CNN —A judge has scheduled a major defamation case against right-wing cable channel Newsmax to go to trial in late September, putting the battle over 2020 election lies front-and-center at the peak of the 2024 campaign. A trial could have significant implications for the First Amendment and how journalists cover Trump’s election lies. The conservative network doesn’t attract a large audience like Fox News, but Newsmax’s ratings surged after the 2020 election. In addition to the Newsmax case, Smartmatic is also suing Fox News, the fringe far-right cable channel OAN and Trump allies like Rudy Giuliani and Mike Lindell, who peddled the same election lies. But there were delays in that case, creating an opening for the Smartmatic case.

The revelation builds on CNN’s previous reporting that OAN President Charles Herring forwarded the purported Smartmatic passwords to ex-Trump campaign lawyer Sidney Powell within days and later passed it to Mike Lindell. OAN denies defaming Smartmatic or anyone else, and its lawyers say nobody at OAN broke the law in connection with the alleged passwords. In a recent court filing, Smartmatic publicly disclosed – for the first time – the original email that OAN received on January 5, 2021, containing the alleged passwords. If you come across any addition (sic) information, please pass along,” according to emails made public in court filings. OAN handed over the emails to Smartmatic last year, but later claimed they were privileged and should be returned.

MINNEAPOLIS (AP) — MyPillow chief executive and prominent election denier Mike Lindell said Friday that Fox News has stopped running his company's commercials, disputing the network's assertion that it is simply because he hasn't paid his bills. Lindell went public by tweeting that Fox, which had been one of MyPillow's biggest advertising outlets, had canceled him. Several big-box retailers, including Walmart, have discontinued his products, and lawyers who were defending him against defamation lawsuits by voting machine companies quit. In an interview with The Associated Press, Lindell acknowledged that MyPillow owes money to Fox. He said MyPillow has long spent an average of $1 million a week to run its ads on Fox.

The White House took aim at former President Donald Trump after the Republican presidential candidate front-runner said he hoped the economy would crash this year rather than during his theoretical second term. Economists have forecast economic slowing in 2024, but consensus has not gone so far as to cry recession. The White House used Trump's comment as an opportunity to tout Biden's economic wins and to draw contrasts with the previous administration. Trump has taken advantage of Biden's struggling economic narrative on the campaign trail, reminiscing on what he claims was a golden economy under his administration. Under Trump, the economy expanded for several years but the stock market ultimately came crashing down in 2020 at the advent of the pandemic while Trump was still in office.

Would some deny the results of the last presidential election? But since then, election conspiracy theories have taken root in the rural, heavily Republican county in northeastern Wisconsin. When she’s defended the election process, Pytleski, a lifelong Republican, has been called a RINO — a Republican in Name Only. The group's efforts come as distrust in elections has gained a persistent foothold across the country, especially in rural areas. Even with that level of local trust, the false belief that the 2020 presidential election was stolen permeates the community.

BRIDGEPORT, Conn. (AP) — A local Democratic official in Connecticut's largest city invoked her 5th Amendment right against self-incrimination Friday rather than answer questions in court about allegations of illegal ballot box stuffing during a recent mayoral primary. In some of them, a woman resembling Geter-Pataky, who works as a greeter at the City Hall annex, can be seen making repeat trips to an absentee ballot drop box outside the building early in the morning on Sept. 5 and stuffing documents inside. In other videos, it appears she hands other people documents that could be ballots and escorts them to the box. Gomes' attorney in the lawsuit, William Bloss, said the videos prove widespread abuse of the absentee ballot system in Bridgeport. Under Connecticut law, certain family members, police, local election officials or a caregiver can drop off a ballot for an absentee voter.

Mike Lindell, CEO of My Pillow Inc., speaks during the Conservative Political Action Conference (CPAC) in Dallas, Texas, on Friday, Aug. 5, 2022. The attorneys defending Mike Lindell and his business against defamation claims from voting machine companies are seeking to sever ties with the "MyPillow Guy" over millions of dollars in unpaid legal fees. "At this time, Defendants are in arrears by millions of dollars to PDK," the filing said. The firm said that if it was forced to continue providing legal services to Lindell, the "future fees and costs will amount to millions of dollars in addition to the millions of dollars already owed." CNN —Attorneys representing conspiracy theorist Mike Lindell and his company MyPillow in a defamation lawsuit brought by Dominion Voting Systems asked to withdraw from the case on Thursday after Lindell allegedly racked up millions in unpaid legal fees. In a court filing, Minnesota-based Parker Daniels Kibort said both Lindell and MyPillow have not paid the firm for its work on the case and won’t be able to pay future fees and costs. But Lindell was adamant that he would not settle with Dominion or Smartmatic, another election technology company suing him for defamation. The court must grant the attorneys’ motion to withdraw before they can formally drop Lindell and MyPillow as clients. Attorneys for Dominion did not have a position regarding the motion when it was filed, the court filing shows.

CNN —Smartmatic, the voting technology company suing Fox News and former President Donald Trump’s top allies over their false claims that its machines rigged the 2020 election, was implicated in an alleged bribery scheme involving the former top election official in the Philippines, according to court filings obtained by CNN. The court documents indicate that the Justice Department has filed money laundering charges against former Filipino election administrator Andres Bautista – and that four executives from Smartmatic subsidiaries are implicated as uncharged co-conspirators. Bautista awarded $199 million in contracts to Smartmatic for about 94,000 voting machines and to handle the results of the Philippines’ presidential election in 2016. The new allegations of corrupt foreign dealings could boost the defense for Fox News and the other Trump allies currently fighting Smartmatic in court. The criminal complaint against Bautista doesn’t accuse Smartmatic of tampering with election results in the Philippines or any other jurisdiction.

CNN —Dominion Voting Systems’ $1.6 billion defamation lawsuit against Newsmax over the right-wing network’s airing of 2020 election lies is scheduled to go to trial in late September 2024, a Delaware judge decided. The decision by Delaware Superior Court Judge Eric Davis means — barring an out-of-court settlement — Trump’s lies about the 2020 election will be front and center at a four-week trial during the closing weeks of the 2024 election. Davis presided over a similar high-profile defamation case brought by Dominion against Fox News over the network’s airing of election lies. The case ended in April with a last-second $787 million settlement, the largest publicly known defamation settlement in US history.
