This afternoon’s New York Times/Siena College poll doesn’t look much like other polls. It finds Donald J. Trump ahead by six percentage points among registered voters and three points among likely voters nationally. You have to go back to a CNN/SSRS poll in April to find something showing him ahead by six points with registered voters. (A Quinnipiac poll today found Trump up by four among registered voters.) When a poll is considerably different from others, it’s often referred to as an outlier — as it falls outside the range of the other data.

In that initiative, federal agents and law enforcement officers used military techniques such as sweeps, raids and surveillance checkpoints — as well as a blunt form of racial profiling — to round up undocumented workers and load them onto buses and boats. As many as 1.3 million people were expelled, mostly Mexican and Mexican American workers, some of whom were U.S. citizens. Critical to the initiative — named Operation Wetback, for the racial slur — was intense anti-immigrant sentiment. Officials at the time used that sentiment to justify family separations and overcrowded and unsanitary detention conditions — practices that the Trump administration would deploy decades later in its own immigration enforcement. But recent polling shows that Mr. Trump’s position on immigration appears to be resonating.

But the idea of simply placing Kennedy atop the Libertarian Party ticket to marry his momentum with their organization left Kennedy with an embarrassing loss at the Libertarian Party convention in Washington. About half – 51% – said they would support Trump in a two-way matchup, compared with 37% who said they would pick Biden. The last third-party candidate to win a state and get Electoral Votes was George Wallace, who won Southern states in 1968. The only third-party candidate to outperform a major party candidate was former President Teddy Roosevelt, who outpolled Republicans after he failed to get their nomination in 1912 and then ran as a third-party candidate. But rather than focus on the relatively few people who turn out for a third-party candidate, why not look at the large number of people who don’t take part in elections at all?

Trump’s lead jumped to 9 points over Biden when Kennedy, Green Party candidate Jill Stein and independent Cornel West were included in the ballot test. (To make the debate stage, candidates must also appear on state ballots totaling at least 270 electoral votes. I should point out that third party and independent candidates tend to see their polling decline over the course of the campaign. Now, it’s quite possible that Kennedy voters will stick by him the more they hear about his positions. National polling for the most part has, after all, shown Kennedy voters prefer Trump to Biden, though not uniformly.

Roughly half of US adults, 49%, want to see federal politicians work to enshrine abortion access nationally, while 37% say abortion laws should be left to states, and 14% call for nationwide restrictions. The poll comes in the wake of two years of largely state-level skirmishes over abortion laws following the overturn of Roe – political fights with tangible consequences for residents’ access to abortion in those states. The share who view their state’s abortion laws as too restrictive rises to 43% in the states where abortion is currently legal with gestational limits of 6-18 weeks, and to 52% in the states where it is banned. Among those who disapprove of overturning Roe, about two-thirds (64%) in states with gestational limits and three-quarters (74%) in states where abortion is banned find their state’s laws too restrictive. The CNN poll was conducted by SSRS from April 18-23 among a random national sample of 1,212 adults drawn from a probability-based panel, including 967 registered voters.

Trump’s success might make you believe that he has turned the conventional wisdom on its head – that somehow, his legal troubles are helping him politically. There isn’t much of a sign that Trump’s legal woes are helping him among the wider electorate, even if they aren’t hurting him necessarily. Consider Trump’s polling against President Joe Biden. You might think that Trump would be gaining against Biden, if the cases against Trump were helping him. It’s not clear whether the money Trump’s raising because of appeals to his base during his legal troubles is offsetting the amount his committees are spending.

Overall, 92% of Republicans call Trump’s time in office a success, while just 73% of Democrats say Biden’s has been a success so far. Among independents, 51% say Trump’s presidency was successful, while only 37% see Biden’s as a success. Those voters who say the economy is deeply important break heavily for Trump in a matchup against Biden, 62% to 30%. CNN —As the first criminal prosecution of a former American president began just 13% nationwide feel Donald Trump is being treated the same as other criminal defendants, a new CNN poll conducted by SSRS finds. Most of the country was divided over whether he is being treated more harshly (34%) or more leniently (34%) than other defendants. Most Democrats and Democratic-leaning independents say Trump is being treated more leniently than other defendants by the criminal justice system (61%), while Republicans and Republican-leaning independents largely say he’s being treated more harshly than others (67%). A broad majority of Democratic-aligned Americans say Trump’s behavior during the trial thus far has been inappropriate (72%), though Republicans haven’t leapt to his defense. Only 46% of Republicans and Republican-leaning independents say Trump’s conduct has been appropriate, with 15% saying it’s been inappropriate and 39% that they haven’t heard enough to say.

Washington CNN —President Joe Biden is fit for duty, his doctor reported Wednesday following the president’s annual physical, in what is expected to be the last update on Biden’s health before November’s election. Dr. Kevin O’Connor said in a memo there are “no new concerns” with the president’s health revealed by this year’s physical. The White House said earlier Wednesday that no cognitive test was administered as O’Connor did not find it necessary. The procedure was “successfully completed” at the White House by a team from Walter Reed, O’Connor said. Reports from the White House physician over the last several decades have consistently described the office-holder as fit to serve.

CNN —President Joe Biden and his allies attacked Donald Trump over abortion after the New York Times reported Friday that the former president has privately expressed support for a 16-week federal ban, as Democrats center the politically potent issue ahead of November’s election. Trump campaign spokesperson Karoline Leavitt told CNN the former president has not committed to backing a national abortion ban. But Trump has not made abortion a key part of his campaign speeches and has steered clear on the trail from outlining any specific abortion legislation he would push for if reelected. The trial date in his New York hush money case was confirmed to be March 25. Trump’s lawyers are hoping to get the Georgia case thrown out or at least delayed over Willis’ conduct. That well could be the case if the New York case finishes first, which looks most likely given that it will probably start first. Of course, the Georgia case is currently on an uncertain timeline with a lead prosecutor who may not end up being the prosecutor who brings the case to trial. The bottom line is that no one wants to be on trial, but if Trump had to pick, he’d much rather go first with the New York case.

CNN —At least 63% of American Jews said their place in American society is less secure than a year ago, according to a new report released Tuesday by the American Jewish Committee. The share of American Jews who said the status of Jews in the United States has become less secure increased 22 percentage points when compared to last year’s survey. The American Jewish Committee has commissioned a survey on the state of antisemitism in the US annually since 2019. Nearly half of American Jews said they think antisemitism is taken less seriously than other forms of hate and bigotry, according to the survey. That’s compared to 38% of American Jews in 2022, according to the advocacy organization.

Nearly two-thirds of American Jews feel less secure in the U.S. than they did a year ago, according to a new national survey. The American Jewish Committee, a prominent advocacy organization, conducted the survey last fall just as the Israel-Hamas war began on Oct. 7. The number of American Jews who say they feel less secure in the U.S. jumped 22% from last year’s survey. The survey released Tuesday found one quarter of American Jews said they have been the target of antisemitism in the past year.
