“The Supreme Court has a limited role to play death penalty cases,” said Paul Cassell, a University of Utah law professor who is representing a victim’s family in another death penalty case before the high court this year. Another involves an Alabama man who claims he is intellectually disabled and therefore ineligible for execution under Supreme Court precedent. The Supreme Court’s approach to death penalty appeals is “to correct severe misapplications of constitutional law by America’s state court systems,” said Seth Kretzer, a Texas attorney who has represented death row inmates at the Supreme Court. Alabama is appealing that decision to the Supreme Court and has been waiting more than year for an answer. In Oklahoma, Brenda Andrew faces the death penalty for the 2001 shooting death of her estranged husband.

CNN —Special counsel David Weiss’ office spent a total of $3.4 million over the past six months, a dramatic increase as it took Hunter Biden to trial in Delaware on gun-related charges and secured a conviction of the president’s son. Spending by two other Justice Department-appointed special counsels, Jack Smith and Robert Hur, decreased slightly compared with the six months prior. The disclosures come as courts have upped their scrutiny of special counsel office operations. Hunter Biden and another defendant in a separate criminal case have so far been unsuccessful in attempting to challenge special counsel Weiss’ authority. Challengers including Trump have argued that shouldn’t be allowed because Congress didn’t specifically sign off on the special counsel offices.

CNN —A federal judge will consider how to proceed with special counsel Jack Smith’s election interference case against Donald Trump during a hearing later this month, according to a brief order Saturday. The judge overseeing the case, Tanya Chutkan, scheduled a hearing for August 16 to consider how the case should move forward. It will be the first time the case is back in court since the Supreme Court granted Trump sweeping immunity for official acts as president – a ruling that may gut Smith’s prosecution. Chutkan also asked both prosecutors and defense attorneys to propose a new schedule for the case going forward by August 9. As part of the order Saturday, Chutkan also denied one of the former presidents’ motions to toss the case.

The case returns to Judge Tanya Chutkan one month after the Supreme Court issued a game-changing ruling on presidential power. But the Supreme Court interceded earlier this year and put the case on pause to consider Trump’s claims of presidential immunity. Attorneys working on the case believe that Chutkan will move quickly with the case back in her jurisdiction, according to sources familiar with their thinking. Any move she makes will be under extreme scrutiny, given that it’s the only remining federal case against Trump after the Florida federal judge overseeing his classified documents case, Aileen Cannon, dismissed those criminal charges against Trump and his two co-defendants. Cannon appeared to hold hearings on nearly every motion in the Trump case before her, but Chutkan often rules without hearing from the parties in person.

But US consumers aren’t only taking a financial hit from this summer’s extreme heat by way of their electricity bills. Shoppers could soon have to pay much higher prices for fruit and vegetables as farmers shoulder higher growing costs from the heat, a reversal of a trend seen over the past year with the cost of fruits and vegetables dropping by 1%, according to June Consumer Price Index data. For the rest of this summer, consumers aren’t likely to see markedly higher prices for seasonal fruits like blueberries because contracts with distributors and retailers tend to be worked out in advance, he said. Climate change, he said, is causing his business to suffer financially with reduced crop yields. However, the steep costs to make that switch could also contribute to higher prices consumers pay for produce.

CNN —Special counsel Jack Smith said Wednesday that he is appealing a judge’s decision to throw out the indictment against Donald Trump concerning his handling of classified documents. This means the shock ruling would be reviewed by judges from the 11th US Circuit Court of Appeals based in Atlanta. Cannon in her ruling on Monday had said that Smith’s appointment as special counsel was unconstitutional, warranting the dismissal of the case against Trump. Her decision was at odds with the rulings of judges across the country that rejected attacks on the legality of special counsel appointments. Absent a move to speed the appeal in the Trump documents case, it will likely take several months for the appeal to play out in the Atlanta-based appeals court.
