A judge in Massachusetts declared a mistrial on Monday in the high-profile murder case against Karen Read, the suburban woman who was accused of killing her boyfriend, a Boston police officer, after a night out drinking. The jurors began deliberating early last week, and twice signaled to the court that they were having trouble reaching a unanimous verdict. In a note to Judge Beverly J. Cannone of Norfolk Superior Court on Monday morning, they wrote that they had “fundamental differences in our opinions,” and that “consensus is unattainable.”The judge then read them last-ditch instructions about the importance of reaching a verdict. But hours later, the 12 jurors declared themselves deadlocked, and Judge Cannone declared a mistrial. Prosecutors said in a statement that they intended to try the case again.

The National Transportation Safety Board issued a series of recommendations on Tuesday aimed at preventing the type of freight train derailment that occurred last year in East Palestine, Ohio, when 38 rail cars operated by Norfolk Southern came off the tracks. The safety agency also faulted Norfolk Southern for concluding that the hazardous material being transported on 11 of the rail cars was at risk of exploding. That conclusion led to a “vent and burn,” in which toxic chemicals were released and incinerated, resulting in vast plumes of dark smoke rising above the town. The controlled burn forced many residents of the town to evacuate. had previously raised doubts about the need for a vent and burn and at a meeting in East Palestine on Tuesday, the agency said the railway had “misinterpreted and disregarded evidence” in reaching that conclusion.

Norfolk Southern told public officials who authorized the controlled burn, known as a vent and burn procedure, that it was the only way to prevent a catastrophic and uncontrolled explosion. Norfolk Southern has agreed to pay more than $310 million to settle claims and cover costs stemming from the February 2023 derailment of a freight train carrying hazardous materials in an Ohio town, the federal government said on Thursday. The Department of Justice and the Environmental Protection Agency said the settlement, which still needs to be approved by a federal court, requires Norfolk Southern to improve rail safety and pay for cleanup costs and health and environmental monitoring in and around East Palestine, Ohio, where the accident happened. On a Friday night in early February last year, 38 rail cars on a Norfolk Southern train derailed, 11 of which were carrying hazard materials like vinyl chloride, a chemical used to make plastics. Days later, emergency responders, fearing an explosion, decided to release and burn vinyl chloride from derailed cars, sending vast plumes of dark smoke over the town. Hundreds of residents were evacuated and life in East Palestine was upended for months.

Whether today's activist investors contribute any genuine economic value is open for debate. As this year's proxy season draws to a close, defeat after defeat for activist investors in proxy fights this year – most prominently at Disney and Norfolk Southern – raises the question: Are activist investors increasingly getting de-activated, losing their credibility and power? These self-styled "activist investors" are distinct from the original activists who helped catalyze needed governance reforms two decades back. Many of today's activist investors are a far cry from the original, heroic crusaders for shareholder value who pioneered the activism space decades ago. However, given the failing financial performance of many of today's activist investors, their losing streak in proxy fights and increasing public rejection of their bullying tactics, the credibility and value of activist investors writ large is increasingly imperiled.
