to pay taxes on time in 2017 and 2018. That part of the investigation into potential violations of the Foreign Agent Registration Act, led by the FBI, has been part of the Hunter Biden probe for years.

Hunter Biden, son of U.S. President Joe Biden, arrives at federal court to plead guilty to two misdemeanor charges of willfully failing to pay income taxes in Wilmington, Delaware, U.S., July 26, 2023. Republicans pointed to the testimony as evidence that the Justice Department intervened to delay the Hunter Biden probe, even though the events took place while Republican President Donald Trump was in office. Comer said the alleged misconduct occurred under U.S. Attorney David Weiss, a Trump appointee who was named special counsel in the Hunter Biden investigation last week over the objections of many House Republicans including Comer. Hunter Biden in July pleaded not guilty to charges of failing to pay taxes on more than $1.5 million in income in 2017 and 2018 despite owing more than $100,000. In the end, both FBI and Secret Service headquarters were notified about the interview plan, the interviewers' access to Hunter Biden was blocked and the former FBI agent heard from an attorney for Hunter Biden.

Hunter Biden, son of U.S. President Joe Biden, departs federal court after a plea hearing on two misdemeanor charges of willfully failing to pay income taxes in Wilmington, Delaware, July 26, 2023. But Hunter Biden's lawyers also said in a new Delaware federal court filing that a second agreement with prosecutors that would allow him to escape conviction for a gun-related crime is "valid and binding." Lawyers for Hunter Biden told a judge that federal prosecutors on Friday decided to "renege" on a previously agreed deal in which the son of President Joe Biden would plea guilty to tax crimes in exchange for a recommended no-jail sentence. A key sticking point for the judge was the requirement that she, not the U.S. Department of Justice, be the one to decide if Hunter Biden violates the gun agreement over a two-year period. After Noreika said she would give prosecutors and defense lawyers more time to answer her questions, Hunter Biden pleaded not guilty to the tax crimes.

The Hunter Biden case has become the latest example of America’s dueling realities. You may see the Hunter Biden obsession as the latest in a line of conservative conspiracy theories, joining Barack Obama’s birthplace, John Kerry’s Vietnam War record and the suicide of Vince Foster. Today’s newsletter is for both those readers who believe the case deserves more attention and those whose instinct is to skip any article about Hunter Biden. Cashing inWhen top Democrats are asked about Hunter Biden, they tend to dismiss his problems as a private issue. “Hunter Biden is a private citizen, and this was a personal matter,” Karine Jean-Pierre, the White House press secretary, said last month when asked about federal tax and gun charges against him.

The Hunter Biden case is an unexpected career turn for David C. Weiss, a tough, workmanlike prosecutor and commercial lawyer whose stubborn competitiveness earned him a reputation as a hard man to strike out in local softball leagues. Appointed by President Donald J. Trump, the low-key U.S. attorney for Delaware was held over in his job by the Biden administration to shield the Justice Department from accusations of political meddling. Mr. Weiss grew up in the Philadelphia suburbs, attending Cheltenham High School, whose graduates include Prime Minister Benjamin Netanyahu of Israel, the Hall of Fame slugger Reggie Jackson and the conservative commentator Mark Levin. After completing law school at Widener University in Wilmington, Del., he worked two long stints as a prosecutor in the Delaware U.S. attorney’s office on an array of cases. Those included an investigation of a businessman who pleaded guilty to campaign finance violations after illegally bundling contributions for President Biden’s failed 2008 bid for the White House.
