CNN —Former Donald Trump White House adviser Peter Navarro was released from a Miami federal prison Wednesday after completing his four-month sentence for defying a subpoena from the January 6 congressional committee. Trump adviser Steve Bannon started serving his four-month sentence earlier this month at a federal prison in Connecticut. Navarro, who is in his 70s, worked as a law library clerk during his time in the prison camp, his prison consultant Sam Mangel told CNN. “It gave him a chance to write.”Mangel said Navarro was liked and respected by his fellow inmates while in the prison. While Navarro was unsuccessful in an emergency appeal to delay his prison sentence, he is now appealing his conviction on the merits.

CNN —Special counsel Jack Smith said Wednesday that he is appealing a judge’s decision to throw out the indictment against Donald Trump concerning his handling of classified documents. This means the shock ruling would be reviewed by judges from the 11th US Circuit Court of Appeals based in Atlanta. Cannon in her ruling on Monday had said that Smith’s appointment as special counsel was unconstitutional, warranting the dismissal of the case against Trump. Her decision was at odds with the rulings of judges across the country that rejected attacks on the legality of special counsel appointments. Absent a move to speed the appeal in the Trump documents case, it will likely take several months for the appeal to play out in the Atlanta-based appeals court.

Judge Aileen Cannon had been on the federal bench for little more than a year when a senior judge offered to preside over one of her first criminal trials in her isolated south Florida courthouse. “It’s very lonely,” Senior Judge Paul C. Huck told CNN of Fort Pierce, a small fishing and citrus community on the edge of the Southern District of Florida where Cannon is the only federal judge. CNN —Special counsel Jack Smith told the judge in the classified documents case in Florida that Supreme Court Justice Clarence Thomas’ criticism of his appointment should have no bearing on the criminal case against former President Donald Trump. In a brief filing Friday, Smith said that Thomas’ writing in the presidential immunity case – in a concurrence that no other justice joined – isn’t binding on US District Judge Aileen Cannon. In a filing last week, Trump’s lawyers brought to Cannon’s attention both the Supreme Court’s immunity ruling and the concurrence that Thomas wrote in that dispute. Washington CNN —Hunter Biden’s Washington, DC, law license has been suspended, according to a newly released order from a local court that pointed to his recent conviction on three gun crimes. The order was issued by Chief Judge Anna Elizabeth Blackburne-Rigsby of the DC Court of Appeals, which is the highest appellate court in DC and oversees the DC Bar. It is typical for bars in other states to reciprocate law license suspension or disbarment orders, meaning Biden’s license is also likely to soon be suspended in any other state where he is licensed. CNN —Hunter Biden is requesting a new trial in his federal gun case, with his lawyers claiming that there was a procedural issue in the timing of the early June trial that resulted in a guilty verdict against him. His lawyers claim that the trial court did not have jurisdiction over his case because of appeals that he had filed challenging his prosecution. The defense team says that the conviction must be wiped away because, even though the appeals court had rejected the appeals by the time the trial started, it had not issued what’s known as a “mandate” – the procedural maneuver that effectively notifies a lower court of ruling made by a higher court in an appeal. Biden’s lawyers are pointing to the absence of a mandate sending the case back to the trial court after the 3rd US Circuit Court of Appeals handed down rulings rejecting two of his appeals in late May. “The Third Circuit, however, did not then and has not yet issued its mandate as to the orders dismissing either appeal,” his lawyers wrote.

That sent lower courts scurrying into historical analyses to figure out if modern gun laws had some connection to the 18th Century. CNN —Former President Donald Trump has once again asked a judge to throw out the classified documents case, arguing this time that investigators destroyed exculpatory evidence by rifling through boxes for classified documents gathered in the FBI’s 2022 search of Mar-a-Lago. Special counsel Jack Smith’s team has already acknowledged in court that some of the documents may be out of order. But, according to Trump, those boxes have been tampered with because investigators failed to maintain the order of their contents. The judge has yet to decide several additional motions to dismiss the case from Trump and his two co-defendants. However, the judge gave them a small victory by removing from an indictment prosecutors’ account of Trump allegedly showing a classified map to a political adviser, as the map was not one of the documents Trump is charged with mishandling.

CNN —Judge Aileen Cannon had been on the federal bench for little more than a year when a senior judge offered to preside over one of her first criminal trials in her isolated south Florida courthouse. In her seven years as a Justice Department attorney, Cannon participated on the trial teams of just four criminal cases. Still, Cannon has asked questions in the Trump case that appear out of left field. Her orientation toward such legal rabbit holes is not distinct to the Trump case, veterans of her courtroom say. Ultimately, nearly every attorney CNN spoke to said that Cannon, despite the criticism, is unwavering in her beliefs about how each case in her courtroom should proceed.

CNN —A federal judge on Thursday ordered Steve Bannon to report to prison by July 1, giving the former Donald Trump adviser a short window to get a higher court’s intervention. The federal judge presiding over the case, Carl Nichols, had initially paused the sentence while Bannon appealed the conviction. Last month, however, a DC Circuit Court of Appeals panel unanimously rejected several challenges Bannon made to the case, and prosecutors immediately asked Nichols to send Bannon to prison to begin serving his sentence. “We’re going to win at the Supreme Court,” he added. Navarro is currently serving a four-month prison sentence for his 2023 conviction.
